Temporary Easement. The Purchaser shall grant a temporary right-of-way over the rear ten (10) feet of the Land over the full width to all purchasers in the subdivision, their agents and workmen through, along and over the said Land for the purpose of reaching their own land or transporting materials, machinery or equipment thereto until such time as roads and streets are useable or until construction of the Subdivision is complete and the Purchaser agrees to keep such right-of-way clear of surface earth or material. This right of way shall automatically expire on the assumption of the subdivision by the Municipality.

Grantee agrees that the right to use the TCE Property shall terminate effective as of the date of Xxxxxxx’s recordation of the As-Built Certification (as defined in Section 20 below) (the “Completion Date”) in the real property records of the Office of the Clerk and Recorder of Weld and Xxxxx Counties, Colorado (the “Records”). From time to time, Xxxxxxx may request from Grantor additional temporary easement(s) for work space in connection with Pipeline maintenance, repair, and other work authorized by this Agreement (each, an “Additional Temporary Easement”) on such real property within the Property as mutually agreed by the Parties (“Additional TCE Property”) for such duration as mutually agreed by the Parties, which Additional Temporary Easements may or may not be granted in Grantor’s sole and absolute discretion. Any Additional Temporary Easements granted by Grantor shall be subject to the terms and conditions of this Agreement. For purposes of this Agreement, the Permanent Easement, Access Easement, Temporary Easement, and any Additional Temporary Easements may be referred to collectively herein as the “Easements,” and the TCE Property, Access Property, PE Property, and any Additional TCE Property may be referred to collectively herein as the “Easement Property.”
