USE OF ELECTRONIC. DIGITAL DATA
1. Because of the potential instability of electronic/digital data and susceptibility to unauthorized changes, copies of documents that may be relied upon by CLIENT are limited to the printed copies (also known as hard copies) that are signed or sealed by CONSULTANT. Except for electronic/digital data which is specifically identified as a project deliverable for this Agreement or except as otherwise explicitly provided in this Agreement, all electronic/digital data developed by the CONSULTANT as part of the Project is acknowledged to be an internal working document for the CONSULTANT’S purposes solely and any such information provided to the CLIENT shall be on an “AS IS” basis strictly for the convenience of the CLIENT without any warranties of any kind. As such, the CLIENT is advised and acknowledges that use of such information may require substantial modification and independent verification by the CLIENT (or its designees).
2. Provision of electronic/digital data, whether required by this Agreement or provided as a convenience to the Client, does not include any license of software or other systems necessary to read, use or reproduce the information. It is the responsibility of the CLIENT to verify compatibility with its system and long-term stability of media. CLIENT shall indemnify and hold harmless CONSULTANT and its Subconsultants from all claims, damages, losses, and expenses, including attorneys' fees arising out of or resulting from third party use or any adaptation or distribution of electronic/digital data provided under this Agreement, unless such third-party use and adaptation or distribution is explicitly authorized by this Agreement.
USE OF ELECTRONIC. MEDIA Seller acknowledges and agrees that Buyer may require or permit certain transactions with Buyer be conducted electronically using Electronic Records and/or Electronic Signatures. Seller consents to the use of Electronic Records and/or Electronic Signatures whenever expressly required or permitted by Xxxxx and acknowledges and agrees that Seller shall be bound by its Electronic Signature and by the terms, conditions, requirements, information and/or instructions contained in any such Electronic Records. Seller agrees to adopt as its Electronic Signature its user identification codes, passwords, personal identification numbers, access codes, a facsimile image of a written signature and/or other symbols or processes as provided or required by Buyer from time to time (as a group, any subgroup thereof or individually, hereinafter referred to as Seller’s Electronic Signature). Seller acknowledges that Buyer will rely on any and all Electronic Records and on Seller’s Electronic Signature transmitted or submitted to Buyer. Neither Buyer nor Seller shall be liable for the failure of either party’s internet service provider, or any other telecommunications company, telephone company, satellite company or cable company to timely, properly and accurately transmit any Electronic Record or fax copy. Seller understands and agrees that it shall be fully responsible for protecting and safeguarding its computer hardware and software from any and all (a) computer “viruses,” “time bombs,” “trojan horses” or other harmful computer information, commands, codes or programs that may cause or facilitate the destruction, corruption, malfunction or appropriation of, or damage or change to, any of Seller’s or Buyer’s computer information processing systems, including without limitation, all hardware, software, Electronic Records, information, data and/or codes and (b) computer “worms,” “trap doors” or other harmful computer information,
USE OF ELECTRONIC. Data Interchange (EDI) Bombardier is not currently using EDI, however, if and when Bombardier has the capability and equipment to utilize EDI Bombardier will offer EDI transactions in accordance to the parameters set forth below. The SPEC 200 Protocol shall be used for any EDI transaction. Buyer and Bombardier shall implement security procedures to ensure proper use of this communication. A message will be considered received only at the point where it is in a format which can be accepted by the receiving computer according to ATA SPEC 200 rules on transmissions. If garbled transmissions are received, the receiver shall promptly notify the sender through use of the S1REJECT command.

USE OF ELECTRONIC. Versions of this RFP This RFP is being made available by electronic means. In the event of conflict between a version of the RFP in the Offeror’s possession and the version maintained by the agency, the Offeror acknowledges that the version maintained by the agency shall govern. USE OF ELECTRONIC. Trading Facilities may result in principal orders of OpenMarkets (orders for the account of OpenMarkets) being executed at the same time as or in priority to Your Order. You agree that we may execute principal orders where Your Order on the same terms is outstanding and that these Terms constitute disclosure to You about principal transactions as required by the Market Integrity Rules. Unless You notify us otherwise, You will be taken to have agreed to us (and any persons considered to be trading as principal by virtue of their association to us - eg. related bodies corporate) trading as principal with You and agree to pay such fees (if any) on such principal transactions, each time Your Authorised Representative places an order with us unless You are a retail client (as defined in the Corporations Act), and we are not permitted to charge such fees under the Corporations Act (Cth) or the Market Integrity Rules;

USE OF ELECTRONIC. COMMUNICATIONS You are authorized to give instructions either by facsimile, transmission, telecopier or telex (each being a communication by fax), by telephone or any other form of Electronic Communication
a) To transfer funds from any account in the client's name to any individual, firm or corporation;
b) To deal in any manner with stocks, bonds or other types of securities held in or to be purchased for your account;
c) To issue stop payment orders;
d) Relating to foreign exchange transactions; or
e) Relating to transactions in connection with any credit arrangement between you and the Bank, or
f) Relating to any other business that the Bank will accept Any instructions received by Electronic Communication in accordance with this Agreement relate only to dealings of the client at the Home Branch of Account, and are not effective as regards any other branch of BOCC. BOCC will act upon instructions given in accordance with this Agreement during the Home Branch of Account’s usual banking hours on the earliest Business Day possible, as determined by the time of receipt and the type of transaction required. At your request, we may forward to you copies of any Statements, Instruments or other documents by facsimile or other Electronic Access Device to the number or address provided by you from time to time. You are responsible for providing us with your updated contact information in writing with your signature, including without limitation the email address and / or facsimile number and we will use the contact information on our record for the purpose of this section.
