Unpaid Leaves of Absence. A. An unpaid leave of absence of up to one (1) year may be granted to any contract teacher for the purpose of participating in exchange teaching programs in other states, territories or countries; foreign, embassy and/or military teaching programs; the Peace Corps, Teacher's Corps, or Job Corps as a full-time participant in such program; or a cultural, travel or work program related to his/her professional responsibilities; or for personal health reasons, provided such employee states his/her intention to return to the school system. Requests for such leave shall be submitted in writing by April 1 for the Board's consideration. B. Unpaid Leaves of Absence. A. 1. Any bargaining unit member whose personal illness or disability extends beyond the period compensated in section A-1 of this Article may be granted an unpaid leave of absence for such time as is necessary for complete recovery from such illness or disability or for one (1) year whichever is lesser.
2. In the event a bargaining unit member becomes unable to perform because of medical reasons arising from whatever cause, such bargaining unit member may be placed on leave up to one (1) year in accordance with Article V, Section 2 of the Michigan Teachers Tenure Act, provided that such bargaining unit member is afforded full procedural rights under Article IV, section 4 of the Act. Upon return from said leave, the bargaining unit member shall provide the Board with written medical certification from a mutually accepted physician that s/he is able to return to work.
3. An unpaid leave of absence for up to one (1) year shall be granted upon written application from the bargaining unit member for the purpose of childcare.
a. The period of the leave shall commence no later than thirty (30) days from the date of receipt of the written leave request. In the event of an emergency and upon request, the period of the leave may commence immediately. Whenever possible, the bargaining unit member should consider requesting a leave period which coincides with the end of a semester.
b. The period of leave for an adoptive parent shall commence with the entry of an order by the probate court awarding custody to the adoptive parent.
4. An unpaid leave of absence for up to one (1) year may be granted to any contract teacher upon written application from the bargaining unit member for the purpose of participating study at an accredited college or university in exchange teaching programs in other states, territories or countries; foreign, embassy and/or military teaching programs; the Peace Corps, Teacher's Corps, or Job Corps as a full-time participant in such program; or a cultural, travel or work program field reasonably related to his/her the unit member's professional responsibilities; or for personal health reasons, provided such employee states his/her intention to return to the school system. Requests for such leave shall be submitted in writing by April 1 for the Board's consideration.
B. 5. An unpaid leave of absence of for up to one (1) year may be granted to a contract teacher upon written application from the bargaining unit member for the purpose of engaging in study related to his/her study, travel, research or a special teaching assignment which enhances the professional responsibilities. Requests for such leave shall be submitted in writing for growth of the Board's considerationbargaining unit member.
C. 6. An unpaid leave of absence of for up to one (1) year may be granted to a contract teacher upon written application from the bargaining unit member in cases where illness or death in the family requires the bargaining unit member's absence for periods beyond that provided for in the purpose sick leave provisions of serving as an elected officer of the state associationthis Article.
D. An 7. The Board may grant an unpaid leave of absence not to exceed one (1) year may be granted to for any contract teacher for reason upon written application from the purpose of campaigning for his/her own candidacy or serving in an elected public officebargaining unit member.

(e) A faculty member who is elected or appointed to a political office which requires his/her absence from duty with the College for an extended period of time shall be granted a political leave. Should he/she be reelected or reappointed to the same political office for an ensuing term, or elected or appointed to a different political office, his/her leave of absence shall be terminated. Upon his/her return he/she shall be placed at the same position on the Salary Schedule that he/she would have been had he/she taught in the College during such period if the political office that he/she held directly relates to his/her teaching assignment. A leave of absence for one semester shall be granted to any faculty member upon application for the purpose of running for public office.
(f) A leave of absence of up to one (1) year may be granted granted, upon application, to a contract teacher upon application any faculty member in the technology programs for the purpose of engaging working in study industry as a means of upgrading his/her expertise and skills in the latest industrial techniques. This work experience must be closely related to his/her professional responsibilitiesteaching assignments. Should they be re-elected or re-appointed to the same political office for an ensuing term, or elected or appointed to a different political office for an ensuing term, their leave of absence shall be terminated. A leave of absence for one semester, without pay, shall be granted to any faculty member upon application for the purpose of running for public office.
f. Child Care Leave shall be granted for no more than two (2) academic year to a faculty member upon their request. The faculty member will be able to return to their former position upon completion of the leave period. This leave will be without pay. Fringe benefits shall be provided for the first sixty (60) days of this leave. Faculty members on child care leave will not accrue seniority while on such leave.
g. Mutual Consent leave shall be granted to exceed a faculty member upon their request if it is mutually agreeable to the faculty member and the Board. Such leaves shall be granted for not less than one (1) year may be granted to any contract teacher for the purpose of campaigning for his/her own candidacy or serving in an elected public office.
E. All benefits to which a contract teacher was entitled at the time his/her unpaid leave of absence commenced, and which are currently in effect for contract teachers, as well as unused accumulated sick leave and accrued years toward developmental leave eligibility, shall be restored to him/her upon his/her return.
F. Upon the contract teacher’s return to the District, the District shall endeavor to place the certificated employee in the same or similar position as was vacated and shall advance the employee on the salary schedule.

