Statement of Fact. The statements set forth in the Stipulation of Facts above are facts upon which the parties agree and are not to be construed as mere recitals. Said statements of fact are incorporated into this Agreement by reference as if set forth fully.

Statement of Fact. The Parties hereto acknowledge and agree that the preambles to this Agreement are statements of fact.
Statement of Fact. On or about February 7, 1996, the parties entered into a triple net lease of the Property (Article 1.2 below is hereby incorporated by reference herein). Cannanumus is not aware of any fact or circumstance which has not been disclosed to Abattis which should be disclosed in order to prevent the representations and warranties contained in this Section 2.1 from being misleading or which would likely affect the decision of Abattis to enter into this Agreement.
