The Buyer agrees. 1. To cut only those trees marked with a fresh orange paint spot. Trees marked with an "X" may be cut if desired.
2. Trees other than those specified above may be cut only for access on areas used for roads and landings.
3. To pay the Seller a lump price of $___________when the contract is signed to pay for the trees designated for cutting.
4. To pay three times the stumpage value per tree, a penalty rate, for each tree that is cut which is not designated for cutting.
5. To keep fields, fences, roads and streams free from tree tops and other logging debris at all times.
6. To hold and save the Seller, his officers, agents or employees, harmless from any or all liability on account of any claim whatsoever, for wages, supplies, equipment, damage and injury to persons or property arising in connection with any activity conducted or undertaken by the Buyer, his agents or employees under the terms of this contract.
7. That this contract cannot be transferred to another party without the written permission of the Seller.
The Buyer agrees. 1. To cut only those trees marked with blue and orange paint. Trees are marked with a spot of blue or orange paint at the base of the tree and a slash at a point approximately 4.5 feet above the ground. A tree that has a questionable butt log, but that has volume in the top logs is marked with an “ ”. Cull and undesirable trees are marked with an "X" and were not tallied or included in the volume estimate but are to be cut and harvested if desired. Buyer may remove any marked tree except those trees marked with a blue band around the circumference are not to be harvested. Those trees marked with the word "DEN" may not be cut or damaged.
2. To pay the Seller a lump sum price of $XXXXXX to pay for trees designated for cutting. Ten percent ($XXXX) of the lump sum and the ten percent performance deposit be paid when the contract is signed; with the balance due before any timber is cut.
3. The Buyer agrees to submit a performance deposit in the amount of ($XXX) to be used as follows:
3.1 To liquidate damage claims resulting from the Buyers operations.
3.2 To be retained if the terms of this contract are not satisfied in full.
3.3 To be returned to Buyer if all terms of contract are satisfied.
4. Trees that are cut which are not designated for cutting will be considered a criminal action, and the Purchaser and/or his agents, employees, assigns will be subject to prosecution. The minimum penalty rate per tree will be three (3) times the contract price or three (3) times the delivered mill price whichever is greater. Other monetary penalties for excessive logging damage, follow-up cultural work, or other value losses associated with purchasers operations will be determined and considered beyond the minimum per tree penalty rate. Exception may be made for trees cut for necessary layout of roads, skid trails, and log deck areas (must be agreed upon between purchaser and seller prior to cutting). Any merchantable unmarked trees that must be removed to create or improve log landings or haul roads must be marked and scaled by the Seller prior to cutting. The Buyer will be charged straight stumpage price for these trees. The additional volume and value will be added to the contract lump sum.
5. To not allow the xxxxx height of any felled trees to exceed twelve (12) inches above the ground, uphill side. Roadway, trails, and landing stumps cut to lowest height possible to enhance trafficability. All field edge stumps are to be treated with a xxxxx restricting herbicide so...
The Buyer agrees a) to have this dog de-sexed before 18 months of age and mail proof of spay/neuter to the breeder. Failure to do so shall null and void Clauses 4, 5 and 6.
b) to pay the breeder a fine of 10x’s the purchase price of the dog if this dog is ever bred.
c) to keep the this dog in a fenced yard or if no such yard is available to properly supervise this dog at all times when off leash.
d) to maintain this dog at a proper weight and shall not over exercise (over one mile per walking session) or allow this dog to go up and down stairs freely for the first year and a half of it's life (baby gates must block all stairs).
e) to take this dog to the vet at least once a year for its annual shots and check up.
f) to feed this dog a high quality food and to provide this dog with daily vitamin Nuvet (optional) supplements.
g) to follow all the suggestions laid out in the suggestions letter that accompanied the puppy and on the information section of the breeders website.
h) to inform the breeder if you have any concerns about the health/temperament of this dog.
i) to set up a pet insurance plan for this dog or set up some sort of plan in case the dog gets sick so there are funds available (put away $50 a month etc.).
j) that they are aware there is NO guarantee this will be a non-shedding or hypoallergenic dog.
k) that they are aware there is NO guarantee on color and this puppy may change colors as it ages.
l) to allow Xxxxxx Xxxxx and Swissridge kennels INC to use any photographs or statements emailed or posted on Facebook as a form of advertisement on SwissRidge kennels websites, brochures, Instagram, Pinterest or for any other form of advertising Swissridge kennels may want to use them for.
m) that this dog will never be sold or given away to anyone and if for some reason the buyer is unable to keep the dog they must return the dog to the breeder. No compensation will be given for the dog. However if the buyer needs to return the dog for whatever reason within 2 weeks of the purchase date then half the purchase price of the puppy will be returned to the Buyer. The dog must be healthy and in perfect condition. If it is not healthy or in good condition no money will be returned to the buyer. Buyer will be responsible for all shipping fees.

3. To repair to original conditions or pay for at replacement costs any damage to fences or other improvements of the SELLER.
4. To reimburse the SELLER from the escrow account or otherwise for all costs borne by the SELLER in suppressing any and all fires caused by the BUYER or his/her AGENT upon lands subject to this AGREEMENT.
5. To indemnify, release, and hold harmless the SELLER and his/her AGENT from and against all liabilities, damages, costs, and expenses arising from, by reason of, or in connection with the BUYER'S operations hereunder.

3. To repair to original conditions or pay for at replacement costs any damage to fences or other improvements of the SELLER.
4. To reimburse the SELLER from escrow account or otherwise for all cost borne by the SELLER in suppressing any and all fires caused by the BUYER or his/her AGENT upon lands subject to this AGREEMENT.

The Buyer agrees. That this puppy will be given adequate and proper shelter and be housed securely. This dog shall not be neglected, allowed to roam free, or be mistreated in any manner. The puppy shall receive proper veterinary care throughout its life, receiving annual inoculations and placed on a heartworm preventative. The puppy shall receive proper nutrition and caretaken to maintain its proper weight. Xxxxx agrees to give the dog proper training and socialization. Xxxxx agrees to never sell or surrender this dog into a dog fighting institution, testing center or shelter. The Buyer agrees to finish all puppy vaccines before taking their puppy out in public, letting their puppy on public sidewalks and grasses, or letting their puppy be touched by people outside of the family. Cull trees are marked with an “X” on both sides of the tree along with a xxxxx xxxx. A tree that has a bad butt log, but that has volume in the top logs is marked with an “ X ”. All dead snags shall not be cut unless designated by the Forester In Charge or pose a hazard to the Buyer.

To hold and save the Seller, his officers, agents or employees, harmless from any or all liability on account of any claim whatsoever, for wages, supplies, equipment, damage and injury to persons or property arising in connection with any activity conducted or undertaken by the Buyer, his agents or employees under the terms of this contract.
6. Buyer and any contractor acting under contract with the Buyer who enters upon the premises shall carry public liability, bodily injury, property damage and automobile liability insurance, while operating on Sellers property, in amounts adequate to protect Sellers against any such claims; and Buyer and any such contractor hereby agrees to indemnify and hold harmless the Sellers against any such claims.
