Time of Receipt. A notice or other communication is effective upon delivery to the other party if it is personally delivered or sent by fax. Notice sent by mail or Federal Express is effective upon the second work day after the date it was sent, as evidenced by a postmark or similar indicia, or upon actual delivery.

Time of Receipt. A Notice given to a person in accordance with this clause is treated as having been given and received: (a) if delivered, on the day of delivery if delivered before 5.00 pm on a Business Day, otherwise on the next Business Day; (b) if sent by pre-paid mail, on the day of actual delivery if delivered before 5.00 pm on a Business Day, otherwise on the next Business Day; and (c) if sent electronically by email and confirmation is received from the relevant internet service provider that the transmission was successfully received in full and without error, on the day of transmission if the transmission was completed before 5.00 pm on a Business Day, otherwise on the next Business Day.
Time of Receipt. (a) Subject to clause 22.3(b), a Notice is taken to have been received by the intended recipient: (i) if left at the intended recipient's address, at the time of delivery; (ii) if sent by prepaid ordinary mail, on the third Business Day after the day of posting, or if sent by prepaid airmail from one country to another country, on the tenth Business Day after the day of posting; (iii) if sent by facsimile, at the time shown in the transmission report as the time when the whole Notice was sent; and (iv) if sent by email, four hours after the time the email was sent (as recorded by the device from which the email was sent) provided that the sender has not received an automated message that the email has not been delivered. (b) If a Notice is received by a recipient on a day that is not a Business Day or after 4.00pm on a Business Day, the Notice is taken to be received at 9.00am on the next Business Day. (c) A Notice is effective from the time it is taken to have been received in accordance with clauses 22.3(a) and 22.3(b) (unless a later time is specified in the Notice, in which case the notice takes effect from that time).
