Accumulation of Vacation Leave Credits 34.02 For each calendar month in which an employee has earned at least (a) one and one-quarter (1 1/4) days until the month in which the anniversary of the employee’s eighth (8th) year of service occurs; (b) one and two-thirds (1 2/3) days commencing with the month in which the employee’s eighth (8th) anniversary of service occurs; (c) two and one-twelfth (2 1/12) days commencing with the month in which the employee’s nineteenth (19th) anniversary of service occurs; (i) effective April 1st, 1999, two and one-twelfth (2 1/12) days commencing with the month in which the employee’s eighteenth (18th) anniversary of service occurs; (d) two and one-half (2 1/2) days commencing with the month in which the employee’s thirtieth (30th) anniversary of service occurs; (i) effective April 1st, 1999, two and one-half (2 1/2) days commencing with the month in which the employee’s twenty-ninth (29th) anniversary of service occurs; (e) however, an employee who has received or is entitled to receive furlough leave shall have the vacation leave credits earned under this clause, reduced by five-twelfths (5/12) of a day per month from the beginning of the month in which the employee’s twentieth (20th) anniversary of service occurs until the beginning of the month in which the employee’s twenty-fifth (25th) anniversary of service occurs. (a) For the purpose of clause 34.02 only, all service within the Public Service, whether continuous or discontinuous, shall count toward vacation leave except where a person who, on leaving the Public Service, takes or has taken severance pay. However, the above exception shall not apply to an employee who receives severance pay on lay-off and is reappointed to the Public Service within one year following the date of lay-off. (b) Notwithstanding (a) above, an employee who was a member of one of the bargaining units listed below on the date of signing of the relevant collective agreement or an employee who became a member of those bargaining units between the date of signing of the relevant collective agreement and May 31, 1990 shall retain, for the purpose of “service” and of establishing his or her vacation entitlement pursuant to this clause, those periods of former service which had previously qualified for counting as continuous employment, until such time as his or her employm...
VACATION LEAVE WITH PAY a. Vacation with pay shall be earned by regular and extra-help employees based on the equivalent of full-time service from the date of appointment. Vacation credit shall accrue to the employee upon completion of regular work assignment on the last day of the biweekly pay period in which it is earned. b. Employees who have less than three (3) years of service shall accrue vacation on the basis of 4.0 hours for each biweekly pay period of service. c. Employees who have more than three (3) years but less than fifteen (15) years of service shall accrue vacation on the basis of 5.5 hours for each biweekly pay period of service. d. Employees who have more than fifteen (15) years of service shall accrue vacation on the basis of 7.1 hours for each biweekly pay period of service. e. Alternate Provisions Sub-clauses 38.02(b), 38.13(c) and 38.13(d) apply only to bargaining unit employees classified as GL or GS. VACATION LEAVE WITH PAY. 15.01 For each calendar month in which an employee has earned at least ten (10) days' pay, vacation leave credits shall be earned at the rate of: (a) eleven decimal sixty six (11.66) hours per month until the month in which the employee completes seven (7) years of service; (b) fourteen decimal fifty eight (14.58) hours per month commencing with the month in which the employee completes seven (7) years of service; (c) seventeen decimal five (17.5) hours per month commencing with the month in which the employee completes sixteen (16) years of service. (d) For the purposes of Article 15, years of service will include years working for a bargaining agent representing employees of an organization of the public service as defined in the Public Service Labour Relations Act, to the extent that the duties of the employee included direct service to employees of such organizations. 15.02 The employer will make every reasonable effort to grant vacation leave to an employee at such times as the employee chooses. The employer shall give an employee as much notice as practicable and reasonable of approval, denial or cancellation of a request for vacation leave. (a) Provided that an employee has completed six (6) months of continuous service, on written request the employee shall be granted vacation leave in advance to the extent of the credits that he or she will earn during the year in which the leave is granted subject to the deduction of such advanced leave from vacation leave credits subsequently earned, or the recovery of the advance in the event of termination for reasons other than death or lay-off. (b) Where an employee has less than six months of continuous service, and has insufficient or no credits to cover the granting of vacation leave, vacation leave with pay may, at the discretion of the employer, be granted subject to the deduction of such advanced leave from vacation leave credits subsequently earned, or the recovery of the advance in the event of termination for reasons other than death or lay-off. (a) An employee can accumulate up to two hundred and eighty 280 hours of vacation leave in his or her vacation leave bank. If the vacation leave bank contains more than two hundred and eighty 280 hours of vacation leave, the employee can elect to take the days in excess of two hundred and eighty 280 hours either in time-off with pay or in cash (subject to article 15.04 (b) below).
