Use of Software Services. Company shall not and shall not permit others in using the Software Services to: (i) defame, abuse, harass, stalk, threaten or otherwise violate or infringe the legal rights (such as rights of privacy, publicity and intellectual property) of others or ProRata; (ii) publish, ship, distribute or disseminate any harmful, inappropriate, profane, vulgar, infringing, obscene, false, fraudulent, tortuous, indecent, unlawful, immoral or otherwise objectionable material or information (including any unsolicited commercial communications); (iii) publish, ship, distribute or disseminate material or information that encourages conduct that could constitute a criminal offense or give rise to civil liability; (iv) engage in any conduct that could constitute a criminal offense or give rise to civil liability for ProRata; (v) misrepresent or in any other way falsely identify Company’s identity or affiliation, including through impersonation or altering any technical information in communications using the Software Services; (vi) transmit or upload any material through the Software Services contains viruses, trojan horses, worms, time bombs, cancelbots, or any other programs with the intent or effect of damaging, destroying, disrupting or otherwise impairing ProRata’s, or any other person’s or entity’s, network, computer system, or other equipment; (vii) interfere with or disrupt the Software Services, networks or servers connected to the ProRata systems or violate the regulations, policies or procedures of such networks or servers, including unlawful or unauthorized altering any of the information submitted through the Software Services; (viii) attempt to gain unauthorized access to the Software Services, Customers’ computer systems, or networks using the Software Services through any means; or (ix) interfere with another party’s use of the Software Services, including any parties Company has done business with or choose not to do business with through the Software Services. ProRata has no obligation to monitor Company’s use of the Software Services. However, ProRata reserves the right (but has no obligation) at all times to monitor, review, retain and disclose any information as necessary to satisfy or cooperate with any applicable law, regulation, legal process or governmental request. Use of Software Services. 3.3.1. MassLabs Responsibilities Support. MassLabs shall use commercially reasonable efforts to provide customer support for the Service as further detailed in its Support Policy.
Use of Software Services. 3.1 During the Term, Philips grants Customer a non- exclusive, non-transferable, limited right to permit Authorized Users to use the Software Service in accordance with the Agreement for the sole purpose of managing street lights and related assets. 3.2 Customer shall not: 3.2.1 copy, decompile, reverse engineer, disassemble or otherwise discover any software or protocols that Philips uses to provide the Software Service(s), or permit any other party to do so; 3.2.2 access the Software Service(s) for other purposes than those mentioned above in this Section 3, 3.2.3 access the Software Service by other means than via the identified Authorized Users that must use the dedicated user interface; 3.2.4 sublicense, resell, distribute, lease, rent, loan, time-share, operate as a service bureau or otherwise distribute or provide access to the Software Service other than to Authorized Users, or otherwise generate income from the Software Service; or 3.2.5 remove, modify or obscure any copyright, trademark or other proprietary rights notices that appear during the use of the Software Service on the user interface.
Use of Software Services. Customer must only use the Software Services for its internal business purposes.

Customer is solely responsible for obtaining all necessary rights and authorizations to collect and enter Customer Data into the Software Services, and hereby warrants that providing such Customer Data to ROAM will not violate or infringe the rights of any third party.

  • Software Services If elected by Customer, the following Software Services will be made available for Customer’s use. 2.1. Core HR Software Service is a system of interactive web pages to assist Customer in its human resource related recordkeeping and reporting. Customer shall ensure the accuracy of its Customer Data. The HR Software Services shall function in accordance with the Documentation, as may be amended from time to time, and provide features to aid Customer with its compliance with federal and state laws and regulations applicable to Human Resources (except as stated otherwise in the Documentation). 2.2. Recruiting Software Service is a system of interactive web pages to assist Customer in posting job requisitions, storing candidates, recording job applications, and the related recordkeeping and reporting. Customer shall ensure the accuracy of its Customer Data. The Recruiting Software Service shall function in accordance with the Documentation which may be amended from time to time.

  • Use of Software Any software that is available on the Services ("Software") is the copyrighted work of Red Hat and/or its licensors. Copying or reproducing the Software to any other server or location for further reproduction or redistribution is strictly prohibited, unless such reproduction or redistribution is permitted by a license agreement accompanying such Software. You may not create derivative works of the Software, or attempt to decompile or reverse-engineer the Software unless otherwise permitted by law. The Company has no obligation to monitor the Communication Services. However, the Company reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. The Company reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever. The Company reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Company’s sole discretion.   • Hosting Services NCR Voyix shall furnish facilities, equipment, computer programs and services, as specified from time to time by NCR Voyix, that NCR Voyix deems necessary for operation and maintenance of the System (collectively, the “Hosting Services”).

  • Online Services Microsoft warrants that each Online Service will perform in accordance with the applicable SLA during Customer’s use. Customer’s remedies for breach of this warranty are described in the SLA.

  • Support Services Rehabilitation, counselling and EAP’s. Support is strictly non- punitive, and can be accessed at anytime (self-identification of the need for help is strongly encouraged).
