Use of Subject Property. District 877 shall have the right to use the leased space for the “xXxxxx Choice” Program. The space shall be available from 7:30 A.M. to 4:30 P.M., Monday through Friday; excluding holidays observed by the County. The leased space shall not be used for any other activity. It is hereby agreed that there will be no more than ten (10) students in the leased space. They must be supervised at all times.
Use of Subject Property. The parties agree that the Subject Property will be used only for aeronautical purposes, and that further assignment or subletting shall be subject to the prior written consent of Lessor, which shall not be unreasonably denied. THIS ASSIGNMENT, THE LOAN DOCUMENTS, AND OTHER WRITTEN DOCUMENTS EXECUTED CONTEMPORANEOUSLY HEREWITH REPRESENT THE FINAL AGREEMENT BETWEEN THE PARTIES AND MAY NOT BE CONTRADICTED BY EVIDENCE OF PRIOR, CONTEMPORANEOUS, OR SUBSEQUENT ORAL AGREEMENTS OF THE PARTIES. THERE ARE NO UNWRITTEN ORAL AGREEMENTS BETWEEN THE PARTIES.
Use of Subject Property. Offices Two years from 1 October 2021 to 30 September 2023 RMB1,327,297.50, calculated at the rate of RMB75 per sq. m. per month GCL Energy Technology shall be responsible for the payment of the utility fees, including water, electricity, telecommunications, network, property management, facilities maintenance, cleaning and carpark usage fee.
Use of Subject Property. The primary purpose of Buyer’s activities undertaken pursuant to this agreement is construction of a 33-unit affordable rental development (the “Project”).
Use of Subject Property. Xxxxxx shall have the right to operate and maintain in good working order and safe condition the stormwater improvement features identified in Paragraph 1 and to use Ponds 2 and 3 on the Subject Property to receive and retain stormwater overflow from Pond 1 and from the Leased Property. Xxxxxx shall have the obligation to operate and maintain the stormwater improvement features constructed pursuant to Paragraph 1 in good working order and safe condition for its own benefit and for the benefit of the City, including utilizing such facilities to pump and convey excess stormwater from Pond 1 to Pond 2 or 3, until such time as the Leased Property is no longer leased by Xxxxxx. If Xxxxxx knows or has a reasonable basis to believe that Pond 1 stormwater is contaminated by a spill or release of Hazardous Substances, as defined in RCW 70A.305.020, in amounts in excess of applicable standards, Xxxxxx will immediately inform the City and will cease pumping from Pond 1. Xxxxxx will promptly sample the subject stormwater to determine whether it contains Hazardous Substances, as defined in RCW 70A.305.020, in excess of applicable standards. Xxxxxx'x obligation to pump stormwater from Pond 1 shall resume when testing confirms that the presence of Hazardous Substances, if any, do not exceed applicable standards. While testing is ongoing, the City may require that Xxxxxx pump Pond 1 stormwater into an isolated tank, if needed to avoid overflow of Pond 1 stormwater or potential release of Pond 1 stormwater into the environment. If testing reveals the presence of Hazardous Substances in excess of applicable standards, Xxxxxx and the City will consult on an appropriate course of action.
Use of Subject Property. The parties acknowledge that Tenant will use the property as a production, packaging and assembly facility. The Subject Property will, in all events, be used in strict compliance with all applicable zoning and subdivision regulations, and with all restrictive covenants, if any. Tenant will not use the Subject Property for the purposes of storing, manufacturing or selling any explosives, flammables, or other inherently dangerous substance, chemical, thing, or device.
Use of Subject Property. Tenant shall use the Subject Property for the purpose of conducting and carrying on the design, manufacture and sale of exercise and fitness equipment, and engaging in activities allied or related thereto and for no other purpose without the written consent of Landlord. Tenant shall not utilize the Subject Property for any unlawful purpose or activity. Tenant represents it will not produce, store or use any hazardous or toxic waste or substance, PCB, dioxin or asbestos on the Subject Property.

Use of Subject Property. AmeriCorps shall have the right to use the leased space. The space shall be available for customers and volunteers of AmeriCorps from 7:30 A.M. to 4:30 P.M., Monday through Friday; excluding holidays observed by the County. AmeriCorps employees or volunteers may be provided reasonable access outside of the public hours upon request. The leased space shall not be used for any other activity.
Use of Subject Property. A. The principal and predominant use of any building constructed on Subject Property, shall be for the Lessee’s or their affiliates’ own aircraft storage. At the discretion of the Lessee, Lessee may store other aircraft that are not owned by the Lessee, so long as Lessee does not charge for such storage. The storage of other aircraft within the building will not be construed by the Lessor as the Lessee engaging in commercial activity, as long as the predominant use remains storage of the Lessee’s or their affiliates’ own aircraft. As used in this Lease, an “affiliate” shall mean a corporation, limited liability company, trust, or other entity in which the Lessee owns a majority interest and, in which, the Lessee has the authority to bind such entity in a contractual obligation. Nothing in this paragraph shall be construed to allow the Lessee to assign or sublet the leased premises in violation of Section 23 below or allow the Lessee to engage in commercial activity.
B. The placement of and plans for improvements are subject to approval as provided below in paragraph 17. Lessee shall obtain written approval before commencing any construction. Such construction and any use shall comply with this Lease and with Cody’s City Code.
C. Lessee shall keep and maintain the leased premises in a neat and orderly manner. This includes keeping grass cut and buildings painted a color approved by the Airport in the Minimum Standards, as well as concealing from view temporary storage of and making lawful disposal of debris, garbage, and other waste material arising out of its occupancy. Under no circumstances shall Lessee permit junk, debris, inoperable or unlicensed vehicles or equipment, or other unsightly material to be stored or otherwise located on the Subject Property.
