Subscription Service Warranty. Fourth represents and warrants that the Subscription Service shall materially perform in accordance with the Documentation. For any material breach of a warranty, Subscriber’s exclusive remedy shall be as provided in Xxxxxxx 0, Xxxx and Termination.

Subscription Service Warranty. 12.1.1 WorkWide warrants and represents that during the Subscription Term, the Subscription Services shall materially conform to the WorkWide Documentation (“Subscription Service Warranty”).
Subscription Service Warranty. MobiChord warrants that the Subscription Service shall substantially conform to the Product Overview during the Subscription Term. Upon discovering a breach of this warranty, Customer shall promptly notify MobiChord in writing of said breach. Upon receipt of such notice, MobiChord shall use commercially reasonable efforts to repair the Subscription Service. If MobiChord is unable to repair the Subscription Service within a commercially reasonable period, MobiChord may, in MobiChord’s sole discretion, terminate Customer’s subscription to the Subscription Service and refund to Customer a pro-rata portion of the fees paid for the Subscription Service based on the portion of the then-current Subscription Term remaining. Notwithstanding the foregoing, this warranty shall not apply to any non-conformity due to a modification of or defect in the Subscription Service that is made or caused by any person other than MobiChord or a person acting at MobiChord’s direction. Subscription Service Warranty. Persivia warrants that during the term of any Order Schedule for the Subscription Service, (i) the Subscription Service will conform, in all material respects, with its Documentation and (ii) it will use commercially reasonable efforts to ensure that it does not introduce any virus, Trojan horse or other malicious code into the Subscription Service environment. Persivia does not warrant that it will be able to correct all reported defects or that use of the Subscription Service will be uninterrupted or error free. Persivia makes no warranty regarding features or services provided by third parties. For any breach of the above warranty, Persivia will, at no additional cost to Customer, provide remedial services necessary to enable the Services to conform to the warranty. Customer will provide Persivia with a reasonable opportunity to remedy any breach and reasonable assistance in remedying any defects. The remedies set out in this subsection are Customer’s sole remedies for breach of the above warranties. Such warranties shall only apply if the Subscription Service has been utilized by Customer in accordance with the Documentation, Order Schedule and this Agreement.
Subscription Service Warranty. Amperity warrants that during the applicable Subscription Term for any Subscription Service the Subscription Service will conform, in all material respects, as described in the Service Description Guide. “Subscription Services” means Amperity’s proprietary subscription-based software solution set forth and described on the applicable Order Form. For any breach of the above warranty, Amperity will, at no additional cost to Customer, provide commercially reasonable remedial services to enable the Subscription Service to conform to the warranty. Customer will provide Amperity with a reasonable opportunity to remedy any breach and reasonable assistance in remedying any defects. Such warranty shall only apply if the Subscription Service has been utilized by Customer in accordance with the Agreement.

CloudBolt does not warrant that it will be able to correct all reported defects or that use of the Subscription Service will be uninterrupted or error free. CloudBolt makes no warranty regarding features or services provided by third parties. For any breach of the above warranty, CloudBolt will, at no additional cost to Customer, provide remedial services necessary to enable the Subscription Service to conform to the warranty. The Customer will provide CloudBolt with a reasonable opportunity to remedy any breach and reasonable assistance in remedying any defects. Such warranty shall only apply if the Subscription Service has been utilized by the Customer in accordance with the Order Form and this Agreement.
Subscription Service Warranty. Phreesia warrants that during the term of any Order Form for the Subscription Service, the Subscription Service will conform, in all material respects, with the Documentation. Phreesia does not warrant that it will be able to correct all reported defects or that use of the Subscription Service will be uninterrupted or error free. Phreesia makes no warranty regarding features or services provided by third parties. Customer acknowledges and agrees that the Subscription Service will be subject to limitations inherent in the use of the internet, that Phreesia does not control the transfer of data over the internet, and that Phreesia is not responsible for any delays, delivery failures or other damage resulting from such problems, including any problems or damages of any kind that arise from any of Customer’s or its Users’ acts or omissions. For any breach of the above warranty, Phreesia will, at no additional cost to Customer, provide remedial services necessary to enable the Subscription Service to conform to the warranty. The Customer will provide Phreesia with a reasonable opportunity to remedy any breach and reasonable assistance in remedying any defects. Except for any additional remedies set forth in the Service Level Agreement, the remedies set out in this subsection are the Customer’s sole remedies for breach of the above warranty. Such warranty shall only apply if the Subscription Service has been utilized by the Customer in accordance with the Order Form, the Documentation and this Agreement.

Cresta does not warrant it can correct all reported defects or that use of the Subscription Service will be uninterrupted or error free. For any breach of the above warranty, Customer must specify the non-conformity and Cresta will, at no additional cost to Customer, provide remedial services necessary to enable the Subscription Service to conform to the warranty. Customer will provide Cresta with a reasonable opportunity to remedy any breach and reasonable assistance in remedying any non- conformity. These remedies are Customer’s sole remedies for breach of the above warranty. Such warranty shall only apply if the Subscription Service has been utilized by Customer in accordance with the Sales Order and this Agreement.

Such warranty shall only apply if the Subscription Service has been utilized by the Customer in accordance with the Order Form and this Agreement. THE FOREGOING WARRANTY DOES NOT APPLY, AND CLOUDBOLT STRICTLY DISCLAIMS ALL WARRANTIES, WITH RESPECT TO ANY THIRD-PARTY APPLICATIONS.
