Subject to and in Sample Clauses

Subject to and in accordance with the provisions of this Agreement, the Concession hereby granted shall oblige or entitle (as the case may be) the Concessionaire to: (a) Right of Way, access and licence to the Site for the purpose of and to the extent conferred by the provisions of this Agreement; (b) finance and construct the Bus Terminal and Commercial Complex; (c) manage, operate and maintain the Bus Terminal and the Commercial Complex; (d) demand, collect and appropriate charge(s) from Users liable for payment of Rate for using the facilities mentioned in Schedule-R and the Commercial Complex in accordance with this Agreement; (e) perform and fulfil all of the Concessionaire's obligations under and in accordance with this Agreement; (f) bear and pay all costs, expenses and charges in connection with or incidental to the performance of the obligations of the Concessionaire under this Agreement; and (g) neither assign, transfer or sublet or create any lien or Encumbrance on this Agreement, or the Concession hereby granted or on the whole or any part of the Project nor transfer, lease or part possession thereof, save and except as expressly permitted by this Agreement or the Substitution Agreement.
Subject to and in accordance with the provisions of this Agreement, the Concession hereby granted shall oblige or entitle (as the case may be) the Concessionaire to: (a) Right of Way, access and licence to the Site for the purpose of and to the extent conferred by the provisions of this Agreement; (b) manage, operat e and maintain the Project Highw ay and regulat e the use thereof by third parties; (c) demand, collect and appropriate Fee f rom vehicles and Users liable for payment of Fee for using the Project Highway or any part thereof and refuse entry of any vehicle if the Fee due is not paid;
Subject to and in accordance with the provisions of this Agreement, the Contract hereby granted shall oblige or entitle (as the case may be) the Contractor to: a) Right of Way, access and license to the Site for the purpose of and to the extent conferred by the provisions of this Agreement; b) design, build, operate and maintain the Project; c) perform and fulfill all of the Contractor’s obligations under and in accordance with this Agreement; d) save as otherwise expressly provided in this Agreement, bear and pay all costs, expenses and charges in connection with or incidental to the performance of the obligations of the Contractor under this Agreement; and e) neither assign, transfer or sublet or create any lien or encumbrance on this Agreement, or the Contract hereby granted or on the whole or any part of the Project nor transfer, lease or part possession thereof, save and except as expressly permitted by this Agreement or the Substitution Agreement.
Subject to and in accordance with the provisions of this Agreement, the license hereby granted shall oblige or entitle (as the case may be) the Service Provider to: (a) Right of way, access and licence to the Site for the purpose of and to the extent conferred by the provisions of this Agreement; (b) finance and setup the Tele-Medicine Services; (c) manage, operate and maintain the Project and regulate the use thereof by third parties;
Subject to and in accordance with the provisions of this Agreement, the Concession hereby granted shall oblige or entitle (as the case may be) the Concessionaire to: a. the right of access and license to use the Tower Assets handed over by the Authority for the purpose of and to the extent conferred by the provisions of this Agreement and other Project Agreements; b. manage, operate, maintain, and upgrade the Tower Assets and regulate the use thereof by third parties in accordance with terms hereof; c. perform and fulfil all of the Concessionaire’s obligations under and in accordance with this Agreement; d. enter into contracts, allowing use of Tower Assets handed over by the Authority, with Tenants in accordance with this Agreement; e. demand, collect and appropriate Rentals & Fees, including through contracts with Tenants, in accordance with this Agreement; and f. bear and pay all costs, expenses, and charges in connection with or incidental to the performance of the obligations of the Concessionaire under this Agreement; and g. neither assign, transfer or sublet or create any lien or Encumbrance on this Agreement, or the Concession hereby granted or on the whole or any part of the
Subject to and in accordance with the provisions of this Agreement, the Concession hereby granted shall oblige or entitle (as the case may be) the Concessionaire to: i. access and licence to the Site for the purpose of and to the extent conferred by the provisions of this Agreement; ii. design, finance and construct the Storage Facility iii. manage, operate and maintain the Storage Facility in accordance with the terms of this Agreement;
Subject to and in accordance with the provisions of this Agreement, the Licensed Rights hereby granted shall oblige or entitle (as the case may be) the Developer to: (a) Right of Way, access and license to the Site for the purpose of and to the extent conferred by the provisions of this Agreement; (b) carry out survey, investigation, design, finance and construct the Residential Property; (c) manage, operate and maintain the Residential Property and comply with Maintenance Requirements of Residential Property, in accordance with the provisions of this Agreement till the expiry of 1 (one) year from the date of issuance of Completion Certificate and also levy, demand, collect and appropriate charges/User fee from the allottee/transferee/sub-lessee/tenant of the flats on this account. However, the SH&DB shall not pay any charges/User fee on this account and the Developer shall treat these expenses as included in the project development cost; (d) perform and fulfill all of the Contractor’s/Developer’s obligations under and in accordance with this Agreement; (e) bear and pay all costs, expenses and charges in connection with or incidental to the performance of the obligations of the Developer under this Agreement; and
