Common use of Standard for Services Clause in Contracts

Standard for Services. (a) The provision of the above Services by DBCT Management must be carried out in accordance with due skill, care and diligence in accordance with the Access Undertaking, the Terminal Regulations, Good Operating and Maintenance Practice and all applicable Laws. (b) When providing the above Services, DBCT Management must take into account the following factors, where relevant: (i) lowest total whole of life cost; (ii) reliability and economy of performance; (iii) maximising the effective life of the Terminal; and (iv) DBCT Management’s non-discrimination obligations under the Access Undertaking.
