Developer has full power, authority, and capacity to (i) enter into this Agreement, (ii) carry out Developer’s obligations as described in this Agreement, and (iii) assume responsibility for compliance with all applicable Governmental Regulations (including, without limitation, those in the CDBG-DR Regulations and the CDBG Multifamily Rental Housing Guidelines).
