Common use of Subscriber’s Obligations Clause in Contracts

Subscriber’s Obligations. a. It is the responsibility of the Subscriber to provide the computer hardware and software and/or make modifications to their existing equipment that are necessary to effect access to OCRA. b. Subscriber shall not use automated tools to navigate this website. Subscriber must manually enter any requests using the queries provided on the website. c. The Subscriber is responsible for ensuring that unauthorized personnel do not use the Subscriber’s account. Unauthorized personnel for the purposes of this contract shall be any person, employee, support staff, or entity other than the Subscriber. d. Information accessed from OCRA is for the use of the Subscriber in the ordinary course of their business. e. The Subscriber is responsible for ensuring that the use of OCRA is conducted in a proper and legal manner. If the Subscriber is convicted of a crime, including but not limited to, a violation of the Virginia Computer Crimes Act (Section 18.2-152.1 of the Code of Virginia), arising out of their use of OCRA, the Clerk's Office shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting the Clerk's Office from pursuing any other remedy available to it for such breach. f. The Subscriber is responsible for ensuring the security of the Subscriber’s assigned username and password. If at any time Subscriber has knowledge of compromised security of Subscriber’s access credentials, Subscriber will IMMEDIATELY notify the Clerks Office in writing. g. The Subscriber may NOT share passwords or login credentials with anyone for any reason. Access is STRICTLY one username login for one individual Subscriber. h. Information obtained on the website cannot be sold or posted on any other internet website or redistributed to any third party.

The Subscriber is responsible for ensuring that the use of OCRA is conducted in a proper and legal manner. If the Subscriber is convicted of a crime, including but not limited to, a violation of the Virginia Computer Crimes Act (Section 18.2-18.2- 152.1 of the Code of Virginia), arising out of their use of OCRA, the Clerk's Office shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting the Clerk's Office from pursuing any other remedy available to it for such breach. f. g. The Attorney Subscriber is responsible for ensuring that the use of OCRA by the employees designated in Attachment A is conducted in a proper and legal manner. The Attorney Subscriber must immediately notify the Clerk’s Office when an employee who has an Attorney Employee Subscriber Agreement is no longer employed by the Attorney Subscriber. h. The Subscriber is responsible for ensuring the security of the Subscriber’s assigned username and password. If at any time Subscriber has knowledge of compromised security of the Subscriber’s access credentials, Subscriber will IMMEDIATELY notify the Clerks Office in writing. g. i. The Subscriber may NOT share passwords or login credentials with anyone for any reason. Access is STRICTLY one username login for one individual Subscriber. h. Information obtained on the website cannot be sold or posted on any other internet website or redistributed to any third party.

Information accessed from OCRA is for the use of the Subscriber in the ordinary course of their business. e. The Subscriber is responsible for ensuring that the use of information from OCRA is conducted in a proper and legal manner. If the Subscriber is convicted of a crime, including but not limited to, a violation of the Virginia Computer Crimes Act (Section §18.2-152.1 and §18.2-152.2 of the Code of Virginia), arising out of their use of OCRA, the Clerk's Office Clerk shall have the right to terminate this Agreement agreement immediately. This shall not be construed as prohibiting the Clerk's Office Clerk from pursuing any other remedy available to it the Clerk for such breach. f. . Information accessed from OCRA is for the use of the Subscriber in the ordinary course of their business as provided by Virginia Code (§17.1-293). The Subscriber has a duty to bring to the Clerk’s attention any errors or omissions in the scanned court case documents. Notification may be made by electronic mail to xxxxxxx@xxxxxxxx.xxx. The Subscriber is responsible for ensuring the security of the Subscriber’s assigned username and password. If at any time the Subscriber has knowledge of compromised security of Subscriber’s access credentials, Subscriber will IMMEDIATELY must immediately notify the Clerks Office Clerk by electronic mail to xxxxxxx@xxxxxxxx.xxx. Supervising attorney shall be responsible for reporting termination of employment of any Subscriber under their supervision. Subscribers shall be responsible for reporting any change in writingthe information provided in the OCRA application. g. The Subscriber may NOT share passwords or login credentials with anyone for any reason. Access is STRICTLY one username login for one individual Subscriber. h. Information obtained on the website cannot be sold or posted on any other internet website or redistributed to any third party.

The Subscriber is responsible for ensuring the security of the Subscriber’s assigned username and password. If at any time Subscriber has knowledge of compromised security of the Subscriber’s access credentials, Subscriber will IMMEDIATELY notify the Clerks Office in writing. g. i. The Subscriber may NOT share passwords or login credentials with anyone for any reason. Access is STRICTLY one username login for one individual Subscriber. h. If the Subscriber is convicted of a crime, including including, but not limited to, to a violation of the Virginia Computer Crimes Act (Section Sec 18.2-152.1 152.1) of the Code of Virginia), ) arising out of their the use of OCRA, such conviction shall constitute a material breach of this Agreement, and the Clerk's ’s Office shall have the right to terminate this Agreement immediately. This Nothing herein shall not be construed as prohibiting the Clerk's ’s Office from pursuing any other remedy available to it for such breach. c. The Subscriber is responsible for ensuring that unauthorized personnel do not use any of the Subscriber’s account. Unauthorized personnel, for the purposes of this contract shall be any person whom the Clerk’s Office has not granted Subscriber’s account for any reason. The Subscriber may NOT share passwords or login credentials with anyone for any reason. Access is STRICTLY one Username login for one Subscriber. d. Information accessed from OCRA is solely for the use of the Subscriber in the ordinary course of their business as provided by Virginia Code Section 17.1-293. Subscriber has a duty to bring to the Clerk’s attention any errors or omissions in the scanned court documents. Notification can be made by calling the Clerk’s office at 000-000-0000. e. The Subscriber shall not permit any data accessed through OCRA to be sold or posted on any other Internet website or in any way redistributed to any third party, and the Clerk reserves the discretion to deny secure remote access to ensure compliance with this provision. f. The Subscriber is responsible for ensuring the security of the Subscriber’s assigned username and password. If at any time the Subscriber has knowledge of compromised security of Subscriber’s access credentials, Subscriber will IMMEDIATELY notify the Clerks Office in writingClerk by telephone at 000-000-0000. g. The Supervising attorneys shall timely report termination of employment of any Subscriber may NOT share passwords or login credentials with anyone for any reasonunder their supervision. Access is STRICTLY one username login for one individual SubscriberReporting shall be made within 7 days of Subscriber termination. h. Information obtained on Subscribers shall be responsible for reporting any change in the website cannot be sold or posted on any other internet website or redistributed to any third partyinformation provided in the OCRA application.
