Vacations, Holidays, Sick Leave. Executive shall be eligible to accrue up to thirteen and one third (13 1/3) hours of vacation per month, which is equivalent to one hundred sixty (160) hours or twenty (20) days per full calendar year. The Company’s policies and/or practices as are generally applicable to executive employees of the Company shall apply to Executive’s accrual and use of vacation. Executive will be eligible to earn paid sick leave in accordance with the Company’s standard policy for similarly situated employees and applicable law. Executive will also be entitled to all paid holidays provided to the Company’s executive employees in California.

Vacations, Holidays, Sick Leave. The Superintendent shall be privileged to take, at the Superintendent's choice, the greater of twenty (20) vacation days annually or the same number of days of vacation authorized by policies adopted by the Board for administrative employees on twelve-month contracts, the days to be taken in a single period or at different times. The vacation days taken by the Superintendent will be taken at such times or times as will least interfere with the performance of the Superintendent's duties as set forth in the Contract. The Superintendent's accrued and unused vacation days shall accumulate and carry over from year to year. At the sole option of the Superintendent, on or before the end of each year of the term of this Contract, the District shall pay in a lump sum to the Superintendent any accrued but unused vacation days, up to a maximum of twenty (20) accrued but unused vacation days annually, at the Superintendent's daily rate of pay as of payment date, determined by dividing the Superintendent's then total TRS creditable compensation by 226. At the time the Superintendent leaves employment, either voluntarily or involuntarily, with the District, the District will pay the Superintendent for up to fifty (50) unused accrued vacation, local and State personal days at her her current daily rate of pay. The Superintendent shall observe the same legal holidays as provided by Board policies for administrative employees on twelve-month contracts. The term "legal holiday(s)" includes days for which the District's central administration office is closed. The Superintendent is hereby granted the same illness benefits and leave as authorized by Board policies for administrative employees on twelve-month contracts, except that the Superintendent, at her discretion, may utilize any and all accrued but unused leave days to be taken in a single period or at different times during the term of this Contract.

If Executive is unable to utilize planned vacation time in a given year due to the demands of the business as set forth by the Chairman or the Chief Executive Officer of National Media, and such vacation time is not thereafter used in the applicable year, Executive shall be paid for such accrued but unused vacation time at the expiration of such year. Executive shall also be entitled to all paid holidays and sick leave as are generally awarded to senior executives of National Media.

Vacations, Holidays, Sick Leave. The Superintendent shall receive the number of vacation days, plus 6 additional vacation days, as authorized by board policy for administrative employees on 12-month contracts. The Superintendent shall observe the same holidays and breaks as provided for other 12-month administrators in the Board’s adopted annual calendar and shall be eligible for any leave available to other employees under Board policy. The Superintendent shall schedule vacation and leave days with prior written approval of the Board President and at times that will least interfere with the performance of the Superintendent’s duties.

The Superintendent’s accrued and unused vacation days shall carry over from year to year as authorized by Board policies for administrative employees on 12-month contracts. The Superintendent may request payment for up to 10 days of accrued but unused vacation days on June 30 of each year during the term of this Agreement (and also a one-time right to request payment for up to 10 days of accrued vacation within 30 days of execution of this Agreement), to be paid at the Superintendent’s “Daily Rate,” determined by dividing the Superintendent’s then-current annual salary by 260. The Superintendent shall observe the same legal holidays as provided by Board policies for administrative employees on 12-month contracts and shall be granted Juneteenth if and when the Board approves that holiday for other PPS nonrepresented employees. The Superintendent is hereby granted the same number of illness benefits and other leaves as authorized by Board policies for administrative employees on 12-month contracts. If there are any changes to District vacation, holidays, or leave benefits or policies for nonrepresented employees during the term of this Agreement, those changes shall not apply to the Superintendent unless the parties agree to those changes in writing.

Employees hired prior to July 1, 1997: Employee will be paid for unused sick days in the following manner: a. Payment for unused sick days will be made to the employee upon that employee’s early or full service retirement or, upon the employee’s death, to the employee’s estate. Employees eligible for early or full service retirement who resign from employment and do not receive a retirement benefit, shall forfeit all rights to payment for unused sick days. b. Employees, who have a balance of less than 250 unused sick days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to a maximum of 250 unused days at their average daily rate*. c. Employees who have a balance of unused sick days greater then 250 days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to their June 30, 2002, unused sick leave balance, at their average daily rate*. d. Payments for unused sick days in amounts greater than $5,000 will be paid in equal amounts over five consecutive years beginning with the year of retirement. e. Payments for unused sick days in the amount at $5,000 or less or for the death of an employee will be paid in a lump sum to the employee or the employee’s estate in the year of retirement or death.
