Verification of Use. Customer will monitor its own use of the Cloud Service and report any use in excess of the Usage Metrics and volume. Qualtrics may monitor use to verify compliance with Usage Metrics, volume and the Agreement.

Verification of Use. 5 a. Pursuant to Multnomah County policy, Management must require 6 the completion of a certification form by the employee’s health care provider and any other 7 verification required for under the provisions of the FMLA, OFLA, or their successors. 8 b. Management may require medical verification of absence due to 9 non-FMLA and non-OFLA covered illness or injury under the following conditions: 10 i. the employee has been absent for more than three (3) 11 days; or 12 ii. the employee has exhausted all sick leave; or 13 iii. the employee has had five or more events with less than 14 24 hours notice in a six month period; or 15 iv. management reasonably believes that the absence may 16 not be bona fide.
Verification of Use. You agree to keep accurate records sufficient to provide auditable verification that Your use of Our Software is in compliance with the terms and conditions of this Agreement. We, or Our specifically designated representatives, have the right to verify Your compliance with this Agreement, at Our expense, during the term of this Agreement and for a period of one (1) year thereafter. Verification will take place upon reasonable notice during normal business hours and in a manner that does not interfere unreasonably with Your operations. If verification reveals unlicensed use of Our Software, You must promptly order sufficient licenses at Our then-current pricing to permit the usage disclosed. If material unlicensed use is found (license shortage of 5% or more), You must reimburse Us for the costs We have incurred in verification and acquire the necessary additional licenses within thirty (30) days. If We undertake such verification and do not find material unlicensed use of Our Software, We will not undertake another verification of the same Licensed Entity for at least one (1) year. We will use the information obtained in compliance verification only to enforce Our rights and to determine whether You are in compliance with the applicable terms of this Agreement.
Verification of Use. 6.1. We (or our designated auditors) shall have the right to audit your use of the Service to verify your compliance with any usage limits and this Agreement. We will conduct any such audit at our expense and will use reasonable endeavors to provide you with reasonable prior notice of any such audit. If any such audit reveals that you have underpaid Subscription Fees or owe any other fees to us in connection with the Service then, without prejudice to any other rights that we may have under this Agreement, we will invoice you for the underpayment or amount due based on our then- current price list for the Service. You shall pay any such invoice within ten (10) days of the date of the invoice.

The County may require an employee to submit written 1 medical verification from a health care provider due to non-FMLA and non-OFLA 2 covered illness or injury under the following conditions: 3 i. The employee has been absent for more than three 4 (3) consecutive works days; or 5 ii. The employee has requested leave that is 6 scheduled to last more than three (3) scheduled work days; or 7 iii. The employee has exhausted all sick leave; or 8 iv. The employee commences sick time without 11 provides notice to the County as soon as is practicable; or 12 v. When the employee has exceeded the amount of 13 sick leave protected under the Oregon Sick Leave Law and has had five (5) or more 14 events with less than twenty-four (24) hours’ notice in a six (6) month period; or 15 vi. Management suspects that an employee is abusing 16 sick time, including engaging in a pattern of sick leave abuse. “Pattern of sick leave 17 abuse” includes, but is not limited to, repeated use of unscheduled sick time on or 18 adjacent to weekends, holidays, vacation days, or paydays. After an employee has 19 exceeded the amount of sick leave protected under the Oregon Sick Leave Law, an 20 employee may be required to submit written medical verification when management 21 reasonably believes that the absence may not be bona fide. 22 If medical verification is requested, the County will pay any and 23 all reasonable costs, including lost wages, associated with obtaining medical 24 verification that are not covered under the employee’s health benefit plan in which 25 the employee is enrolled.

Pursuant to Multnomah County policy, Management must require 13 the completion of a certification form by the employee’s health care provider and any other 14 verification required for under the provisions of the FMLA, OFLA, or their successors. 15 b. The County may require an employee to submit written medical 16 verification from a health care provider to receive sick leave benefit for any non-FMLA or non- 17 OFLA condition under any of the following circumstances: 18 i. the employee has missed work due to illness for more than 19 three (3) consecutive work days; or 20 ii. the employee has requested leave that is scheduled to last 21 more than three (3) scheduled work days: or 22 iii. the employee has exhausted all sick leave; 23 iv. whenever the County can articulate reasonable cause to 24 believe that a misuse or abuse of sick leave has occurred, including questionable usage, 25 questionable patterns of usage or calling in sick on a previously denied day off, provided the 26 employee has been previously notified by a supervisor or Human Resources representative 27 that, due to such concerns, future verification may be required. After an employee has 28 exceeded the amount of sick leave protected under the Oregon Sick Time Law, employees 29 notified of such reasonable cause described in this paragraph may be required to furnish 30 certification as referenced above for each use of sick leave for a period not to exceed six (6) 31 months following the notice; 32 v. when the employee has exceeded the amount of sick leave 33 protected under the Oregon Sick Time Law and has called in sick five (5) or more times for 1 separate events in any six (6) month period, regardless of how the time is charged and the 2 employee has been notified by a supervisor or Human Resources representative that such 3 verification will be required for a period up to six (6) months following the notice.

If any such audit reveals that you owe any Fees to us then, without prejudice to any other rights that we may have under this Agreement, we will invoice you for the underpayment or amount due based on our then current price list. You shall pay any such invoice within ten (10) days of the date of the invoice.

Management may require medical verification of absence due 27 to qualified protected sick time under the following conditions: 28 i. The employee has missed work due to illness for more 29 than three consecutive work days; or 30 ii. The employee has requested leave that is scheduled 31 to last more than three scheduled work days; or 1 iii. The employee has exhausted all sick leave; or 2 iv. The employee commences sick time without providing 3 prior notice required by the County, unless medical circumstances prevent the employee 4 from providing notice prior to commencing sick time and the employee provides notice to 5 the County as soon as is practicable; or 6 v. Management reasonably believes that the absence 7 may not be bona fide, including engaging in a pattern of sick leave abuse. 8 vi. If medical verification is requested, the County will pay 9 any and all reasonable costs associated with obtaining medical verification. 10 c. Management may require medical verification of absence due 11 to non-FMLA, non-OFLA, non-protected Oregon Sick Leave, and non-Paid Leave Oregon 12 covered illness or injury under the following conditions: 13 i. the employee has been absent for more than three (3) 14 consecutive work days; or 15 ii. the employee has exhausted all sick leave; or 16 iii. the employee has had five (5) or more events with less 17 than twenty-four (24) hours’ notice in a six (6) month period; or 18 iv. management reasonably believes that the absence 19 may not be bona fide.

Verification of Use. Sage (or its designated auditors) shall have the right to monitor or audit your use of the Service to verify compliance with this Agreement. If it is revealed that you have underpaid fees, including such fees as may be due to your Accountant, or owe fees to Sage, without prejudice to any other rights that Sage may have under this Agreement, Sage will invoice you for the underpayment or amount due based on Xxxx’s then current price list. You shall pay any such invoice within ten (10) days of the date of the invoice, and all unauthorised User subscriptions will be converted into full-use subscriptions at our then-current list pricing for such full-use User subscriptions.
