Common use of Transfer to Other Positions Clause in Contracts

Transfer to Other Positions. (i) When a redundant employee transfers to another position for which the rate of pay is higher than the position previously held the employee will receive the higher rate upon taking up the position. (ii) When a redundant employee transfers to a position for which the rate of pay is lower than the position previously held, the employee will retain the higher rate of pay ('the maintained rate') for a period of 26 weeks. (iii) Allowances and penalties will not be taken into account when ascertaining the maintained rate.

(ii) 27.4.2 When a redundant employee transfers to a position for which the wage rate of pay is lower than the position previously held, held the employee will retain the higher wage rate of pay ('the maintained rate') for a period of 26 weeks. (iii) Allowances 27.4.3 Where an employee is transferred to a new location his/her continuity of service will be deemed to have been continuous and penalties will not all rights accruing thereto shall be taken into account when ascertaining the maintained rateretained.
