The companies must individually determine their needs and jointly assess the cost of permanent restoration to determine the overall plan of action. Multiple restoration trailers from each company will result in the need for designated space and installation order. This layout and control is required to maximize the amount of restoration equipment that can be placed at the site, and the priority of placements. Care must be taken in this planning to ensure other restoration efforts have logistical access to the building. Major components of telephone and building equipment will need to be removed and replaced. A priority for this equipment must also be jointly established to facilitate overall site restoration. (Example: If the AC switchgear has sustained damage, this would be of the highest priority in order to regain power, lighting, and HVAC throughout the building.) Site Control. Seller shall have Site Control as of the earlier of: (a) the Commercial Operation Date; or (b) any date before the Commercial Operation Date to the extent necessary for the Seller to perform its obligations under this Agreement and, in each case, Seller shall maintain Site Control throughout the Term. Seller shall promptly provide Buyer with Notice if there is any change in the status of Seller’s Site Control.
Site Control. Unless otherwise agreed to by NYSERDA in writing, within one hundred and ninety (190) days of the Award Notification Date, Seller shall provide documentation demonstrating rights-of-way or full control of the acreage needed for any interconnection facilities, and, should the Bid Facility site acreage exceed fifteen (15) acres, documentation demonstrating full control of the Bid Facility site acreage.
Site Control. Within 60 days of the Effective Date and until the Term End Date, Seller shall have Site Control.
Site Control. Seller shall demonstrate site control as of the Effective Date of this Agreement by ownership or lease of real property sufficient to enable Seller to finance, construct and operate the Facility, with any such lease having a term equal to or greater than the Term of this Agreement.

32.1.5.1 Ownership of, a leasehold interest in, or a right to develop a site for the purpose of constructing the Small Generating Facility;
32.1.5.2 An option to purchase or acquire a leasehold site for such purpose; or
32.1.5.3 An exclusivity or other business relationship between the Interconnection Customer and the entity having the right to sell, lease, or grant the Interconnection Customer the right to possess or occupy a site for such purpose.
Site Control. As of the Effective Date, Seller holds a federal lease issued on a competitive basis after January 1, 2012 for an offshore wind energy generation site located on the Outer Continental Shelf and for which no turbine is located within ten miles of any inhabited area; and, as of the date set forth in 3.1(a)(i) for such Critical Milestone (as extended pursuant to Sections 3.1(c), 3.1(e), and 10.1), Seller will have acquired all other real property rights to construct and operate the Facility, to interconnect the Facility to the Interconnecting Utility, to construct the Network Upgrades (to the extent it is Seller’s responsibility to do so) and to perform Seller’s obligations under this Agreement.
Site Control. At all times during the Term, Seller shall control the Site through ownership or lease and shall provide PGE with prompt notice of any change in control of the Site.
Site Control. As of the Effective Date, Seller either (i) has acquired all real property rights to construct and operate the Facility, to interconnect the Facility to the Interconnecting Utility, to construct the Network Upgrades (to the extent it is Seller’s responsibility to do so) and to perform Seller’s obligations under this Agreement or (ii) has an irrevocable option to acquire such real property rights and the only condition upon Seller’s exercise of such option to acquire such real property rights is the payment of monies to acquire such real property rights.
