Statutory Contract vs Contract by Agreement. (a) This Agreement is a Statutory Contract if it takes effect as contemplated in paragraph B.1(a), B.1(b) or B.1(c). (b) This Agreement is a Contract by Agreement if it takes effect as contemplated in paragraph B.1(d). (a) Under section 738J of the Water Act, this Agreement may also provide that the Scheme Owner may charge the Customer a fee for providing Drainage Services under this Agreement. (b) Drainage Services are relevant if the Customer is the owner or lessee of, or otherwise occupies, land all or part of which is located within the Declared Drainage Area.
