Common use of Termination of Unsatisfactory Subcontractor Clause in Contracts

Termination of Unsatisfactory Subcontractor. When any portion of the Work that has been subcontracted by Contractor is not being prosecuted in a satisfactory manner, or when materials supplied do not conform to the Contract Documents and these deficiencies form the basis of a default notice issued pursuant to Section 16 of these General Conditions, District may direct Contractor to discharge the Subcontractor or supplier. Any Subcontractor or supplier which is discharged shall not again be employed on this Project. Any termination of a Subcontractor pursuant to this Section 6.05 shall be with the District's prior written consent in strict conformity with the requirements of the Subletting and Subcontracting Fair Practices Act, Part 1 of Division 2 of the Public Contract Code, commencing with Section 4100.
