Common use of Sierra Club Clause in Contracts

Sierra Club. The Sierra Club and its respective employees, officers, governing boards and committees covenant not to take any action to challenge, in a formal administrative or judicial proceeding, any certifications, permits or approvals for a Post- Settlement Alignment that may be required under the Environmental Review Process for the SR 241 Extension Project, including the specific actions set forth in Section 5.3.1.1 through 5.3.1.6 inclusive, so long as TCA complies with the mitigation required by any state or federal agency as a condition of any approval, finding, concurrence, or permit under the Environmental Review Process for the SR 241 Extension Project, and subject to each of the exceptions set forth in Section 5.3.2.
