Technical Standards and Codes. References in this Service Agreement to all professional and technical standards, codes and specifications are to the most recently published professional and technical standards, codes and specifications of the institute, organization, association, authority or society specified, all as in effect as of the Contract Date. Unless otherwise specified to the contrary, all such professional and technical standards, codes and specifications shall apply as if incorporated herein.
Technical Standards and Codes. References in this Design-Build Agreement to all professional and technical standards, codes and specifications are to the most recently published professional and technical standards, codes and specifications of the institute, organization, association, authority or society specified, all as in effect as of the Contract Date. Unless otherwise specified to the contrary, (1) all such professional and technical standards, codes and specifications shall apply as if incorporated in the Design and Construction Requirements and (2) if any material revision occurs, to the Design-Builder’s knowledge, after the Contract Date, and prior to completion of the applicable Design-Build Work, the Design- Builder shall notify the Owner. If so directed by the Owner, the Design-Builder shall perform the applicable Design-Build Work in accordance with the revised professional and technical standard, code, or specification as long as the Design-Build Price is increased to account for any additional cost or expense attributable to any such revision.

Consistent with the Design Standard of Care, references in this Agreement to all professional and technical standards, codes and specifications are to the most recently published professional and technical standards, codes and specifications of the institute, organization, association, authority or society specified, all as in effect as of the Contract Date. Unless otherwise specified to the contrary, (1) all such professional and technical standards, codes and specifications shall apply as if incorporated in the Technical Specifications, and (2) if any material revision occurs, to the Company's knowledge, after the Contract Date, and prior to completion of the applicable Design/Build Work, the Company shall notify the Village. If so directed by the Village, the Company shall perform the applicable Design/Build Work in accordance with the revised professional and technical standard, code, or specification as long as the Village agrees to provide appropriate schedule relief and to adjust the fixed Design/Build Price on a lump sum or cost substantiated basis to the extent necessary to compensate the Company for any additional cost or expense attributable to any such revision.

If so directed by the City through a Work Change Directive or Change Order, the Design-Builder shall perform the applicable Design-Build Work in accordance with the revised professional and technical standard, code, or specification, subject to the Design-Builder’s rights under this Design-Build Contract with respect to Work Change Directives and Change Orders at the direction of the City.

If any material revision to such professional and technical standards, codes and specifications occurs, to the DBOM Contractor’s knowledge, after the Contract Date, and prior to completion of the applicable Design-Build Work, the DBOM Contractor shall notify the BWS. If so directed by the BWS pursuant to a Unilateral Change Directive or a Change Order, the DBOM Contractor shall perform the applicable Design-Build Work in accordance with the revised professional and technical standard, code, Board of Water Supply, City and County of Honolulu Kalaeloa Seawater Desalination Facility Design-Build-Operate-Maintain Project Service Agreement Article 1 - Definitions and Interpretation or specification as long as the BWS agrees to provide appropriate schedule relief and to adjust the Fixed Design-Build Price on a lump sum or Cost Substantiated basis to the extent necessary to compensate the DBOM Contractor for any additional cost or expense attributable to any such revision. Nothing in this subsection shall limit the DBOM Contractor’s obligation to comply with Applicable Law as in effect during the Term

References in this Contract to all technical standards, codes and specifications are to the most recently published technical standards, codes and specifications of the institute, organization, association, Applicable Law or society specified, all as in effect as of the Contract Award Date. Unless otherwise specified to the contrary: (1) all such technical standards, codes and specifications shall apply as if incorporated in this Contract and (2) if any material revision occurs, to Contractor’s knowledge, after the Contract Date, and prior to completion of the applicable Work, Contractor shall notify Authority. If so directed in writing by Authority, Contractor shall perform the applicable Work in accordance with the revised technical standard, code, or specification as long as the Price or Contract Time is adjusted, subject to cost substantiation, for any additional cost, expense or time attributable to any such revision.

If any material revision to such professional and technical standards, codes and specifications occurs after the Baseline Date, and prior to completion of the applicable Project Implementation Work, the KRRC shall have the right, through a Unilateral Change Directive or a Change Order, to direct the Project Company to perform the applicable Project Implementation Work in accordance with the revised professional and technical standard, code, or specification, subject to the Project Company’s rights under this Project Agreement with respect to Unilateral Change Directives and Change Orders at the direction of the KRRC. Nothing in this Section shall limit the Project Company’s obligation to comply with Applicable Law as in effect during the Term.
