Transportation Equipment. In the event Customer supplies equipment for the transportation of Product, Supplier shall have the right to inspect such equipment and to reject such equipment if Supplier, in the exercise of its reasonable discretion, believes such equipment may pose a risk of injury or contamination to persons or property. In the case of barges or vessels supplied by or at the direction of Customer, the type, size and scheduled arrival date must be approved by Supplier in the exercise of Supplier's reasonable discretion.
Transportation Equipment. If Suburban delivers propane to or from the Facilities using Suburban’s equipment or employees, Suburban will be subject to the Terminal Access Agreement executed by the parties substantially in the form of Exhibit “B,” or as subsequently mutually agreed to by the parties. If Suburban’s deliveries of propane to or from the Facilities are contracted and/or made by a common carrier, Suburban shall require the common carrier to sign the Terminal Access Agreement in Exhibit “B”.
Transportation Equipment. Buyer will promptly receive and unload shipments made in Seller’s owned or leased transportation equipment and will return as instructed such transportation equipment in as good condition as received. Buyer will pay Seller for all damage to Seller’s owned or leased equipment that occurs during THE USE, CONTROL, POSSESSION, HANDLING, LOADING OR UNLOADING OF THE TRANSPORTATION EQUIPMENT BY BUYER, ITS EMPLOYEES, CONTRACTORS OR AGENTS. Buyer and Seller will each report to the other the date of arrival and release of such transportation equipment. If Buyer holds Seller’s railcar equipment longer than forty-five (45) days after Seller’s equipment has been tendered for delivery to Buyer, Buyer will pay Seller a charge 3.
Transportation Equipment. CONTRACTOR will purchase the following transportation equipment from vendors: semi tractors, roll off tractors, and end dump trailers. The walking floor trailers will be manufactured at one of CONTRACTOR’s affiliated companies in Southern California. Transportation equipment will be purchased with or include extended warranty periods: semi tractors; roll off tractors; and end-dump trailers.

Transportation Equipment. If Customer utilizes its own transportation, Customer represents and warrants that all transport equipment, including any cargo tanks, is in a properly maintained and safe condition, free from any material defects, and that the equipment is in all respects suitable for the loading and transport of the specific Product to be handled. Customer shall maintain in full force and effect any and all required permits, certificates or licenses required for the receipt, handling, storage, transportation or delivery of Product and agrees that such permits, certificates and licenses for each transport equipment shall be made available to QT Fuels upon request. Customer shall fully comply with all federal, state and local laws, statutes, ordinances, rules and regulations applicable to the maintenance or operation of its transportation equipment, or the receipt, handling, storage, transportation or delivery of Product. In particular, Customer shall fully comply with the pertinent provisions of Public Law 93-633, the “Hazardous Materials Transportation Act” as fully set forth in 00 Xxxxxx Xxxxxx Code Section 1801 et seq, its amendments and implementing regulations, as well as other applicable federal, state and local laws and regulations pertaining to the receipt, handling, storage, transportation, delivery or disposal of hazardous substances, material or waste, or solid waste. Furthermore, Customer shall comply with all operating, reporting and record keeping procedures required by applicable law designed to ensure: (a) that no unauthorized release of any Product occurs; (b) that in the event any Product is released, all applicable reporting and recordkeeping requirements are fully complied with and (c) that in the event any Product is released, all Product and any contaminated environmental medium or media is expeditiously and properly cleaned up and remediated. Customer shall require that Customer’s Carriers using the Access Devices shall hold a current license, in good standing, appropriate for the conveyance and carriage undertaken by said driver and transportation equipment. Customer shall also require that Customer’s Carriers be fully trained, competent and informed and familiar with operating guidelines of the Terminal Facilities. Transportation Equipment. 11.1.1. The Contractor shall be able to provide transportation equipment that can accommodate the various transportation options. It is anticipated that some Contract Users will not have loading docks at their location so trucks with lift gates may be needed for pickups at these sites.
11.1.2. All equipment must be in good working condition and safe to operate. Any equipment deemed not in working condition or unsafe to use must be replaced with alternate equipment.
11.1.3. For purposes of this contract equipment will be defined as unsafe or not in working condition if operation of the equipment will potentially cause damage or injuries to persons or property.
Transportation Equipment. In the event Seller elects to furnish Substitute Coal from an Alternative Source as provided in Section 6, Buyer and Seller shall mutually agree to an alternative place to tender the delivery of such Substitute Coal (and such point shall be the “Point of Delivery” therefore), and to any reasonable arrangements needed to accommodate the loading of such Substitute Coal into Buyer’s Transportation Equipment.
