For the purpose of this Agreement the term underground services shall mean all road subbase, road base and base course of asphalt under paragraph 4 of this Schedule "F", all sanitary sewers and appurtenances under paragraph 13 of this Schedule "F", all watermain and appurtenances to be constructed under paragraph 15 of this Schedule "F", all storm sewers and appurtenances under paragraph 21 of this Schedule "F", and all stormwater management systems and appurtenances under paragraph 22 of this Schedule "F".

Underground Services. The Underwriters will indemnify the Insured for the Damages and Defence Costs in respect of Personal Injury or
(a) prior to the commencement of any work, the Insured enquired of the relevant authority, corporation or company as to the location of such services, cables, pipes or equipment; and
(b) the Insured took all reasonable precautions to prevent Personal Injury or Property Damage; and
(c) any liability arising out of work carried out more than five metres below ground level is excluded; and
(d) any liability arising out of work carried out underground by directional drilling or by a thrusting or boring machine is excluded; and
(e) this coverage is subject to the Sublimit of Liability specified in Item 5 of the Schedule.
(f) an Excess of $5,000 NZD shall apply unless otherwise specified in Item 5 of the Schedule.

Underground Services. (a) The Subdivider shall ensure that the installation of the services will not interfere with or be in conflict with the location of any existing underground facilities, whether on road allowances or private rights-of-way. The Subdivider, or his Consulting Engineer, shall obtain field locates from the appropriate authority prior to the installation of any services.
(b) The Subdivider shall cooperate and coordinate with all utility companies, such as Union Gas, Telephone Company, Cable TV, etc. so that the doing of the work which the Subdivider is required to do shall be coordinated as much as is practicable with the installation of any utilities which may be installed by any utility. Such installations shall not commence until the Municipality has approved the plans, design and specifications that are to be required.
Underground Services. 10.1 Prior to the Owner commencing any work, the Hirer must advise the Owner of the precise location of all underground services on the site and clearly mark the same.
10.2 Whilst the Owner will take all care to avoid damage to any underground services the Hirer agrees to indemnify the Owner in respect of all and any liability claims, loss, damage, costs and fines as a result of damage to services not precisely located and notified as per clause 10.1.
