Unpaid Leaves of Absence. A. A maximum leave of absence of one (1) year without pay shall be granted an employee desiring to further his/her education, providing said education is in a field of study related to the employee's current assignment. Unpaid Leaves of Absence.
A. A maximum Section 1 An employee desiring a leave of absence must submit a written request to the Assistant Superintendent for Human Resources stating the reason and the desired term of one (1) year without pay shall the leave. A letter of approval must be received from the Superintendent or the Assistant Superintendent before a leave becomes official.
Section 2 Leaves of absence may be granted for personal illness, illness in the immediate family, as defined in Article 21, Section 3, maternity, or military leave. All leaves are without pay, and for terms not to exceed two consecutive school years, except for military leave, which may be for a longer period. The Board of Education may extend the term of any absence upon written request by the employee (Injuries and personal illness which are job related are covered by Article 17, Section 7.
Section 3 For all leaves except military leaves, a medical examination must be completed before an employee desiring may return to further work. An employee may be allowed to return to work if the employee’s health record permits and if a suitable vacancy exists. If an employee notifies the Board of Education of his intention to return to work within the term of the leave, the Board of Education is committed to reinstate the employee, but not later than the term of the leave.
Section 4 In cases of maternity leave, an employee is expected to notify the supervisor of her condition, which will enable the administration to locate a suitable replacement. The effective date of the maternity leave will be determined by the condition of the employee. When a maternity leave is requested, the employee must submit a statement from her physician notifying the Board that she should not work past a specific date. The Assistant Superintendent will establish the effective date based upon the ability of the employee to perform the assigned tasks and report of the attending physician.
Section 5 An employee because of a physical disability must request a leave of absence, shall have his/her education, providing said education is in medical and life insurance premiums paid for a field of study related to the employee's current assignment. When the employee provides evidence of completion period of the educational experience for which the leave was given, the regular step increment for this year shall be allowed. An increment will not be given to the employee who does not complete a full year of additional educational experience as prescribed in the request for said leave which has been approved by the Board.
B. Military leave of absence without pay shall by the Board of Education not to exceed twelve (12) weeks which will be granted according to concurrent with family medical leave for those employees qualifying under the provisions of Michigan and federal law. Unpaid Leaves of Absence.
A. A maximum leave of absence of up to two (2) years shall be granted any teacher, upon application, for the purpose of participating in exchange teaching programs in other states, territories, countries, foreign or military teaching programs, the Peace Corps, Teacher’s Corps or Job Corps as a full-time participant in such programs, provided said teacher states his/her intention to return to the school system. Upon return from such leave, a teacher shall be placed at the same position on the salary schedule as he/she would have been on had he/she taught in the district during such period.

