Spot Quotes. The parties understand that additional services and charges other than those initially set forth herein may periodically arise. In those circumstances, Xxxxxx Logistics shall spot quote the requested services in writing, which will become the applicable rate upon Xxxxxx Logistics receiving written acceptance of the spot quote from Customer (written acceptance includes e-mail from a representative of Customer). Upon request from Customer, Xxxxxx Logistics shall include with its invoice for the spot quote a copy of the written acceptance. Unless the spot quote and the written acceptance clearly indicate that the services provided and the applicable rate are to be on an extended basis (e.g., for the remainder of the Agreement term), the spot quote will apply only to the immediate services provided. Services provided pursuant to spot quotes will be subject to the terms of this Agreement and the Appendices.

In the event Customer does not provide a written acceptance of the spot quote, said spot quote shall be deemed accepted by Customer if PCC Logistics performs the additional services requested, and Customer shall be liable for payment of said spot quote. Upon request from Customer, PCC Logistics shall include with its invoice for the spot quote a copy of the written acceptance or proof of its issuance of said spot quote. Unless the spot quote and the written acceptance clearly indicate that the services provided and the applicable rate are to be on an extended basis (e.g., for the remainder of the Agreement term), the spot quote will apply only to the immediate services provided. In such circumstances, Axis may spot quote the requested services in writing, each of which spot quotes will become the applicable rate upon Axis’ receipt of written acceptance of the spot quote from Customer, which written acceptance may be communicated by any written means, including electronically, by e-mail, facsimile, electronic signature, text message or other mechanized, programmatic, or digital means. Unless the spot quote and the written acceptance clearly indicate that the requested services and the applicable rates therefore are to be on an extended or continuing basis (e.g., for the remainder of the term of this Agreement), each such spot quote will apply only to the immediate services provided in connection with that spot quote. Services provided from time to time pursuant to spot quotes will be subject to the terms and conditions of this Agreement.

Request for Quotes 9.1 Customers needing information technology staff augmentation services will create a Request for Quote eQuote event in MFMP Sourcing, each time they desire to solicit information technology staff augmentation services. The Customer shall issue a detailed RFQ that includes a term, service levels, educational qualifications and experience needed. 9.2 The Customer shall select at least one (1) awarded Contractor for the RFQ event. MFMP Sourcing will automatically add an additional twenty-five (25) randomly selected awarded Contractors to the RFQ event. All twenty-six (26) awarded Contractors sent the RFQ will receive a notification of the RFQ and may respond. Customers may view the RFQ Contractor List on the event’s “Overview” tab. 9.3 Pursuant to section 287.056(2), F.S., RFQs performed within the scope of this Contract are not independent competitive solicitations and are not subject to the notice or challenge provisions of section 120.57(3), F.S. 9.4 All Customers who utilize MFMP must use the MFMP Sourcing application for creating RFQ’s on this contract. Customers who do not utilize MFMP will create a RFQ document each time they desire to solicit information technology staff augmentation services and shall send the RFQ document electronically via email to at least (25) awarded or prequalified Contractors.