16.4 A leave of absence of up to one (1) year shall be granted to any teacher upon application for the purpose of serving as an elected officer of the state associationAssociation or on its staff.
D. An unpaid 16.5 A leave of absence not to exceed one (1) year may shall be granted to any contract teacher upon application for the purpose of campaigning for his/her own candidacy for, or serving in an elected in, a public office. This section shall not apply to a State of Michigan Senate Office or House of Representatives Office.
E. All benefits to which a contract 16.6 Any teacher was entitled at the time his/her desiring an unpaid short-term leave of absence commenced(less than 20 working days) shall apply in writing to the Board stating the purpose and the proposed duration of such leave. It is expressly understood that said teacher taking leave here-under will not be eligible for any other form of compensation or monetary benefit for the duration of this leave.

Unpaid Leaves of Absence. A. An The Board may grant an unpaid leave of absence for up to one (1) year upon the written request of a teacher for reasons of child care, professional development, including studies, travel, and special teaching assignments resulting in potential advantage to the District or for other reasons not otherwise provided in this Article. In determining whether to grant any such leave, the Board shall consider the District’s staffing needs and the availability of a certified and qualified replacement to ensure that the quality of student instruction will not be diminished.
B. 1. The leave shall commence thirty (30) days after a written request for such leave has been made. In the event of emergency, leave may commence immediately upon written request. Such request shall indicate the desired termination date of leave.
2. The above leave may be extended upon written application by the teacher at the discretion of the Board. Such extension shall not be denied if it is requested because of a medical reason for which there is medical verification.
E. Parental leave of up to one (1) year shall be submitted in writing granted to a member of the bargaining unit for a period not to exceed one (1) year for the purpose of child rearing. Application shall be made at least thirty (30) days prior to the birth or anticipated date of adoption of the child. Such leave shall commence within thirty (30) days of the birth or adoption of the child. The application shall indicate the desired termination date of the leave. Such leave is renewable at the discretion of the Board's consideration.
C. F. Any bargaining unit member whose personal illness or disability extends beyond his accrued sick leave shall be granted an unpaid leave of absence for such time as is necessary for complete recovery from such illness or disability or for up to one (1) year, whichever is shorter. The leave period may be extended at the Board’s discretion. Upon expiration of the leave of absence and after receipt of medical verification that the bargaining unit member’s recovery is such that he cannot return to a position for which he is certified and qualified, the employment relationship will be terminated.
G. The Employer may grant any tenured teacher an unpaid leave of absence for up to one
(1) year for any reason upon written application to the Superintendent.
H. An unpaid leave of absence of up to twelve (12) weeks during a twelve (12) month period shall be granted to any bargaining unit member in accordance with the Federal Family and Medical Leave Act (FMLA) for any of the following purposes: the birth or placement for adoption or xxxxxx care of a child (up to one (1) year from date of birth or placement); a serious health condition of a bargaining unit member’s spouse, child or parent; the bargaining unit member’s own serious health condition.
1. The bargaining unit member and the District may mutually agree that a leave may be granted to taken either on an intermittent or reduced leave schedule basis. A reduced leave schedule is a contract teacher for leave schedule that reduces the purpose of serving as an elected officer of the state associationbargaining unit member’s regularly assigned hours in a workweek or workday.

