Software Application. The following terms apply if you download Software:
(a) We grant to you a non-exclusive and non-transferable single-user (non-concurrent) license for the Software for individual use only. The license authorizes you to use the Software in object code format for the purpose of using Mobile Banking, accessing the Mobile Wallet and/or accessing any services, features, functionality, content and/or information made available by us using certain Electronic Access Devices.
(b) We retain at all times all ownership rights, including without limitation, copyright, in the Software. You agree not to copy, reproduce, transfer copies or reverse engineer the Software and not to disclose or distribute the Software to third parties. We have no obligation to provide any training, maintenance, or other assistance for the Software.
(c) YOU ACCEPT THE SOFTWARE "AS IS" AND ASSUME THE ENTIRE RISK FOR THE PERFORMANCE OF THE SOFTWARE. WE WILL NOT BE LIABLE TO YOU FOR ANY DAMAGES RESULTING FROM YOUR USE OF THE SOFTWARE, UNDER THIS AGREEMENT OR OTHERWISE.
(d) We may end the terms relating to the Software in this Section 24 at any time on notice to you. On the ending of these terms, you will destroy or return all copies of the Software or of any documentation for it then in your possession. The grant of the license in this Section 24 may not be assigned by you unless agreed upon in writing by us.
(e) By choosing to install Software such as our Apps on your Electronic Access Device for the purpose of accessing certain mobile services such as Mobile Banking and Mobile Payments:
1. You consent to the installation of Software and any future updates or upgrades to the Software. You may withdraw your consent by deleting the Software from your Electronic Access Device. 2. You consent to and provide written acknowledgement of Software functions including accessing recipient information from your contact list for the e-Transfer Service, accessing your camera for Mobile Cheque Deposit and accessing your physical location for Find a Location. Software Application. Solutions Contract Manager means a duly authorised representative of the CUSTOMER nominated in writing to the SERVICE PROVIDER by the CUSTOMER and a duly authorised representative of the SERVICE PROVIDER nominated in writing to the CUSTOMER by the SERVICE PROVIDER.
Software Application. 17.1 In the event that the Licensor shall go into liquidation other than a voluntary liquidation for the purpose of reconstruction or amalgamation, the Licensor shall, in so far as it is permitted in law to do so, provide to the Licensee, at no additional charge, a copy of the Software licensed in perpetuity together with all necessary documentation with a copy of the Licensee’s current database.
Software Application. The Remote Deposit Service includes the Software Application(“Application”). The Application resides on servers located at the Credit Union’s service provider, and is made available to Credit Union members by means of the Internet. We grant you a limited, non-exclusive, and non-assignable right and license to have access to, and use of, the Application in accordance with the terms of this Agreement. Upon our acceptance of this Agreement, we will provide you with login access to the Application. The Application may be used solely in connection with the Remote Deposit Service and may not be used by you for any other reason. You may not grant any sublicenses to the Application. You agree that you will not(i)modify, change, alter, translate, create derivative works from, reverse engineer, disassemble or decompile the technology or Application, (ii) copy or reproduce all or any part of the technology or Application, or
Software Application. The application must support the following areas of activity: 1) inventory, 2) inspection, 3) violations, 4) permits, 5) billing, 6) invoicing, 7) staff, 8) timekeeping, 9) wireless access, 10) portable field computing for inspections, 11) ability to post inspection data on the department's website, 12) automated reporting for multiple state agencies, 13) database integration, 14) public portal access, 15) publication system for online inspection results, and 16) canned and custom reports.
Software Application. In order to guarantee the integrity and continuity of the Site and application, the Service Provider will perform daily software backups (both remote in the server as well as local) that allow the Service Provider to recover the application at any given time.
Software Application. You may install, use, access, display, run or otherwise interact with (collectively, “run”) a copy of the Software on any single device, including but not limited to computers (except network computers), workstations, terminals, handheld PCs, beepers, smart phones or other digital electronic devices connected to the local network (collectively, the “Computer”). The main user of the Computer running the Software may make a second copy for use on laptops only.
