Utilities Costs. 8.1 Subject to the terms and conditions of this License, the Licensee shall have the right to connect the Licensee Equipment to the electric power distribution system within the Building at the sole cost and expense of the Licensee. The Licensee agrees to pay for such electricity consumption which shall be calculated based upon the rates set out in Schedule “G” attached. Licensee agrees to pay for such electricity consumption “in- advance” on a monthly basis with an annual reconciliation, provided that any overpayments by the Licensee, based upon the actual consumption by the Licensee, shall be refunded to the Licensee by the Licensor within sixty (60) days of Licensor receiving an invoice from the applicable utility for such electricity consumption. 8.2 Except in the case of a real or apprehended emergency where Licensor shall provide reasonable notice beforehand or forthwith thereafter, the Licensor shall provide to the Licensee five (5) Business Days notice of any planned construction, maintenance, utility outages or other Building repairs that may affect the Licensee Equipment or provision of Licensee Services. 8.3 The Licensee agrees that the Licensor has no obligation or responsibility to provide emergency or backup power to the Licensee, unless the Licensor agrees to provide emergency or backup power to the Licensee on such terms and conditions as may be mutually agreed to by the parties in writing.

Utilities Costs. (G) Tax Expenses; (H) costs occasioned by casualties or condemnation; (I) costs to correct violation of law applicable to the Premises or the Project on the Lease Commencement Date: (J) costs incurred in connection with the presence of any Hazardous Materials, except to the extent caused by the release or emission of the Hazardous Material in question by Tenant or any of Tenant’s Parties; (K) expense reserves; (L) costs which could properly be capitalized under generally accepted accounting principles, except as specifically provided in 4.2.3(x), above, and only to the extent amortized over the useful life of the capital item in question; (M) costs for services not provided to Tenant under this Lease or are of a nature that are paid directly by Tenant; (N) profit by Landlord for managing or administering the Project except as set forth in Section 4.2.3(v) above; and (O) any costs related to construction of any other buildings or completion of the work described in Sections 1.1.3 or 24.30 or Exhibit B.

Utilities Costs. UTILITIES COSTS" means all of the following that are not Excluded Costs and that are incurred by Landlord in connection with the ownership or operation of the Property; (a) costs and expenses for consumption or use of public or private utility services for the Property, including without limitation, water, steam, sewer, waste disposal, gas, telecommunications, and electricity; and (b) amortization in accordance with generally accepted accounting principles of capital expenditures and reasonable financing charges for items that are primarily for the purpose of (i) reducing or avoiding increases in Utilities Costs in Landlord's good faith estimate, or (ii) complying with Laws imposed after the initial construction of the Building.

Utilities Costs. 8.1 Subject to the terms and conditions of this License, the Licensee shall have the right to connect the Licensee Equipment to the electric power distribution system within the Building at the sole cost and expense of the Licensee. Either party, at its sole cost, expense and option may install a check meter to measure the electricity consumption of the Licensee and the Licensee agrees to pay for such electricity consumption based on the metered use of same. In the event the Licensee elects not to install a check meter and in the event the electrical consumption is not included in the POP Space Fee, the Licensor shall, acting reasonably, estimate the amount of electricity consumed by the Licensee, which amount shall be paid within sixty (60) days of receipt of an invoice by the Licensee, in advance throughout the Term provided that any overpayments by the Licensee, based upon the actual consumption by the Licensee, shall be refunded to the Licensee by the Licensor within sixty (60) days of Licensor receiving an invoice from the applicable utility for such electricity consumption. 8.2 Except in the case of an emergency, the Licensor shall provide to the Licensee 10 Business Days notice of any planned construction, maintenance, utility outages or other Building repairs that may affect the Licensee Equipment or provision of Licensee Services. 8.3 The Licensee agrees that the Licensor has no obligation or responsibility to provide emergency or backup power to the Licensee, unless the Licensor agrees to provide emergency or backup power to the Licensee on such terms and conditions as may be mutually agreed to by the parties in writing.
Utilities Costs. The cost of all utilities without xxxx-up (including without limitation, electricity, gas, sewer and water) to the Premises shall be paid by Tenant. All such utilities are separately metered to the Premises, and Tenant shall contract with and pay directly to the applicable utility provider for all such utilities. 6.2.1 Landlord shall not provide janitorial or trash services for the Premises. Tenant shall be solely responsible for performing all janitorial and trash services and other cleaning of the Premises, all in compliance with applicable laws. In the event such service is provided by a third party janitorial service, and not by employees of Tenant, such service shall be a janitorial service approved in advance by Landlord, which approval shall not be unreasonably withheld, conditioned or delayed.
