Unpaid Leaves of Absence. 1. Bargaining unit members may, under conditions specified herein, under state law and/or Board Policy, be granted leaves of absence without pay. It is understood that no member shall have a right to such unpaid leave for sporadic or short-term absences, whether or not based upon illness (unless qualified under appropriate FMLA leave). For example, unpaid leave may not be granted for non-FMLA qualifying absence to extend the employment of a member where such member has exhausted all accumulated and/or advanced sick leave, unless the request is for long term unpaid leave and based upon legitimate medical reasons. 2. Eligible employees who are on an approved Board of Education leave of absence shall have the opportunity of continuing to receive Cleveland Heights-University Heights group insurance coverage. Such employees must reimburse the Board for the premium costs. Failure of the individual to forward payments to the Board at the stipulated times will terminate this option. 5. Employees, on return from leave, are assured of employment and will be returned to their former classification. If a leave of absence is required for six or more months, the position will be posted and filled. Upon returning to work, if there is no vacant position in the returning employee’s job classification, the returning employee may bump as set forth under Art. 13 § C. The employee bumped has the same bumping rights as outlined in this section. Time spent on unpaid leave will not be credited towards seniority or as experience on the salary schedule.

Unpaid Leaves of Absence. 1Section 8.1. Unpaid Leaves of Absence. a. Leaves of absence for periods not to exceed one (1. An employee on leave of absence with the Armed Forces of the United States, on resuming duty with the Board, shall be considered to have been uninterruptedly employed. 7. No sick leave may be earned while on an unpaid leave of absence. 8. Salary shall cease upon the effective date of leave. Notwithstanding the Family Leave Act provisions, paid fringe benefits (hospital insurance, dental insurance, term life insurance) shall also cease upon the effective date of leave or, in the case of employees who completed a full school year of work, at the end of August. Also, at the employee’s discretion, the position employee may choose to use accrued leave to cover some or all or none of the FMLA leave, or the employee may choose to use accrued leave in combination with FMLA leave. During periods of such leaves of absence, including disability leaves of absence, and running concurrently with COBRA rights, employees may continue coverage of fringe benefits by paying premium costs in full to the Treasurer. All coverage shall cease after two years of such leave. 9. Up to five (5) days of an unpaid leave of absence may be granted for the emergency care of the teacher’s non-dependent ill child. 10. Written requests, in advance when possible, for unpaid leave for reasons other than those allowed elsewhere in this agreement shall be directed to the Director of Human Resource Services whose judgement shall be final. All employee requests shall be treated in an equitable manner. Employees who take unauthorized leave shall be subject to discipline up to and including termination of employment. A record of any discipline will be posted kept by the Director of Human Resource Services and filled. Upon returning to work, if there is no vacant position in shall become a part of the returning employee’s job classification, official personnel file. Such records shall be removed from the returning employee may bump as set forth under Art. 13 § C. During the six or more months(6) months the employee will accrue seniority and during the additional twelve (l2) months the employee will maintain seniority but will not have any leave time credited for advancement on the salary schedule nor receive any other benefits. This secretary position will be posted to a thirty (30) day maximum period on a temporary filling of job. After thirty (30) days, the secretary position shall be posted to the membership and will be filled by the membership by qualifications and seniority for the duration. The person acquiring said position shall be paid the rate of that classification. If the secretary does not return, then the position must be posted as an open position. If the secretary who was on leave returns to the position as allowed, then the membership secretary who filled the position will be posted and filledconsidered as having the position eliminated. Upon Any bargaining unit member not returning to workwork upon the expiration of the unpaid leave shall be terminated. B. A personal leave of absence without pay and without benefits may be granted, if there is no vacant upon written request, for a period of up to ninety (90) calendar days. During this period of absence, a bargaining unit member may return to the same position in the returning employee’s job classificationand accrue seniority and maintain any accumulated sick leave. Unpaid Leaves of Absence. 1. Bargaining A. Any bargaining unit members maymember absent due to compensable injury under the Workers Compensation Act or whose personal illness or disability extends beyond the period compensated by paid sick leave in Article 10, under conditions specified herein, under state law and/or Board Policy, may be granted a leave of absence upon request, for a period of up to one (1) year. The one (1) year period shall be measured from the employee's first day of absence. Section B shall apply to the first twelve (12) weeks of such leave time in a year. B. Upon proper and timely application, an eligible employee will be granted a qualified leave of absence as required under the Family and Medical Leave Act of 1993 (29 USC 2601) and Board Policy 5660, for a total period of up to twelve (12) weeks per year. A rolling twelve month period will be utilized in all cases by the Board in assessing the amount of time an eligible employee has available for qualified leaves under the Act. The Board may require an employee to utilize available paid leave time (e.g., sick leave, etc.) and such time will be utilized in computing available time off under the Act. In general, intermittent and reduced schedules will not be approved absent mutual agreement between the employee and the Board. Proper consideration, when medically necessary, will be given as required by law in such instances, and alternate assignment(s) may be instituted by the Board. In the event an employee and his/her spouse are employed by the District, whether within or outside of the bargaining unit, an aggregate of twelve (12) weeks will be provided, unless the leave time is attributable to a serious health condition that makes the employee unable to perform the functions of his/her position. In such instances, the total amount of time for each spouse will not exceed twelve (12) weeks for all leaves covered by the Act. Insurance benefit payments will continue for an employee absent on a qualified leave under this section. Employees returning from such leaves will be returned to the same or an equivalent position. In the event this Article or other portions of this Agreement extend greater benefits to an eligible employee in relationship to qualified leaves, the provisions of the Agreement shall prevail. C. Leaves of absence for other purposes, including requests for unpaid days off, shall be made in writing to the superintendent, with a copy of the request being sent by the employee to the employee’s supervisor. The granting of such leaves is discretionary. Staffing needs, the employee's attendance record and other relevant factors will be taken into consideration by the superintendent, or designee, in making a decision on the leave request. D. The following general provisions will apply to all leaves of absence under this Article: 1. Except as set forth in Section B above, the leaves of absence under this Article shall be without pay. It is understood that no member shall have a right to such unpaid leave for sporadic or short-term absences, whether or not based upon illness (unless qualified under appropriate FMLA leave). Unpaid Leaves of Absence. 1. Bargaining ‌ A.
