To pay three times the stumpage value per tree, a penalty rate, for each tree that is cut which is not designated for cutting. 5. To keep fields, fences, roads and streams free from tree tops and other logging debris at all times. 6. To hold and save the Seller, his officers, agents or employees, harmless from any or all liability on account of any claim whatsoever, for wages, supplies, equipment, damage and injury to persons or property arising in connection with any activity conducted or undertaken by the Buyer, his agents or employees under the terms of this contract. 7. That this contract cannot be transferred to another party without the written permission of the Seller.

The Buyer agrees. 1. To cut only those trees marked with blue and orange paint. Trees are marked with a spot of blue or orange paint at the base of the tree and a slash at a point approximately 4.5 feet above the ground. A tree that has a questionable butt log, but that has volume in the top logs is marked with an “ ”. Cull and undesirable trees are marked with an "X" and were not tallied or included in the volume estimate but are to be cut and harvested if desired. Buyer may remove any marked tree except those trees marked with a blue band around the circumference are not to be harvested. Those trees marked with the word "DEN" may not be cut or damaged. 2. To pay the Seller a lump sum price of $XXXXXX to pay for trees designated for cutting. Ten percent ($XXXX) of the lump sum and the ten percent performance deposit be paid when the contract is signed; with the balance due before any timber is cut. 3. The Buyer agrees to submit a performance deposit in the amount of ($XXX) to be used as follows: 3.1 To liquidate damage claims resulting from the Buyers operations. 3.2 To be retained if the terms of this contract are not satisfied in full. 3.3 To be returned to Buyer if all terms of contract are satisfied. 4. Trees that are cut which are not designated for cutting will be considered a criminal action, and the Purchaser and/or his agents, employees, assigns will be subject to prosecution. The minimum penalty rate per tree will be three (3) times the contract price or three (3) times the delivered mill price whichever is greater. Other monetary penalties for excessive logging damage, follow-up cultural work, or other value losses associated with purchasers operations will be determined and considered beyond the minimum per tree penalty rate. Exception may be made for trees cut for necessary layout of roads, skid trails, and log deck areas (must be agreed upon between purchaser and seller prior to cutting). Any merchantable unmarked trees that must be removed to create or improve log landings or haul roads must be marked and scaled by the Seller prior to cutting. The Buyer will be charged straight stumpage price for these trees. The additional volume and value will be added to the contract lump sum. 5. The Buyer agrees a) to have this dog de-sexed before 18 months of age and mail proof of spay/neuter to the breeder. No compensation will be given for the dog. However if the buyer needs to return the dog for whatever reason within 2 weeks of the purchase date then half the purchase price of the puppy will be returned to the Buyer. The Buyer agrees. That this puppy will be given adequate and proper shelter and be housed securely. This dog shall not be neglected, allowed to roam free, or be mistreated in any manner. The puppy shall receive proper veterinary care throughout its life, receiving annual inoculations and placed on a heartworm preventative. The puppy shall receive proper nutrition and caretaken to maintain its proper weight. Xxxxx agrees to give the dog proper training and socialization. Xxxxx agrees to never sell or surrender this dog into a dog fighting institution, testing center or shelter. The Buyer agrees to finish all puppy vaccines before taking their puppy out in public, letting their puppy on public sidewalks and grasses, or letting their puppy be touched by people outside of the family.