Upon return, a bargaining unit member shall endeavor be reinstated to place the certificated employee in the same position from which the leave was taken if such position exists, or similar if such position as was vacated has been eliminated, to an equivalent position for which he is certified and shall advance the employee on the salary schedulequalified.
G. All extensions or renewals 4. In case of unpaid leaves reduction in staff during the leave period, the provisions of Article 27 shall be applied govern.
5. The Board reserves the right to fill a position which is vacant under the provisions herein with a long-term substitute.
6. If the need for and granted or denied in writing. However, where the need is not foreseeable or if the date of the planned medical treatment requires the leave to begin in less than thirty (30) calendar days, the bargaining unit member shall provide such notice upon his receipt of the requisite information.
8. Where permitted by FMLA, the bargaining unit member may elect to use his accumulated sick leave, business leave and/or any combination thereof for all or any part of a leave. Where permitted by the FMLA, the Board may require a bargaining unit member to substitute his accumulated paid leave for unpaid FMLA leave.
9. The Board reserves the right to require certification from the bargaining unit member’s health care provider or from that of the bargaining unit member’s spouse, or child or parent as the case may be.
10. In recognition of the confidential nature of the required medical certifications, all such information shall be requested by and submitted to the Superintendent.
11. The terms and provisions of this leave Section shall be subject to and administered in accordance with the Federal Family and Medical Leave Act of 1993.
I. A voluntary reduction of hours may be granted upon application to the Superintendent at least sixty (60) days prior to the beginning of a semester.
1. A reduction in hours may be granted for the remainder of the school year following purposes:

X. Xx unpaid leave of absence of up to twelve (12) weeks during a twelve (12) month period shall be granted to any contract teacher bargaining unit member in accordance with the Federal Family and Medical Leave Act (FMLA) for any of the purpose following purposes: the birth or placement for adoption or xxxxxx care of campaigning for his/her a child (up to one (1) year from date of birth or placement); a serious health condition of a bargaining unit member's spouse, child or parent; the bargaining unit member's own candidacy or serving in an elected public officeserious health condition.
E. All benefits 1. The bargaining unit member and the District may mutually agree that a leave may be taken either on an intermittent or reduced leave schedule basis. A reduced leave schedule is a leave schedule that reduces the bargaining unit member's regularly assigned hours in a workweek or workday.
2. The following conditions shall apply to which a contract teacher was entitled at the time his/her unpaid leave of absence commencedFMLA leave:
a. Any health, and which are currently in effect for contract teachersdental, as well as unused accumulated sick leave and accrued years toward developmental leave eligibility, and/or vision insurance shall be restored to him/her upon his/her return.
F. Upon the contract teacher’s return to continued, with premiums paid by the District, at the level and under the conditions that same would have been provided if the bargaining unit member had continued in employment during the leave period.
b. If the bargaining unit member does not return to work after the expiration of the leave, the bargaining unit member shall reimburse the District for the cost of the premiums paid by the District for his insurance during the FMLA leave, unless the FMLA provides otherwise.
3. Upon return, a bargaining unit member shall endeavor be reinstated to place the certificated employee in the same position from which the leave was taken if such position exists, or similar if such position as was vacated has been eliminated, to an equivalent position for which he is certified and shall advance the employee on the salary schedulequalified.
G. All extensions or renewals 4. In case of unpaid leaves reduction in staff during the leave period, the provisions of Article 27 shall be applied govern.

ADVANCED STUDY, CULTURAL TRAVEL, OR WORK PROGRAM A leave of absence of up to two (2) years may be granted to any tenured teacher upon application and verification that the leave shall be for the purpose of engaging in advanced study, cultural travel, or work program related to his/her the teacher's professional responsibilities; or for personal health reasons, provided such employee said teacher states his/her their intention to return to the school systemdistrict at the expiration of the leave. All benefits to which a contract teacher was entitled at the time his/her unpaid leave of absence commenced, and which are currently in effect for contract teachers, as well as unused accumulated sick leave and accrued years toward developmental leave eligibility, shall be restored to him/her upon his/her return.
F. Upon the contract teacher’s return to the District, the District shall endeavor to place the certificated employee in the same or similar position as was vacated and shall advance the employee on the salary schedule.
G. All extensions or renewals of unpaid leaves shall be applied for and granted or denied in writing. Failure to return to the District from an unpaid leave at its expiration will be considered a resignation, unless such leave has been extended by the Board.
H. Unpaid maternity leave shall be granted upon request. Unpaid Leaves of Absence. A. 16.4 A leave of absence of up to one (1) year shall be granted to any teacher upon application for the purpose of serving as an elected officer of the state associationAssociation or on its staff.
D. An unpaid 16.5 A leave of absence not to exceed one (1) year may shall be granted to any contract teacher upon application for the purpose of campaigning for his/her own candidacy for, or serving in an elected in, a public office. This section shall not apply to a State of Michigan Senate Office or House of Representatives Office.

