Software Customization. Any customizations of the Software shall not infringe upon or violate any patent, copyright, trade secret or other property right of any third party. In addition, Vendor hereby represents and warrants that any Software application customized shall meet the specifications as provided in the Contract. If the Board notifies Vendor, or Vendor becomes aware, of any non-performance, error or defect covered by the foregoing warranties, the Vendor shall, at its own expense, promptly correct such non-performance, error or defect, but in no event later than 30 days after notification by the Board. Any repair or replacement of Software or Services or portions thereof will be additionally and automatically warranted therein.

Software Customization. Shift4 shall provide reasonable Software customization based on the information requested by Shift4 and provided by Merchant. Any additional customization after the Equipment has been shipped to Merchant is excluded from this Service Agreement and will be charged at Shift4's then current rate. SHIFT4 DOES NOT WARRANT THAT CUSTOMIZATION WILL BE FREE FROM DEFECTS OR MISTAKES. SHIFT4 EXPRESSLY DISCLAIMS AND MERCHANT AGREES TO HOLD SHIFT4 HARMLESS FOR ANY ERRORS IN THE EQUIPMENT AND SOFTWARE.
Software Customization. All Software customization is provided "AS IS", without a warranty of any kind.
Software Customization. After Purchaser and the Seller’s provisioning team have performed the data collection task, the software translations can be completed. Upon mutual agreement that the Purchaser’s collected information is complete and all requested and purchased features and functionality are included, the Purchaser’s information is loaded into the system software one time. If Purchaser initiates additional changes at any point after agreeing that the information provided is complete, additional charges may be levied. The Seller will have the right to charge for the time and costs incurred by the Seller’s provisioning team at Seller’s then prevailing hourly rates.
Software Customization. With the participation and agreement of TELKOM, PARTNER shall customize TELKOM's existing software to meet TELKOM's internal and/or external business requirements in relation to operation and maintenance of the Network PARTNER shall: - Work with TELKOM to determine the customization requirements of the software; - Prepare release notes stating the reasons for each software customization for TELKOM's approval; - Prepare and customize the software upon receipt of TELKOM's approval; - Install the customized software on the Network; - Provide TELKOM with an implementation report after each installation; and - Perform software version maintenance.

Software Customization. Under the terms of the support agreement, Purchaser may require one or more modifications to NoMatterWare as requested by NoMatterWare customers. Such modifications can be divided into two categories: (a) Graphic Artwork and Cosmetic Modifications - alterations to the Products that do not require changes to the underlying source code or business logic Purchaser may perform any and all graphic and cosmetic modifications or assign the performance of the modifications to a third party without the consent of Company. The Purchaser's Customer will pay Purchaser One Hundred Percent (100%) of any and all fees charged to the Purchaser's Customer by Purchaser for Graphic Artwork and Cosmetic Modifications and Company lays no claim to such fees unless Company conducts the work, in which case such fees will be paid by Purchaser to Customer without set off or deduction. (b) Source Code Modifications - modifications to the programming logic embedded in the Products. These modifications are not related to bugs, flaws, or defects in the products in any manner. Company will make reasonable efforts to provide the capability to modify the Products as requested. Company will determine the estimated cost of the proposed modifications and will provide Purchaser with a written price estimate for the requested modifications, as well as for any manuals and related documentation which require modification. Company will commence work only upon receiving signed approval by Purchaser to make the modifications.

Software Customization. Artisoft shall customize the Licensed Software for TAIS, at no cost or expense to TAIS, in accordance with the specifications and delivery dates set forth in Schedule 3, and shall provide TAIS with a Master Copy of such software. 3.1 TOSHIBA NAME IDENTIFICATION. Artisoft shall customize a version of the Software by [**] or other mutually agreed upon date that brands the Software as a TAIS product in accordance with the specifications set forth in Schedule 3 ("Branded Version"). TAIS shall have the final right of approval over all use and placement of its trademarks in the Licensed Software. Nothing in this Agreement shall transfer any rights in any TAIS trademarks to Artisoft.
Software Customization. At the request of Purchaser, Kodak shall cooperate with Purchaser in making modifications (customizations) to Software to meet specific customer needs to the extent that such modifications (i) are not modifications that field service engineers or systems engineers are capable of implementing (absent re-engineering) or (ii) involve source code. In the event Purchaser requests such cooperation, Purchaser shall be responsible for submitting a customization request, installing customized software at its customer's site, and paying Kodak's fees for implementing, testing and delivering the requested customization, which fees shall be as set forth in a written estimate prepared by Kodak promptly upon its receipt of Purchaser's request set forth in the preceding sentence. Kodak shall respond to customization requests by supplying cost and time estimates to implement, test, and deliver the requested customization and, if such estimates are accepted by Purchaser, shall do so as described in such response.