D. Insurance protection provided in this agreement shall be available to a teacher on unpaid leave under this Article if allowed by the rules and regulations of the carrier. The teacher must pay the monthly premiums in advance of the due date to the Central Office. The terms of coverage will be as determined by the carrier.
E. Seniority shall not accrue when a teacher is on unpaid leave under this article for the period of time the leave is in excess of six (6) weeks. There shall be no loss of seniority rights or other benefits accrued prior to the leave.
F. No more than two (2) teachers from the Xxxxxx School; two (2) teachers from XxXxxx school; two teachers from Middle School; two (2) teachers from the High School and one (1) teacher from Adult Education shall be on unpaid leave of absence if the certain criteria and procedures outlined below under Section A. of this article at any given time. These limits do not include extensions granted to those already on leave or on child care leave.
G. Tenure teachers who have been metelected as President or Secretary of the NEA or MEA, upon proper application to the Board, shall be granted a leave of absence for the purpose of performing duties for the Association for a period of two (2) years with pay, provided the National or State Association agrees to reimburse the local Board for this person's salary and fringe benefits so that he may continue to be on the local payroll. Each Teachers given leave of absence under this section, shall receive credit toward annual salary increment.
H. The Board shall grant a leave of absence without pay to any tenure teacher to campaign for, or serve in, a public office. Any teacher taking leave under the provisions of this section shall be entitled to reinstatement in accordance with Section A after the first year and Section C thereafter.
I. A teacher who is unable to work because of personal illness or disability as certified by a licensed physician, shall be granted a leave of absence without pay for the duration of such illness or disability, up to one (1) year and the leave shall be renewed each year upon written request by the teacher provided the physician certification is provided. Any teacher on such a leave shall provide the Board not less than twenty-one (21) calendar days of their intent to return.
J. A leave of absence shall be granted to any teacher for the purpose of child care.
1. A pregnant teacher may commence said child care leave at her option. Anytime after the birth of the child and when she is physically able to adequately perform her teaching responsibilities she may return.
2. In the event of the death of the object child of the leave, the leave of absence may be terminated upon the request of the teacher.
K. If the unpaid leave of absence will granted under this article is to be considered on its individual meritsused as a sabbatical leave, the following shall apply:
1. The applications shall be submitted in accordance with the provisions of this Article. The particular circumstances surrounding each leave will be reviewed by the Board with the understanding that its decision will in no way establish a precedent. The decision of the Board as to whether such leave shall be granted is final. The employee can request only one such leave every teacher must have completed at least seven (7) consecutive years and not consecutiveof service in the school system.
2. In order to provide opportunities for professional development, sabbatical leave may be available to professional staff for formal study or other activities designed for professional improvement. An application for sabbatical leave shall clearly show how the activity shall be of a benefit to the school district, as well as to the individual teacher.
3. The number Board will pay full insurance protection under the current contract during the term of employees who can be on leave during any one year shall be determined by the Boardsabbatical leave.
F. 4. Should an individual fail to carry out the activities outlined for sabbatical leave, they shall refund to the school district the amount of insurance premiums paid on their behalf.
5. The following conditions shall teacher will agree to return to employment in the district for one (1) full year in the event of a semester/trimester leave or two (2) full years in the event of a full year's leave. If a teacher fails to return for the required time, he will be liable for repayment to the district of a proportionate amount of the insurance benefit.
6. On return to the district, the teacher will be placed on the salary schedule at the level he would have achieved if he had not been absent.
L. A teacher may apply to all of the above Board for an unpaid leaves of absence referred to leave in the event they do not qualify otherwise under this Article:.

F. Section 13.6 The following conditions shall apply to all of the above unpaid leaves of absence referred to in this Article:
(a) Salary increment shall not accrue (except for military leaves and leaves taken under the Family Medical Leave Act after August 31, 2004) but position on the salary schedule shall be retained. Position shall be determined as that held by the employee at the time the leave was granted.
(b) Sick leave shall not accrue, but unused sick leave days held at the start of the leave shall be reinstated upon return.
(c) Other fringe benefits shall not be paid, except as otherwise required for employees eligible under the Family and Medical Leave Act.
(d) Requests for unpaid leaves shall be in writing at least sixty (60) calendar days preceding the start of the leave, except for leaves taken under the Family and Medical Leave Act where thirty (30) days notice is required for foreseeable leaves.
(e) The employee on leave must give written notice that he/she desires to return to work ninety (90) days prior to the end of the leave of absence and may return at the beginning of the school year or at the beginning of the second semester unless agreed otherwise by the employee and the Superintendent.

Unpaid Leaves of Absence.