Unpaid Leaves of Absence. A. Unpaid Leaves of Absence. A. 1. Any bargaining unit member whose personal illness or disability extends beyond the period compensated in section A-1 of this Article may be granted an unpaid leave of absence for such time as is necessary for complete recovery from such illness or disability or for one (1) year whichever is lesser.
2. In the event a bargaining unit member becomes unable to perform because of medical reasons arising from whatever cause, such bargaining unit member may be placed on leave up to one (1) year in accordance with Article X, section 2 of the Michigan Teachers Tenure Act, provided that such bargaining unit member is afforded full procedural rights under Article IV, section 4 of the Act. Upon return from said leave, the bargaining unit member shall provide the Board with written medical certification from a mutually accepted physician that s/he is able to return to work.

a. The period of the leave shall commence no later than thirty (30) days from the date of receipt of the written leave request. A faculty member who is elected or appointed to a political office which requires their absence from duty with the College for an extended period of time shall be granted a political leave of absence without pay. Should they be re-elected or re-appointed to the same political office for an ensuing term, or elected or appointed to a different political office for an ensuing term, their leave of absence shall be terminated. A leave of absence for one semester, without pay, shall be granted to any faculty member upon application for the purpose of running for public office.
f. Child Care Leave shall be granted for no more than two (2) academic years to a faculty member upon their request. The faculty member will be able to return to their former position upon completion of the leave period. This leave will be without pay. Fringe benefits shall be provided for the first sixty (60) days of this leave. Faculty members on child care leave will not accrue seniority while on such leave.
g. Mutual Consent leave shall be granted to exceed a faculty member upon their request if it is mutually agreeable to the faculty member and the Board. Such leaves shall be granted for not less than one (1) year may be granted to any contract teacher for the purpose of campaigning for his/her own candidacy or serving in an elected public office.
E. All benefits to which a contract teacher was entitled at the time his/her unpaid leave of absence commenced, and which are currently in effect for contract teachers, as well as unused accumulated sick leave and accrued years toward developmental leave eligibility, shall be restored to him/her upon his/her return.
F. Upon the contract teacher’s return to the District, the District shall endeavor to place the certificated employee in the same or similar position as was vacated and shall advance the employee on the salary schedule.
G. All extensions or renewals of unpaid leaves shall be applied for and granted or denied in writingsemester nor more than two (2) semesters. Failure to return to the District from an unpaid leave at its expiration will be considered a resignation, unless such leave has been extended by the Board.
H. Unpaid maternity leave shall be granted upon request. A request for maternity leave and the length of time requested must be submitted to the superintendent fifteen (15) days in advance of the date said leave is to commence. The leave shall be granted for the remainder of the school year in which the baby is born. j. After twelve (12) months of continuous employment, a disability leave without pay may be requested by the Faculty Member from the Chief Academic Officer. Accumulated sick leave must be used prior to the disability leave. Leave may be granted in accordance with Federal on the approval of the President and State lawthe Board of Trustees. Employees granted parental Disability leave may use accumulated sick leave during part be up to ninety (90) calendar days in length, with fringe benefits covered.

