Violations and Sanctions a. If an authorized xxxxxx has been identified through compliance purchases to have committed a violation (see Rules and Procedures for Farmers (FMC-4)), he/she will be notified in writing by the Department that a violation of program rules has been recorded and that a subsequent violation can result in disqualification from the program. A copy of the letter will be sent to the market. Upon its receipt, the market must inform the xxxxxx that the market is aware of the violation and that further violations could result in disqualification from the FMNP. b. If an unauthorized xxxxxx or non-xxxxxx vendor is found by means of compliance purchases to be accepting FMNP Checks, he/she will be notified of this in writing by the Department. A copy of the letter will be sent to the market. The market is to notify the unauthorized xxxxxx or non- xxxxxx vendor that further acceptance of FMNP checks will be grounds for suspension or termination of their participation in the market per the market's rules and regulations. If further check acceptance occurs, the market must sanction the xxxxxx or vendor through suspension or termination of participation in the market or by alternative means. c. If a private nonprofit agency (nonprofit) exempt from income tax under the Internal Revenue Code of 1986, as amended, (26 U.S.C. 1 et. seq.) is operating a market in the program, selling local produce on behalf of bona fide farmers, accepting FMNP checks for this local produce, and then fails to account and make prompt payment, without reasonable cause, for any local produce bought or contracted to be bought or negotiated to be bought, he/she will be notified in writing by the Department that a violation of program rules has been recorded and that a subsequent violation can result in disqualification from the program.

If an FMNP-authorized xxxxxx is identified through a farm inspection to not meet the requirements of the program, he/she will be notified in writing by the Department that such a finding has occurred and he/she is being disqualified from the program. b. If an FMNP-authorized xxxxxx has been identified through compliance purchases to have committed a violation, he/she will be notified in writing by the Department that such a violation has occurred and that future violations can result in termination from the program. A copy of the letter will be provided to the market sponsor or manager. c. If a xxxxxx is identified through a second compliance purchase to have committed a second such violation, he/she will be again notified in writing and required to provide an explanation by a specified date and/or to participate in a violation conference to discuss continued participation in the program. A copy of the letter will be provided to the market sponsor or manager. Violations that occurred in the prior year will be considered to be part of a consecutive series. d. A second violation may, and a third violation will result in disqualification from the FMNP. Immediate disqualification from the FMNP will occur if a xxxxxx: (1) is found to be trafficking FMNP checks or (2) is found to be discriminating against check customers or (3) fails to respond to a second violation notice or (4) fails to attend a scheduled violation conference. e. If a disqualification decision is made by the Department, the xxxxxx will be notified in writing that he/she is being disqualified from the program. Farmers disqualified from the program may be ineligible to participate in future years. Upon disqualification, the xxxxxx’x stamp will be cancelled immediately and will no longer be valid for check depositing or cashing. The xxxxxx must then return his/her FMNP stamp, FMNP sign, and FMNP ID card to the Department. A disqualified xxxxxx may request a Fair Hearing at the Department at which an Administrative Hearing Officer will review the disqualification decision.
Violations and Sanctions. ‌ A vendor who commits fraud or abuse in the WIC Program is liable to prosecution under applicable federal, state and local laws. Those who have willfully misapplied, stolen or fraudulently obtained program funds will be subject to a fine of not more than $25,000 or imprisonment for not more than five years or both, if the value of the funds is $100 or more. If the value is less than $100, the penalties are a fine of not more than $1,000 or imprisonment for not more than one year or both. The following is the list of violations and sanctions that will be applied to vendors. In applying the sanctions listed, the WIC Program is under no obligation to determine a vendor’s intent. The sanctions may be applied equally for error, ignorance or willful intent. The WIC Program will determine the impact of a potential vendor disqualification upon participant access to WIC Program benefits. A vendor may not withdraw from the WIC Program in order to avoid a sanction. Non-renewal of a vendor’s agreement may not be used as an alternative to disqualification. Sanctions may include a claim for the value of WIC benefits/CVBs as well as administrative fines, disqualification and/or civil money penalties. After disqualification for any length of time, a vendor must reapply and meet all WIC Program selection criteria before being readmitted to the Arkansas WIC Program. A vendor may not reapply during the disqualification period.

