Value of the contract. The MA will transfer the ERDF funds on the basis of the eligible expenditures. MA will make the transfer of ERDF in the limit of the existent balance at the date of reimbursement request, and in case of insufficient funds, payment process will be suspended until the European Commission credits the program’s account with the amounts representing the ERDF funds. The Lead Beneficiary commits itself to support its own contribution and the non-eligible expenditures as well as to ensure the temporary availability of funds for the proper implementation of the project until they are reimbursed by the MA. In the case of net revenue generating projects, the partners shall respect the provisions of Article 61 of Regulation (EU) No. 1303/2013

4 Special contractual provisions

4.1 Deviations from the General Implementing Rules This chapter of these Tender Specifications holds the specific provisions that apply to this public contract by way of derogation from the 'General Implementing Rules for public procurement and for concessions for public works’ of the Royal Decree of 14 January 2013, hereinafter referred to as 'GIR', or as a complement or an elaboration thereof. The numbering of the articles below (between brackets) follows the numbering of the GIR articles. Unless indicated, the relevant provisions of the General Implementing Rules (GIR) apply in full. These tender specifications derogate from Art. 25-33 of the General Implementing Rules (see point 4.7 “Performance bond (Art. 25-33)”). This is motivated by the need to provide equal opportunity for local and international bidders to participate with a view to increasing competition.
Value of the contract. (1) The Fund approves funds to the Beneficiary of the funds in the amount of x .00 denars (with letters хх denars), and which amount represents 100% (one hundred percent) of the total Project budget.
(2) The allocation and the purpose of the funds from paragraph 1 of this article is determined and will be carried out in accordance with the approved Project budget and the Public call.
(3) The payment of the funds will be made in advance, after signing the Contract in the amount of 50% of the total project budget, and the remaining 50% after successful implementation of the solution, subject to the project in the Municipalities that have technical conditions for its implementation, ie after submitting a Report for realization of the solution / s and their implementation and approval of the Final Report.
(4) In case the project is not successfully realized and implemented in the Municipalities that have technical conditions for its implementation or in case of abuse, the amount of 50% will not be paid to the beneficiary of the funds.
(5) For the needs of the project, the Beneficiary of the funds will open a separate bank account with number xx at xX AD Skopje to which the financial means will be transferred.
