Warranty Exceptions. PTC shall have no warranty obligations hereunder with respect to (i) New Releases (for which the terms of Maintenance Services shall apply), (ii) computer software provided to Customer in the course of PTC’s delivery of Training Services; (iii) any Error attributable to the use of the Licensed Product in an application or environment for which it was not designed or contemplated, or attributable to modifications of the Licensed Product by anyone other than PTC or its employees or agents; and/or (iv) Bundled Third Party Products.
Warranty Exceptions. Seller's obligations pursuant to this Section 13 shall not apply where:
(i) Custom Items are manufactured to Buyer's detailed design and such design is the cause of the claim; or (ii) Items are used in combination with equipment, software or other products that are (x) not supplied, required or recommended by Seller, and (y) not reasonably utilized within the scope of the intended use of the Items, and (z) such infringement would not have occurred but for such combination.
Warranty Exceptions. Videojet’s warranties herein do not cover failure of warranted goods resulting from: (i) accident, abuse, misuse, neglect or any other use not in accordance with Videojet’s recommendations, accompanying documentation, published specifications, and standard industry practice; (ii) fire, flood, lightning or any other act of God, Buyer or third party; (iii) Buyer’s failure to provide power, air, supplies, storage conditions, or an operating environment that conforms to Videojet’s accompanying documentation and published specifications; (iv) failure to follow the maintenance procedures in Videojet’s accompanying documentation or published specifications; (v) repair or service by anyone other than Videojet or its authorized representatives; (vi) the warranted goods or any part thereof, including without limitation the ink system and thermal transfer printheads, being used, or coming into contact, with any equipment, parts, supplies or consumables not manufactured, distributed, or approved by Videojet; (vii) any attachments to the warranted goods not manufactured, distributed or approved by Videojet; or (viii) any modifications to the warranted goods not approved by Videojet. This Warranty Policy covers goods owned, leased or otherwise held only by Buyer at all times (and no other third parties), and located only in the United States, Puerto Rico and the Caribbean countries, unless otherwise prohibited by law. Videojet warrants that all services shall be performed in a professional and workmanlike manner in accordance with applicable industry standards for 30 days after performance. For the avoidance of doubt, repeat services on any equipment required to repair any prior or new issues are not covered by this warranty unless such issues arise from previous services provided by Videojet that failed to meet this service warranty. Videojet in its sole but reasonable discretion shall determine whether any of the exceptions herein apply.
Warranty Exceptions. PTC shall have no warranty obligations hereunder with respect to any (i) evaluation, “trial” or “express” Licenses, (ii) New Releases, (iii) computer software provided to Customer in the course of PTC’s delivery of Training Services, (iv) Errors attributable to the use of the Licensed Product in an application or environment for which it was not designed or contemplated, (v) Errors attributable to any modifications or customizations of the Licensed Products, (vi) Licensed Products that are provided by PTC free of charge to Customer, and/or (vii) Sun Software, Oracle Software and/or Bundled Third Party Products.
Warranty Exceptions. 1. Except as otherwise noted in this Section 11, HP does not warrant that the operation of Products shall be uninterrupted or error free.
2. Some newly manufactured Products may contain, and in supporting such Products HP may use, remanufactured parts that are equivalent to new in performance.

Warranty Exceptions. The warranties set forth in Section 7.1 shall not apply to: (a) any Product that, following delivery EXW as set forth in Section 5.1, is misused, neglected, improperly stored or handled, altered, abused or used for any purpose other than the one for which it was manufactured (including any Non-Conforming Use) or other conditions beyond the control of Parent, its Affiliates or their respective agents; or (b) any Product that, following delivery EXW as set forth in Section 5.1, suffers any damages or defects caused by unauthorized repair or use of parts or components not provided by Parent or its Affiliates under this Agreement for use in connection with the Product.
Warranty Exceptions. This Warranty shall be void in the event of any of the following:
a. Alterations or repairs made to the applicable System’s supporting structure, or to any part of such System or associated wiring and parts without Contractor’s prior written approval;
b. Use of such System beyond the scope contemplated in its operating manuals or Technical Specifications;
c. A change in usage of the applicable Site, which may affect building or site permits and related requirements, without the written approval of Contractor; and
d. Damage, malfunction or degradation of electrical output caused by third-‐party abuse, negligence, improper use or vandalism.
Warranty Exceptions. This warranty shall not be applicable or extend to or shall become void in the following cases :
1) Minor/permissible change/variation, hairline cracks and dampness caused due to settlement, humidity, variations in temperature, electrical conduits, etc.
2) In case the Allottee carries out any work within the Said Unit after taking possession such as structural or architectural changes from the original design attributes, demolition, dismantling, making openings, removing or re-sizing the original structural framework, putting excess or heavy loads or using the premises other than for its intended purpose;
3) In case the Allottee carries out any work within the Said Unit after taking possession, resulting in cracks and dampness, or any other defect within or to the adjoining Said Unit/shop, then in such an event the Promoter shall not be liable to rectify or pay compensation. But the Promoter may offer services to rectify such defects at nominal charges.
4) any structure/item/specification that is broken or damaged due to mishandling, misuse, wear-and- tear or due to inadequate preventive maintenance by the Allottee(s) or his/her/their/its tenants or occupants of the Said Unit.
5) Extra Items & Changes including materials supplied/procured/delivered by the Allottee(s).
6) damage due to mishandling/misuse/wear and tear due to any construction/addition/alteration/ modification in or of the Said Unit installed or carried out by the Allottee(s) or his/her/their/its agent(s) or due to the result of said damages being caused due to activities/actions of other Allottees or Society after the Promoter has handed over possession of the Said Unit or during any furnishing and interior decoration thereof by the Allottee(s).
7) any use that the Said Unit may be put to in contravention of the terms and conditions herein.
8) Structural defects caused by accidental breaking of fire or any kind of explosion of gas cylinder etc.
9) Structural defects induced anyhow by failure of waterproofing system(s) of the premises or the building.
10) Structural defects induced by Force Majeure situations, such as war, flood, act of God, explosions of any kind by terrorist, Civil Commotion, etc.
11) Structural defects occurring in the Said Unit or Project Building that has undergone civil renovations.