Any subsequent instances of violation will be met with a 4-month disqualification: i. Accepting Farm Direct vouchers for ineligible foods. ii. Failing to prominently display the program sign provided by OHA, on each day at each selling location. iii. Failing to provide Farm Direct shoppers with the full amount of product for the value of each Farm Direct voucher. iv. Failing to ensure that Farm Direct shoppers receive equitable treatment, including the availability of produce that is of the same quality and no greater price than sold to other shoppers. v. Charging sales tax on Farm Direct voucher purchases vi. Seeking restitution from Farm Direct shoppers for vouchers not paid by the Authority. vii. Giving cash back for purchases less than the value of a Farm Direct voucher. viii. Accepting Farm Direct vouchers from an unauthorized farmer. ix. Failing to respond to requests, implement corrective action, or comply with the terms in final orders as directed by the Authority. x. Using Farm Direct vouchers for any purpose other than to process for payment. b. The first instance of the following violation(s) will be met with a Notice of Non- Compliance. Any subsequent instances will be met with a denial of authorization the following season: i. Failing to reimburse the State for Farm Direct vouchers improperly transacted. ii. Failing to cooperate with staff from the Authority or their designees in monitoring for compliance with Farm Direct program requirements and failing to provide information the Authority or their designees may require. c. Any instance of the following violation will be met with a 4-month disqualification: i. Providing credit in exchange for Farm Direct vouchers. d. Any instance of the following violation(s) will be met with an immediate disqualification for the remainder of the current season and the entire following season: i. Trafficking in Farm Direct vouchers (exchanging vouchers for cash, controlled substances, tobacco products, firearms, or alcohol in any amount). ii. A USDA-substantiated violation of laws regarding non-discrimination, and applicable USDA instructions.

I understand that failure to fully participate, failure to appear, positive urine tests, and other program failures will result in sanctions being imposed against me which may include being in custody pending a SRC program termination hearing or summary termination from the SRC program. 3. I understand that any attempt to falsify a urine test is grounds for immediate termination from the SRC program and it is grounds for revocation of my probation and imposition of my suspended sentence. I understand that a missed test will be considered a test which is positive for drugs and will be subject to the same sanctions as a test which actually tested positive for drugs. 4. I understand that a failure to appear for a court date or any other breach of this Agreement will result in an immediate bench warrant.

Violations and Sanctions. Juventus reserves the right to suspend the provision of services to Juventus Official Fan Clubs, and therefore to members of that Juventus Official Fan Club, at any time in the event that Juventus Official Fan Clubs or their members have been responsible for particularly serious behaviour towards Juventus and/or other Juventus Official Fan Clubs, or have been involved in actions or events that represent a breach of the rules of Juventus’ Code of Ethics (attachment 2), the Allianz Stadium regulations (attachment 3), the regulations for assigning tickets (attachment 4), the terms and conditions of the use of season tickets and the sales conditions for individual tickets. Any temporary suspension of services to a Juventus Official Fan Club shall be communicated to the Juventus Official Fan Club in question and the relevant regional representative by email or certified email to the address provided on the Juventus Official Fan Club registration form. The suspension and/or interruption of services will not entitle the Juventus Official Fan Club and/or its members to request any type of refund for the fees paid to purchase member cards.
Violations and Sanctions. If it is determined that an Applicant has violated any terms of this Agreement, TIBCO will provide the Applicant written notice of such violations and any applicable sanctions. TIBCO reserves the right to impose sanctions for violations of any terms of this Agreement, in TIBCO’s discretion, including but not limited to, withholding certifications, retention of exam fees, de-certification of all previous attained certifications, and permanent ban from registering for or taking any further TIBCO exams.