2. Leaves of absence shall be granted for a period of not more than two (2) consecutive years. With at least thirty (30) days written notification to the Board (shorter notice will be accepted where the need for leave is not foreseeable) stating the nature of the child care or emergency situation, any employee who has at least interpreted to be one (1) year of employment will service to qualify for this provision.
4. An employee returning to active service from a leave of absence due to illness or other disabilities may be given required to furnish a maximum doctor’s certificate to the effect that the employee is able to perform satisfactorily his/her assigned duties.
5. No sick leave may be earned while on an unpaid leave of absence.
6. Salary shall cease upon the effective date of leave. Notwithstanding the Family Leave Act provisions, paid fringe benefits (medical insurance, dental insurance, term life insurance) shall also cease upon the effective date of leave or, in the case of employees who completed a full school year of work, at the end of August. The employee must use accrued leave in combination with FMLA leave per federal guidelines. During periods of such leaves of absence that extend beyond FMLA including disability leaves of absence, and running concurrently with COBRA rights, employees may continue coverage of fringe benefits by paying premium costs in full to the Treasurer. All coverage shall cease after two years of such leave.
7. Up to five (5) days of an unpaid leave of absence may be granted for the emergency care of the teacher’s non-dependent ill child.
8. Written requests, in advance when possible, for unpaid leave for reasons other than those allowed elsewhere in this agreement shall be directed to the Assistant Superintendent of Human Capital whose judgement shall be final. All employee requests shall be treated in an equitable manner. Employees who take unauthorized leave shall be subject to discipline up to one (1) year for personal disability, for child care or immediate family emergencies.
E. An employee who has been employed and including termination of employment. Unpaid Leaves of Absence.
A. A maximum (a) Other leaves of absence of up to one year in length, without pay, may be granted by the Director of Human Resources or designee. All requests for an unpaid leave of absence must be in writing and include a reason and a specific start and end date for the leave. Employees requesting a leave for an entire school year must submit the written request to the Director of one Transportation or designee no later than two (12) weeks prior to the first workday of the school year, except in the case of an emergency. Employees requesting a leave during the school year must submit a written request to the Director of Transportation with as much notice as possible. Unpaid Leaves of Absence.
A. Section 1 The Board, upon written request, may grant a leave of absence, without pay, for a period not to exceed one (1) year, subject to renewal at the will of the Board. In such situations, teachers will be provided with insurance benefits, at no cost to the district, in accord with the rules and regulations of the insurance carrier for the duration of the leave.
C. In lieu of the PTO provisions contained in Article 10, teachers may request and may, at the discretion of the Board, receive a medical leave of absence for 1 year.
1. Upon return from the leave, teachers shall provide medical certification that they are physically able to resume full time employment.
D. A military leave of absence shall be granted for teachers who are members of any branch of the armed services of the United States. Teachers returning from such leave shall be subject to the provisions of Section H of this Article as well as the following:
1. Received an honorable or medical discharge;
2. Are still qualified and competent to perform the duties of such teaching position;
3. Make application to the school district for re-employment within 90 days of discharge; and
4. Shall be given up to 2 years credit as it applied to salary schedule advancement and PTO.
E. A leave of absence may be granted to any teacher for the purpose of participating in the Peace Corps, Teacher Corps, or Job Corps as a full time participant subject to the following:
1. The original leave may be for up to 2 years;
2. Teachers shall state their intention to return to this school system; and
3. The time served shall be allowed for salary schedule advancement.
F. The Board may grant a leave of absence for the purpose of further education improvement study subject to the following:
1. For the purpose of an educational study leave, teachers must be enrolled as full time students (12 semester hours or term hours) during the semester of approved leave.
2. Application for such leave shall be made no later than April 1 of the year in which the leave is not foreseeable) stating to commence; and
3. Only one teacher from grades Kindergarten through 5th and one from grades 6th through 12th may be on educational leave at the same time.
G. The Board, at its sole discretion, may grant a leave of absence for other reasons.
H. A leave of absence may be granted to employees for the purpose of child care. The object child of the leave may be prenatal; a newborn infant; a newly adopted child; a child suffering from a crippling, terminal or serious accident or illness.

Said request shall specify the beginning and anticipated ending dates of the leave and, where applicable, be accompanied by a doctor's verification of the nature of the child care or emergency situation, any employee who has at least one (1) year of employment will be given a maximum unpaid leave of absence of up to one (1) year for personal disability, for child care or immediate family emergencieschild's illness.

Unpaid Leaves of Absence.

