Technical Limitations. Client acknowledges and agrees that: (1) it is unreasonable to expect Converse to be able to completely evaluate subsurface conditions, even after the most comprehensive exploratory program; (2) site conditions change frequently due to the passage of time, human activities, and climatic conditions and uncertainties are therefore inherent in the nature of Converse’s services and impossible to avoid; (3) the identification of geotechnical and environmental conditions and the prediction of future or concealed conditions is an inexact scientific endeavor; (4) the state of the art of geotechnical and environmental practice is such that Converse cannot guarantee that its recommendations will prove adequate on this project and the Client assumes the risk of any such failure, except as otherwise provided in these General Conditions and that (5) these General Conditions contains specific LIMITATIONS OF LIABILITY.
Technical Limitations. This software may include technological measures, whether in the software or in bundled hardware or both, that are designed to prevent or detect unlicensed use of the software. Circumvention of these technological measures is prohibited, except and only to the extent that applicable law expressly permits, despite this limitation. Any attempt to circumvent technical limitations may render the software or certain features unusable or unstable, and may prevent you from updating or upgrading the software.
Technical Limitations. All Storage Capacities of the Storage Services described in Article 2 shall be subject to the technical limitations listed in Section 2 to Section 5 which the Storage Customer is informed of according to the General Terms and Conditions for Storage Access via the Nomination Procedure that is regulated in the Operating Agreement.

YOU SHOULD NOT RELY ON THE VOIP SERVICE AS YOUR PRIMARY METHOD TO OBTAIN EMERGENCY SERVICES. IF YOU DO NOT FEEL COMFORTABLE WITH THESE LIMITATIONS, WE SUGGEST YOU MAKE ALTERNATIVE METHODS AVAILABLE TO CALL 911 OR OTHERWISE OBTAIN EMERGENCY SERVICES, SUCH AS THROUGH A TRADITIONAL TELEPHONE LINE OR A MOBILE PHONE.
Technical Limitations. Customer must comply with, and may not work around, any technical limitations in a Trial Service that only allow Customer to use it in certain ways.

The API is subject to limits including (but not limited to) size limits (a maximum amount of API Content or data being required per request), timeout limits (when a query runs for over a certain time frame), rate limits (number of times the API can be called per minute) and daily limits (number of API calls per day). Technical Limitations. 8.1 The Client is obligated to adhere to all technical restrictions embedded in DiVA BC SaaS, which are designed to ensure the software is used only in its intended manner. The Client is expressly prohibited from attempting to circumvent or override these restrictions.
8.2 The Client may download copies of the software or the source code of DiVA BC SaaS only with the explicit prior written permission of MAC IT Solutions GmbH ("MAC").