C. Following the birth or adoption of a child, a teacher shall be entitled to unpaid child care leave, subject to the following provisions:
1. The teacher must request, in writing, a leave of absence at least twenty (20) calendar days prior to the expected date for such leave.
2. The initial leave period may be for the duration of the semester when the leave commences (if during a semester), plus two consecutive semesters. A leave period is considered to be one semester.
3. Upon returning from child care leave, the teacher shall be given the same, like, or similar position to which her/his qualifications and seniority would entitle her/him.
4. Any teacher adopting a child and wishing to utilize these provisions shall give notice as soon as possible as to when such leave is desired.
5. For seniority and salary schedule purposes, the teacher shall be given credit for a full semester during which time said leave commences, if during a semester.
6. Continuation of insurance benefits will be provided to August 31 of the school year as provided in Paragraph C, Article XXIII, if the unpaid child care leave begins during the second semester; otherwise, such benefits shall be provided on a pro rata share of the insurance year, based on the percentage of the year worked.
7. The teacher shall retain the unused sick leave accumulation as held at the start of the leave of absence (unless all of the sick leave is used during the maternity leave).
D. A military leave of absence shall be granted to any teacher who shall be inducted, enlist, or volunteer for military duty in any branch of the armed forces of the United States. A leave of absence shall not be extended beyond one enlistment, draft, or voluntary period of service.
E. A leave of absence shall be granted for requests which involve education, civic, or family obligations or responsibilities.
F. A teacher on unpaid leave of absence is subject to layoff in accordance with his/her seniority and certification. Unpaid leave time is not a part of experience on the salary schedule or towards seniority in a layoff situation. A leave of absence does not count in compiling years accruing to tenure. Upon return from such leave, in the event that the Board of Education deems it necessary, a physical examination by a physician may be required and paid for by the teacher to determine said teacher’s ability to perform his/her duties satisfactorily. Such leaves shall commence when the teacher is no longer able to adequately perform the duties to which he/she is regularly assigned and shall last, until such time as, he/she is able to assume those duties, but not more than one year and the leave may be renewed at the discretion of the Board. In case any dispute as to whether a teacher, under this provision, is able to adequately perform the duties to which he/she is regularly assigned, the physician who has treated the teacher throughout the disability shall make the final and binding determination unless the Board desires an additional opinion from a mutually selected physician by the Board and teacher at Board expense.
E. A teacher may use her accumulated sick leave for disabilities caused or contributed to by pregnancy or childbirth.
F. A leave of absence shall be granted to any teacher of a newborn child. It is further provided that:
1. The initial leave period may be for the duration of the semester when leave was granted, plus two consecutive semesters excluding a summer. The leave may at Board discretion be extended up to a period of two (2) school years by the written request of the teacher.

I. A leave of absence of not less than 90 days shall be granted to any teacher upon written application in case of illness of the immediate family. Upon return the teacher shall be placed on the next 1/2 step of the salary schedule providing 85 or more consecutive days have been completed. The teacher shall give written notification to the Superintendent by no later than November 1, or February 1 of the semester of leave of either his/her own candidacy intention to return or serving in request for an elected public officeextension of the leave. An unpaid 16.5 A leave of absence not to exceed one (1) year may shall be granted to any contract teacher upon application for the purpose of campaigning for his/her own candidacy for, or serving in an elected in, a public office. 16.7 If the Board has approved a short-term leave of absence (less than 20 working days) for a teacher, then said teacher's insurance benefits under this agreement shall continue in full force and effect for the duration of this leave. It is expressly understood that said teacher taking leave here-under will not be eligible for any other form of compensation or monetary benefit for the duration of this leave.
16.8 A teacher who is unable to teach because of personal illness or disability, and which are currently in effect for contract teachers, as well as unused accumulated sick who has exhausted all paid leave and accrued years toward developmental leave eligibilityavailable, shall be restored to him/her granted, upon his/her return.
F. Upon the contract teacher’s return to the Districtwritten request, the District shall endeavor to place the certificated employee in the same or similar position as was vacated and shall advance the employee on the salary schedule.

A teacher in the process of adopting a child may receive a similar leave. An Section F— Other Leaves of Absence Leaves of absence without pay for reasons other than sickness, accident, or military will, upon proper application and approval by the Board, be granted up to a period of two (2) years to teachers who have two (2) or more years of service. G. All extensions or renewals of unpaid leaves shall be applied for and granted or denied in writing. Failure ability to return to the District from an unpaid leave at its expiration will be considered a resignation, unless such leave has been extended by the Boardwork.
H. Unpaid maternity leave shall be granted upon request. A request for maternity leave and the length of time requested must be submitted to the superintendent fifteen (15) days in advance of the date said leave is to commence. The leave shall be granted for the remainder of the school year in which the baby is born. For births that occur during the summer months (June, July and August) such leave may be extended to the end of the first quarter or the end of the first semester. Any exceptions to the above must be with the superintendent's approval. After having been granted a leave of absence, the teacher shall notify the Board, in writing, of her intention to return to her formal employment before the time specified by law for the notification of teacher re-elections.
I. Parental leave shall be granted in accordance with Federal and State law. Employees granted parental leave may use accumulated sick leave during part or all of the leave.
