SOCIAL SECURITY AND UNEMPLOYMENT INSURANCE. (A) The Actor shall be covered by all federal and state laws constituting what are commonly known as social security acts, including unemployment insurance, and it is further agreed that the Producer, during the term of the Actor's contract, shall pay any and all taxes or payments required to be paid by employers under the provisions of said laws. (B) If the Producer is not required to provide benefits under the law, the Producer shall provide social security benefits under the elective provisions of the social security law. (C) In the event the services of the Actor are not subject to the compulsory provisions of an unemployment compensation law of any state, then the Producer xxxxxx agrees that the Producer shall elect to cover the services of the Actor, and pay contributions on the services of the Actor, under the elective provisions of the unemployment insurance law of the state of New York, and/or such other eligible state as Equity may determine to be in the best interests of the majority of the Actors employed by the Producer. The Producer shall elect said coverage, execute and file the necessary forms, and pay contributions within the time required by the applicable state law. (D) The Producer shall advise the Actor of the state in which the coverage obtains and shall furnish the Producer's unemployment registration number to the Actor and to Equity as soon as such number is assigned to the Producer. (E) The Producer shall submit proof satisfactory to Equity that the Producer has applied for unemployment insurance coverage, and deliver a true copy of the Producer's application to Equity. The Producer warrants and represents that the Producer shall not withdraw such application nor modify nor change it without written consent of Equity. (F) In the event any Producer fails to provide unemployment insurance coverage where designated and available, the Producer shall pay to the Actor the equivalent of any unemployment insurance benefits the Actor may lose as a result thereby. This obligation shall survive the termination of the Actor's contract of employment.

(Cc) No reference shall be made to amounts declared as exempt for Federal Income Tax Withholding purposes in determining what constitutes gross compensation for the purposes of Unemployment Insurance and Social Security.
(d) In the event event, however, the services EMPLOYER is not eligible to elect to come under the New York State Unemployment Insurance Law then he agrees to elect to come under the Unemployment Compensation (Insurance) Law of the Actor are not subject to the compulsory provisions State where he has his principal place of an unemployment compensation law of any statebusiness, then the Producer xxxxxx agrees that the Producer shall elect to cover the services or of the Actor, and pay contributions on the services State of the ActorARTIST's residence, under the elective provisions or of the unemployment insurance law State where the contracts of the state of New York, and/or such other eligible state as Equity may determine employment were entered into.
(e) The EMPLOYER agrees to be in the best interests of the majority of the Actors employed by the Producer. The Producer shall elect said coverage, execute and file the necessary forms, and pay contributions within the time forms required by the applicable state lawState Unemployment Compensation (Insurance) Law under which he has elected to cover the ARTIST and shall notify the ARTIST of his election.
(Df) The Producer shall advise If EMPLOYER complies with subparagraphs (a) or (c) he further agrees to obtain coverage for all ARTISTS employed hereunder with the Actor Disability Benefit Law of the state in which the coverage obtains and shall furnish the Producer's unemployment registration number to the Actor and to Equity as soon as such number is assigned to the ProducerState of New York.
(Eg) The Producer Upon request of AGMA, the EMPLOYER shall submit proof satisfactory disclose to Equity that the Producer has applied for unemployment insurance coverage, and deliver a true copy AGMA evidence of the ProducerEMPLOYER's application to Equity. The Producer warrants and represents that compliance with the Producer shall not withdraw such application nor modify nor change it without written consent provisions of Equitythis Paragraph 10.
(Fh) In EMPLOYER shall elect coverage for all ARTISTS who are residents of New York State under the event any Producer fails to provide unemployment insurance coverage where designated and available, the Producer shall pay to the Actor the equivalent of any unemployment insurance benefits the Actor may lose as a result thereby. In the event the Producer is not required subject to provide benefits under the lawfederal Social Security Act, the Producer shall provide agrees to elect to make the necessary contributions to F.I.C.A. in order to protect the social security benefits under of each Actor in the elective provisions of the social security law.
(C) Producer's employ. In the event the services of the Actor are not subject to the compulsory provisions of an unemployment compensation (insurance) law of any state, then the Producer xxxxxx agrees that the Producer shall he will elect to cover the services of the Actor, Actor and pay contributions on the services earnings of the Actor, Actor under the elective provisions of the unemployment insurance law of the state of New York, York and/or such other eligible state as Equity may determine to be in the best interests of the majority of the Actors employed by the Producer. In the event, however, that the Producer is not eligible to elect to come under the New York state unemployment insurance law and if Equity has not designated another eligible state, the Producer agrees to elect to come under the unemployment compensation (insurance) law of the state in which the Producer has his principal place of business, the state of the Actor's residence or the state in which the contract of employment was entered. The Producer shall agrees to elect said coverage, execute coverage and file the necessary forms, and to pay contributions within the time required by the applicable state law.
(D) . When such election is made to New York State, the Producer agrees to report the Actor by name, social security number and by New York address to the appropriate agency during the first week of the Actor's employment, but in no event later than the quarter in which the work is performed. The Producer agrees to execute and file the necessary forms required by the state unemployment compensation (insurance) law under which the Producer has elected to cover the Actor and he shall advise notify the Actor of said election. Simultaneously with the state in which posting of security, the coverage obtains and shall furnish the Producer's unemployment registration number to the Actor and to Equity as soon as such number is assigned to the Producer.
(E) The Producer shall submit proof proof, satisfactory to Equity Equity, that the Producer has applied for unemployment insurance coverage, coverage and deliver a true copy of the Producer's said application to Equity. The Producer warrants and represents that the Producer shall he will not withdraw such application application, nor modify nor or change it it, without the written consent of Equity.
(F) . In the event that any Producer Producer: (1) fails to provide apply for unemployment insurance coverage; (2) withdraws or modifies any application for such coverage where designated and availablewithout the written consent of Equity; (3) fails to elect coverage within the time required by applicable state law; or (4) fails to pay the required insurance contributions to the appropriate state agencies within the time required, the Producer shall must pay to the Actor the equivalent of any unemployment insurance benefits the Actor may lose as a result therebyresult. This obligation shall survive the termination of the Actor's contract of employment. Equity may require the Producer to xxxxxxx satisfactory evidence that the Producer has obtained and maintained maximum unemployment insurance coverage for Actors employed by the Producer in accordance with this Rule. If Equity is not so satisfied, it may retain the Producer's security (bond) as a fund against such claims.
