Settlement Class Member Benefits. Settlement Class Members shall be eligible to receive monetary benefits from the Net Settlement Fund in accordance with the Distribution Plan.
Settlement Class Member Benefits. When submitting a Valid Claim, Settlement Class Members must choose either Cash Payment A or Cash Payment B. Settlement Class Members may also elect to receive Identity Monitoring in accordance with the terms set forth hereinbelow. Cash Payments will be subject to a pro rata increase from the Net Settlement Fund in the event the amount of Valid Claims is insufficient to exhaust the entire Net Settlement Fund. Similarly, in the event the amount of Valid Claims exhausts the amount of the Net Settlement Fund, the amount of the Cash Payments may be reduced pro rata accordingly. For purposes of calculating the amount of the increase or decrease, the Settlement Administrator must first pay for Identity Monitoring before distributing the funds in the Net Settlement Fund for Cash Payments. Any pro rata increases or decreases to Cash Payments will be on an equal percentage basis. In the unexpected event the value of the Identity Monitoring on its own exhausts the amount of the Net Settlement Fund, the length of the Identity Monitoring provided will be reduced as necessary to bring the cost within the Net Settlement Fund. If a Settlement Class Member does not submit a Valid Claim, the Settlement Class Member will release his or her claims against the Released Parties without receiving a Settlement Class Member Benefit.
Settlement Class Member Benefits. Cash benefits shall be paid to each Settlement Class Member who submits a Valid Claim in accordance with the following terms: • Settlement Class Members who timely submit a valid Claim Form with Proof of Purchase of a Covered Product shall receive the full purchase price for each unit of Covered Product listed on the Proof of Purchase, inclusive of all taxes. • Settlement Class Members who timely submit a valid Claim Form without Proof of Purchase of a Covered Product shall receive the average retail price for up to two (2) Covered Products claimed per Household, plus a 10% allowance for sales tax. • If a Settlement Class Member or any person in that Settlement Class Member’s Household received Recall Reimbursement, regardless of whether such Recall Reimbursement was provided in the form of cash, check, gift card or coupon, as reflected on the Settlement Class Member’s Claim Form or in the records of Defendant, the amount of that Settlement Class Member’s payment shall be reduced by the amount of Recall Reimbursement that Settlement Class Member or persons in that Settlement Class Member’s Household have received (provided that the payment shall not be reduced below $0.00). • Each Settlement Class Member’s payment shall be increased or decreased on a pro rata basis such that the total amount paid to all Settlement Class Members equals the Available Settlement Funds.
Settlement Class Member Benefits. Settlement Class Members shall be eligible to receive benefits in accordance with the Claims Process Plan provided in Section 3.2. Settlement Class Members will have the option to claim from the Credit Settlement or the Cash Claims-Made Settlement.

Any pro rata increases or decreases to Cash Payments and California Statutory Awards will be on an equal percentage basis. In the unexpected event the value of Credit Monitoring on its own exhausts the amount of the Net Settlement Fund, the length of the Credit Monitoring provided will be reduced as necessary to bring the cost within the Net Settlement Fund. If a Settlement Class Member does not submit a Valid Claim, the Settlement Class Member will release his or her claims against the Released Parties without receiving a Settlement Class Member Benefit.

Settlement Class Member Benefits. Settlement Class Members may submit claims for up to 50 Calls received within the Class Period, subject to verification by the Claims Administrator. To the extent that Settlement Class Members that file a claim submit no records of how many Calls they received within the Class Period, the Claims Administrator shall apply the number of Calls for each such Settlement Class Member as reflected in Momentum’s call log records subject to a cap of 50 Calls per Settlement Class Member filing a valid claim. Settlement Class Members that file timely and valid claims shall be entitled to a pro rata share of any amounts paid into the Common Fund on a per-call basis, net of any attorneys’ fees, costs, expenses or any other Claims Administration Expenses, until the entirety of the Common Fund is exhausted, subject to any remainder that cannot administratively feasibly be distributed to the Settlement Class being distributed to a cy pres recipient to be approved by the Court.

Defendant agrees to make available up to Eight Million Two Hundred Fifty Thousand Dollars and No Cents ($8,250,000.00) which shall be used by the Settlement Administrator to pay for: (i) reasonable Notice and Claims Administration Costs incurred pursuant to this Settlement Agreement as approved by the Parties and approved by the Court, (ii) any taxes owed, (iii) any Service Awards approved by the Court, (iv) any Attorneys’ Fees, Costs, and Expenses Award as approved by the Court, and (v) any benefits to Settlement Class Members, pursuant to the terms and conditions of the Settlement Agreement.