C. The teacher, in order to return to work from the above leaves, shall furnish the District with a statement from his/her physician, if applicable, indicating that he/she is fit to perform his/her teaching duties.
D. Upon the request to the Board, a leave may be granted to a tenure teacher who desires to improve himself/herself through a full−time study program. Upon satisfactory completion of the said program, the teacher shall advance, if appropriate, on the salary schedule.
E. An employee Teachers who has are officers of the Michigan Education Association or are appointed to its staff may upon proper application be given a leave of absence up to two (2) years for the purpose of performing the duties for the Association. Teachers given leaves of absence without pay for this purpose shall not receive credit toward annual salary increment on the schedule.
F. Military leaves of absence shall be granted to any teacher who shall be inducted or shall enlist for military duty to any branch of the Armed Forces of the United States. Teachers on military leave from the Boyne Falls School System, shall receive credit of increments and sick leave days up to a maximum of two (2) years which would have been employed credited to them had they remained in active service to the District. It is expressly understood by the parties that a teacher on this leave will not receive more credit than an active teacher.
G. A teacher would retain not more than five (5) years in the Oakridge Public Schools can request sick leave days while on leave of absence. Unpaid Leaves of Absence.
A. A maximum Unpaid leaves of absence may be granted for the following purposes. Seniority will not accrue and the teacher will not advance on the salary schedule unless specifically stated. Any teacher whose personal illness extends beyond the period compensated under Article 12 shall be granted a leave of absence without pay for such time as is necessary for complete recovery from such illness. The teacher, upon return from such leave, shall be returned to his/her former position or to a position of like nature and status. B. Teachers who have been employed for seven (7) years may be granted a sabbatical leave for one year.
1. A teacher, upon return from a sabbatical leave, shall be granted an employee desiring restored to further his/her educationformer position or to a position of like nature, providing said education is in a field of study related to the employee's current assignmentseniority and status. A teacher returning from leave will be assigned based on certification only if that teacher was not required to meet qualification standards in the nature assignment he/she held when leave was taken. During said leave, seniority will not accrue nor shall the teacher be advanced on the salary schedule.
G. Other Leaves of Absence
1. In addition to the child care or emergency situationleaves provided elsewhere in this Article, any employee who has the Board may grant written requests for leaves of absence of at least one (1) year semester but not to exceed two (2) semesters without pay and fringe benefits. The written application shall include the purpose for such leave request and the anticipated duration of employment will the leave.
2. At least thirty (30) calendar days prior to the expiration date of the leave, the teacher must give written notice of intent to return to his/her position by certified mail. Failure of any individual to provide such timely notice shall be given deemed a maximum unpaid violation of this provision. A teacher providing such timely notice shall be returned to the same or another position for which he/she is certified and qualified, with the term qualified being as defined according to Article 9 of this Agreement.
H. A teacher may request a leave of absence under the provisions of the Family and Medical Leave Act of 1993 (FMLA) of up to one twelve (112) year for personal disability, for child care or immediate family emergencies.
E. An employee who has been employed five (5) years weeks in the Oakridge Public Schools can request a one (1) year unpaid any school year. (c) Other fringe benefits shall not be paid, except as otherwise required for employees eligible under the Family and Medical Leave Act.
(d) Requests for unpaid leaves shall be in writing at least sixty (60) calendar days preceding the start of the leave, except for leaves taken under the Family and Medical Leave Act where thirty (30) days notice is required for foreseeable leaves.

(1) Teachers returning from military leave or leave taken under the Family and Medical Leave Act will be reinstated to their former assignments (or to an equivalent assignment for which they are certified and qualified) at the conclusion of those leaves, to the extent required by those statutes.
(2) Tenure teachers returning from leaves, other than those leaves referred to (f)(1) above, shall be reinstated to the position held by the least senior teacher assigned to a position for which the returning teacher is both certified and qualified.
(3) Probationary and other non-tenure bargaining unit members returning from leave, other than those leaves referred to in (f)(1) above, shall be reinstated to the next vacant position for which the bargaining unit member is certified and qualified. Vacancies filled in this manner will not be posted under Article 11 of this Agreement.
(4) For purposes of this subsection, the term "qualified" shall be defined as in the layoff and recall procedures of this Agreement, found in Article 12.

Unpaid Leaves of Absence. 1. Employees who have not completed their probationary period are not eligible for leaves of absence.
A. 2. A maximum leave of absence of one (1) year without pay shall for personal reasons satisfactory to the employer may be granted to an employee desiring with seniority for a period not to further his/her educationexceed thirty (30) days. 6. Any employee on a personal leave who does not report back to work by the expiration date as set forth on his/her leave of absence notice or does not receive an approved extension, will be considered to have terminated his/her employment.
