Servicing Contract. An agreement between the Master Servicer and a Primary Servicer, Special Servicer or Subservicer relating to the servicing of Mortgage Loans. The Servicing Contract may be a general agreement that is entered into before or after the formation of any particular Trust, may include more than one written document (including a mortgage selling and servicing contract, a master agreement and any related pool purchase contract), and may apply to Mortgage Loans in one or more Pools and loans in Other Xxxxxx Xxx Trusts or owned by one or more other Persons.
Servicing Contract. An agreement between the Master Servicer and a Direct Servicer or Subservicer that relates to the servicing of Mortgage Loans and is comprised of the mortgage selling and servicing contract (which incorporates the Guide), as the same may be amended from time to time by any other written agreements between the parties (including master agreements and any related pool purchase contracts). The Servicing Contract applies to the servicing of Mortgage Loans at time of delivery, and may apply to Mortgage Loans in one or more Pools and loans in other Xxxxxx Xxx Trusts or loans owned by one or more other Persons.
Servicing Contract. The Xxxxxx Xxx Servicing Contract is in full force and effect, and Borrower has not been terminated as the servicer under the Xxxxxx Xxx Servicing Contract.

Servicing Contract. In the event a Title III Plan has been confirmed providing for the Securitization SPV to issue new secured debt, Owner shall have received a copy of the Servicing Contract, duly executed by Operator.
Servicing Contract. Operator shall at all times conduct the billing and collection services in compliance with the terms of any Servicing Contract then in effect. In the event of any conflict or issue of interpretation between such Servicing Contract and this Agreement in connection with Operator’s obligations for billing and collection services, the Servicing Contract shall prevail over this Agreement.
Servicing Contract. The Borrower has delivered to the Lender a true and complete copy of the Servicing Contract and all amendments thereto (in each case, to the extent requested by the Lender), other than the Guide or other information publicly available on or through Xxxxxxx Mac’s website.
Servicing Contract. The Fannie Mae Servicing Contract is in full force and exxxxx, and Borrower has not been terminated as the servicer under the Fannie Mae Servicing Contract.
