WAIVER AND HOLD HARMLESS. I am fully aware that the work associated with being a City of Spokane Volunteer involves certain risks of physical injury, property damage, or death. In consideration for the experience and other personal benefits gained by being permitted to volunteer for the City of Spokane, to the maximum extent permitted by law, I voluntarily assume all risks of bodily injury or property damage associated with participation. I agree to defend, indemnify, and save harmless the City of Spokane, its appointed and elected officers, employees, agents, and representatives from and against all loss or expense including but not limited to judgments, settlements, attorney fees, and costs for bodily injury, death, or property damage arising out of any act or omission under or in connection with my volunteering except only such injury as shall have been occasioned by the sole negligence of the City of Spokane, its appointed and elected officers, employees, agents, or representatives. To the extent any of the damages referenced herein were caused by or resulted from the concurrent negligence of the City of Spokane, its elected and appointed officers, employees, agents, or representatives and others, this obligation to indemnify, defend, and hold harmless is valid and enforceable to the extent of the negligence of the volunteer. Further, I understand that I am not an employee or agent of the City of Spokane and that I have no claim to any industrial insurance (i.e., workers compensation) or other healthcare-related benefits. WAIVER AND HOLD HARMLESS. I am fully aware that the work associated with being a City Volunteer involves certain risks of physical injury or death. Being fully informed as to these risks and in consideration of my being allowed to participate in the City’s Volunteer Program, I hereby assume all risk of injury, damage and harm to myself arising from such activities or use of City facilities. I also hereby individually and on behalf of my heirs, executors and assignees, indemnify and hold harmless the City, its officials, employees and agents and release and waive any right of recovery I might have to bring a claim or a lawsuit against them for any personal injury, death, or other consequences occurring to me arising out of my volunteer activities.
WAIVER AND HOLD HARMLESS. In consideration for being granted permission to work as a gardener at the above- referenced Community Garden, I, the undersigned, hereby agree for myself and for my personal representatives.
WAIVER AND HOLD HARMLESS. Licensee shall indemnify and hold harmless the University, its agents, officers, and employees from and against all claims, damages, losses and expenses, including attorney’s fees, arising out of or resulting from this license, provided that such claim, damage, loss or expense is not caused by any negligent act or omission or willful misconduct of the University or its employees or agents acting within the scope of their duties.
WAIVER AND HOLD HARMLESS. In consideration of the opportunity afforded to me to attend and participate in the City Event described above, I will not make a claim against the City or any or any of its officers, employees, or directors collectively for injury or death, or damage to my property, however caused, arising from my attendance and participation in a City event, including the negligence of the City. Without limiting the generality of the foregoing, I hereby waive and release any rights, actions, or causes of action resulting from personal injury or death or damage to my property, sustained in connection with my attendance and participation the City Event, including those resulting from the negligence of the City. In the event any suit is brought, I agree for myself, executors, administrators, heirs, and assigns to defend, indemnify, and hold harmless the City or any of its officers, employees, or directors collectively or individually, from any and all liability for any sums or damages personally or to property whether such claims are brought in equity or at law which might arise out of my participation in the City Event described above, including, but not limited to, death or injury, including attorneys’ fees, costs, and expenses, including those resulting from the negligence of the City. THIS RELEASE AND HOLD HARMLESS TO THE CITY AND OTHERS RELATES TO ALL CLAIMS BASED UPON ACTS AND ALLEGED FAILURES TO ACT, INCLUDING CLAIMS BASED UPON THE NEGLIGENCE OF THE CITY. Medical Treatment. I hereby consent to the administration of first aid and other medical treatment in the event of an injury and agree to pay the costs of any such medical expenses. I hereby release and forever discharge the City from any claim whatsoever which arises or may hereafter arise because of any first aid, treatment, or service rendered in connection with my participation and activities in City Event.
WAIVER AND HOLD HARMLESS. 17.1 Except as provided in Section 8, Intel hereby WAIVES and RELINQUISHES any claim, right, title or interest in any ad valorem property tax payments made under Section 5.2 of this Agreement and shall not be entitled to any refund of said payments, in the event that the DOR or a court of competent jurisdiction determines that the levy of ad valorem property taxes on any property in accordance with this 2014 SIP Agreement is inconsistent with or not authorized by Oregon law.
WAIVER AND HOLD HARMLESS. Except as otherwise specifically provided by Nevada Revised Chapter 41, PIC hereby agrees to fully indemnify, waive, discharge, and forever release the City, its officers, officials, employees, and volunteers from any and all injures, claims (including, but not limited to, claims for damages for death, personal injury, personal injury, or property damage), demands, actions, suits, costs, (including attorney’s fees), and liabilities of any character whatsoever which PIC or PIC’s members, employees, or volunteers may have, or which hereafter may accrue, involving or relating to any and all harm, injury or damage suffered by PIC or PIC’s members, employees, or volunteers, or arising out of PIC or PIC’s members, employees, or volunteer’s participation in the above activity. This release is intended to discharge the City, its officers, officials, employees, and volunteers from and against any and all liability (including attorney’s fees) arising out of or connected in any way with PIC or PIC’s members, employees, or volunteers participation in the activity. PIC further understands that accidents and injuries can arise out of the activity, unforeseen, and to release and to hold harmless all of the persons or agencies mentioned above who, through negligence or carelessness might otherwise be liable to PIC or PIC’s members, employees, or volunteers, or PIC or PIC’s members, employees, or volunteer’s heirs, personal representatives, successors, or assigns for damages. It is further understood and agreed that this waiver, release, and assumption of risk is to be binding on PIC’s heirs, personal representatives, successors, and assigns.
WAIVER AND HOLD HARMLESS. Both Buyer and Seller acknowledge that the preparer of this document, Law Office of Xxxxxx Xxxxxxx, LTD. has prepared this document solely to facilitate the sale of the Shares from Seller to Buyer. As such, Buyer and Seller each hereby agrees to indemnify and hold preparer harmless from any disputes arising between Buyer and Seller in connection with this Agreement and the sale of the Shares, and from any costs and expenses which may be incurred by preparer in connection therewith. Further, Buyer and Seller acknowledge that no legal advice has been rendered by the preparer of this document to either Buyer or Seller, that they each have had an adequate opportunity to have their own respective counsel review this Agreement and have sought and do acknowledge seeking individual legal, accounting and investment advice from their own accountants, lawyers and other professionals to the extent deemed desirable to them in their sole discretion. Both Seller and Buyer consent to preparer's being the scrivener of this document and acknowledge that preparer was previously counsel for Applied DNA Sciences, and now represents Applied DNA Sciences through Sichenzia Xxxx Xxxxxxxx Xxxxxxx LLP and as such do not represent either Buyer or Seller in this transaction.
WAIVER AND HOLD HARMLESS. The Applicant and the Responsible Party agree to release and waive any and all claims that may arise against Fannin County, its agents, representatives, officials or employees relating, directly or indirectly, to the Event, without limitation, including claims arising solely from Fannin County, its agents, representatives, officials or employees negligence. FURTHERMORE, the Applicant and the Responsible Party agree to save and hold Fannin County, its agents, representatives, officials and employees harmless from and against any and all liabilities, costs, damages, expenses, and attorney’s fees resulting from or attributable to them, or someone claiming through them, asserting a claim against Fannin County, its agents, representatives, officials or employees relating, directly or indirectly, to the Event. I agree to the above stated terms and conditions, and have had an opportunity to review this agreement with an attorney of my own choosing.
