User Warranties and Indemnification. You warrant to us the following, and you agree to indemnify and hold us harmless from any loss for your breach of these warranty provisions. • You will comply will this Agreement and all applicable rules, laws and regulations. • You will only transfer eligible items that are properly endorsed and meet our image quality standards. • You will not transmit duplicate items. • You will not re-deposit or re-present an original item once it has been scanned and sent through this service, or any other mobile deposit service, unless we specifically request you to do so. • You will not store (other than as required under subsection 8 - Retention and Disposal of Transmitted Items of this Mobile Check Deposit section) or make a back-up copy of any item you submit to us through Mobile Check Deposit. • All information you provide to us is accurate and true. • The Credit Union will not sustain a loss because you have deposited an item through Mobile Check Deposit. Your breach of any of the above warranties may result in our termination of your use of the service.

a. You will only transmit eligible items.
b. You will not transmit duplicate items.
c. You will not re-deposit or re-present the original item.
d. All information you provide to us is accurate and true.
e. You will comply with this Agreement and all applicable rules, laws and regulations.
f. You are not aware of any factor which may impair the collectability of the item. You agree to indemnify and hold us harmless from any loss for breach of this warranty provision.
User Warranties and Indemnification. You make the following warranties and representations with respect to your use of the Services and each image of an original check you transmit to us using the Services • Each image of a check transmitted to us is a true and accurate rendition of the front and back of the original check, without any alteration, no fraudulent check and the drawer of the check has no defense against payment of the check. • The amount, the payee, signature(s), and endorsement(s) on the original check are legible, genuine, and accurate. • Each check that you submit to us for deposit will not be resubmitted in any format to us or to any other person for payment and will not cause the same drawer’s account to be debited twice. • Other than the digital image of an original check that you remotely deposit through the Services, there are no other duplicate images of the original check. • Each original check was authorized by the drawer in the amount stated on the original check and to the payee stated on the original check. • You have not knowingly failed to communicate any material information to us. • You will retain possession of each original check deposited using the Services for the required retention period and neither you nor any other party will submit the original check for payment. • Your account into which you deposit checks using the Services, and the funds from such checks, are only used for consumer purposes and not for business purposes. • You will not use the Services and/or your accounts for any illegal activity or transactions. • Files and images transmitted to us will contain no viruses or any other disabling features that may have an adverse impact on our network, data, or related systems. You understand and agree that you are required to indemnify us and hold us harmless against any and all claims, actions, damages, liabilities, costs and expenses, including reasonable attorneys’ fees and expenses, arising out of your use of the Services and/or breach of this Agreement. You understand and agree that this paragraph shall survive termination of this Agreement.

c. You will not transmit duplicate items
d. You will not deposit or represent the original item once it has been scanned and sent through this service unless specifically requested to do so by Skyward.
e. All information you provide to Skyward is accurate and true.
f. You will comply with the agreement and all applicable rules, laws and regulations.
g. Items you transmit do not contain viruses.
h. You agree to indemnify and hold Skyward from any loss or breach of this warranty provision.
User Warranties and Indemnification. You warrant to the Credit Union that: Errors in Transmission - By using the service you accept the risk that an item may be intercepted or misdirected during transmission. The Credit Union bears no liability to you or others for any such intercepted or misdirected items or information disclosed through such errors. Errors - You agree to notify the Credit Union of any suspected errors regarding items deposited through the service right away, and in no event later than thirty-three (33) days after the applicable Credit Union account statement is sent. Unless you notify the Credit Union within thirty-three (33) days, such statement regarding all deposits made through the service shall be deemed correct, and you are prohibited from bringing a claim against the Credit Union for such alleged error. Cooperation with Investigations - You agree to cooperate with us in the investigation of unusual transactions, poor quality transmissions, and resolution of customer claims, by providing, upon request and without further cost, any originals or copies of items deposited through the service in your possession and your records relating to such items and transmissions. Termination - This Agreement shall remain in full force and effect unless and until it is terminated by us. We may terminate this Agreement at any time and for any reason. Without limiting the foregoing, this Agreement may be terminated if you breach any term of this Agreement, if you use the service for any unauthorized or illegal purposes or you use this service in a manner inconsistent with the terms of this Agreement or any other agreement with us. Enforceability - We may waive enforcement of any provision of this Agreement. Any such waiver shall not affect our rights with respect to any other transaction or to modify the terms of this Agreement. In the event that any provision of this Agreement shall be deemed to be invalid, illegal, or unenforceable to any extent, the remainder of the Agreement shall not be Ownership & License - You agree that the Credit Union retains all ownership and proprietary rights in this service, associated content, technology, and website(s). Your use of this service is subject to and conditioned upon your complete compliance with this Agreement. You agree not to copy, reproduce, distribute or create derivative works from the content of this service or to reverse engineer or reverse compile any technology used to provide this service. d. You will destroy remotely deposited items, and not re-deposit or re-present any original item;
e. All information you provide to us is accurate, true and correct;
f. You will comply with this Agreement and all applicable rules, laws and regulations;
g. With respect to each check image that you transmit, you are deemed to have made any representation or warranty that would have applied had you deposited a paper check by other means; You must indemnify and hold us harmless from any loss or damage arising from or in connection with breach of these warranties.
