Data and specimens collected under an IRB approved protocol are the property of the University of Virginia. You must have “permission” to share data/ specimens outside of UVa other than for a grant application and or publication. This “permission” may come in the form of a contract with the sponsor or a material transfer agreement (MTA) with others. A contract/ MTA is needed to share the data outside of UVa even if the data includes no HIPAA identifiers and no code that could link the data back to a HIPAA identifier.

L. 104-191, and its implementing regulations (45 CFR part 160 and 164), and the Individuals with Disabilities Education Act, and its implementing regulations (34 C.F.R. §§ 300.610 - 300.626 and 34 C.F.R. §§ 303.400 – 303.417). Neither Contractor nor any of its employees, agents or affiliates, or subcontractors shall: (i) engage in targeted marketed advertising using Sponsor Information; (ii) use Sponsor Information to amass a profile about a Sponsor End User, except in connection with Contractor’s performance of its obligations under this Agreement; (iii) or publish any report, data, or research findings that are based on Sponsor Information or that otherwise expressly identifies the Sponsor, without prior review and approval from the Sponsor, unless otherwise required by law.
