Common use of Termination Upon Death or Incapacity Clause in Contracts

Termination Upon Death or Incapacity. DISTRIBUTOR may terminate this Agreement in the event of the death of an Owner or upon the incapacity of any Owner who is also the General Manager identified herein, upon written notice to DEALER and/or such Owner's legal representative. Termination upon either of these events shall be effective ninety (90) days from the date of such notice.

Termination Upon Death or Incapacity. Subject to certain exceptions identified in Section XV, DISTRIBUTOR may terminate this Agreement in the event of the death of an Owner OWNER or upon the incapacity of any Owner OWNER who is also the General Manager identified herein, upon written notice to DEALER and/or and such Owner's OWNER'S legal representative.
