Waiver and Breach. No failure by a Party to insist upon the strict performance of any covenant, agreement, term, or condition of this Addendum shall constitute a waiver of any such breach or such covenant, agreement, term, or condition. Any Party may waive compliance by the other Party with any of the provisions of this Addendum if done so in writing. No waiver of any provision shall be construed as a waiver of any other provision or any subsequent waiver of the same provision.
Waiver and Breach. The waiver by either party of a breach of any provision of this Agreement by the other party shall not operate or be construed as a waiver of any subsequent breach of that provision or any other provision hereof.

In the event that AVFRD is required to file a legal action because of a breach of this Agreement by the RENTER, the RENTER shall be responsible for the costs of the action, including, but not limited to, attorneys’ fees, expert witness fees or other professionals’ fees, as determined by the court.
