Servicing and Origination Costs. Except as expressly set forth in this Agreement, Bank One shall be solely responsible for and shall pay all costs due to any third party from Bank One (including, without limitation, amounts due to XXXX or Servicer) with respect to origination of EDUCATION ONE Loans and with respect to loan servicing of EDUCATION ONE Loans incurred prior to purchase of the respective EDUCATION ONE Loans hereunder. FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the Bank of America DTC Loans and shall be solely responsible for arranging and paying all costs for servicing of the Bank of America DTC Loans after purchase of such Loans.

FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the Bank of America GATE Conforming Loans.

FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the NextStudent Conforming Loans and shall be solely responsible for arranging and paying all costs for servicing of the NextStudent Conforming Loans after purchase of such Loans.

Purchaser shall be solely responsible for and shall pay all costs due to any third party from Purchaser (including, without limitation, amounts due to Servicer) with respect to servicing of the Loans incurred upon or after the purchase of the Loans hereunder.

FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the Bank of America Direct to Consumer Conforming Loans and shall be solely responsible for arranging and paying all costs for servicing of the Bank of America Direct to Consumer Conforming Loans after purchase of such Loans.

FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the CFS Conforming Loans and shall be solely responsible for arranging and paying all costs for servicing of the CFS Conforming Loans after purchase of such Loans.

FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the GMAC Bank Conforming Loans and shall be solely responsible for arranging and paying all costs for servicing of the GMAC Bank Conforming Loans after purchase of such Loans.

FMC shall be solely responsible for and shall pay any obligations it has incurred in connection with the UFSB Astrive Conforming Loans and shall be solely responsible for arranging and paying all costs for servicing of the UFSB Astrive Conforming Loans after purchase of such Loans. 3.09.
