Waiver and Breach. No failure by a Party to insist upon the strict performance of any covenant, agreement, term, or condition of this Addendum shall constitute a waiver of any such breach or such covenant, agreement, term, or condition. Any Party may waive compliance by the other Party with any of the provisions of this Addendum if done so in writing. No waiver of any provision shall be construed as a waiver of any other provision or any subsequent waiver of the same provision.
Waiver and Breach. The waiver by either party of a breach of any provision of this Agreement by the other party shall not operate or be construed as a waiver of any subsequent breach of that provision or any other provision hereof.
Waiver and Breach. No waiver of the enforcement or breach of any portion of this Agreement is a waiver of any other breach or of the enforcement of any other portion of the Agreement. No extension of time for performance is an extension of the time for any other performance.
Waiver and Breach. A waiver by the Association of any breach of any term or condition hereof shall not be deemed a waiver of any other, or any subsequent breach. In the event that the Association is required to file a legal action due to a breach of this Agreement by the Member/Homeowner, the Member/Homeowner shall be responsible for the costs of the action, including, but not limited to, reasonable attorney’s fees as determined by the court.

In the event that the Association is required to file a legal action due to a breach of this Agreement by the NON-SRA Member, the NON-SRA Member shall be responsible for the costs of the action, including, but not limited to, reasonable attorney’s fees as determined by the court.
Waiver and Breach. The waiver by either party of any default or breach of the Agreement shall not constitute a waiver of any other default or breach, or subsequent default or breach.

(b) A breach of any term of this Lease Addendum shall constitute a breach of the Lease.
Waiver and Breach. A waiver by AVFRD of any breach of any term or condition hereof shall not be deemed a waiver of any other or any subsequent breach. In the event that AVFRD is required to file a legal action because of a breach of this Agreement by the RENTER, the RENTER shall be responsible for the costs of the action, including, but not limited to, attorneys’ fees, expert witness fees or other professionals’ fees, as determined by the court.
Waiver and Breach. A waiver by the VaW HOA of any breach of any term or condition hereof shall not be deemed a waiver of any other, or any subsequent breach. In the event that the VaW HOA is required to file a legal action due to a breach of this Agreement by the Applicant, the Applicant shall be responsible for the costs of the action, including, but not limited to, reasonable attorney’s fees as determined by the court.
