Common use of TIMING OF INITIAL REGISTRATION Clause in Contracts

TIMING OF INITIAL REGISTRATION. On June 15, 2001 or as soon thereafter as practicable, Aspen shall file a shelf Registration Statement on Form S-3 (the "Initial Registration") to register 193,994 of the Registrable Shares issued to the Shareholder pursuant to the Merger Agreement. Thereupon, Aspen shall comply with the registration procedures of Section 2.3 with respect to the Initial Registration.

TIMING OF INITIAL REGISTRATION. On Subject to Section 2.1(b), Aspen shall file, by June 15, 2001 or as soon thereafter as practicable2001, Aspen shall file a shelf Registration Statement on Form S-3 (the "Initial Registration") to register 193,994 368,461 of the Registrable Shares shares of Aspen Common issued to the Shareholder Stockholders pursuant to the Merger Purchase Agreement, which shares shall be registered for offering by the Stockholders in the respective numbers set forth in Schedule I hereto. Thereupon, Aspen shall comply with the registration procedures of Section 2.3 with respect to the Initial Registration.
