Warranty for Service. In addition to the warranties provided in the Agreement, IBM warrants that it performs each IBM Service using reasonable care and skill and according to its current description.

Model N warrants that the Service will substantially perform in all material respects in accordance with the Documentation, and that the Service will meet the requirements set forth in the SLA. In the event of a breach of the foregoing warranty, as Customer’s sole and exclusive remedy, Model N will provide the remedy set forth in the SLA unless the breach of warranty constitutes a material breach of the Agreement and Customer elects to terminate the Agreement.

Warranty for Service. Contractor warrants that the Cloud Solutions and Related Services shall conform in all material respects with all requirements set out in the Participating Addendum and Contract and that all Cloud Solutions and Related Services shall be performed in accordance with the highest professional standards.
Warranty for Service. IBM warrants that it performs the Service using reasonable care and skill and according to its current description contained in this Agreement and any Attachments. You agree to provide timely written notice of any failure to comply with this warranty so that IBM can take corrective action. THIS WARRANTY IS YOUR EXCLUSIVE WARRANTY AND REPLACES ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IBM does not warrant uninterrupted or error-free operation of the Service or that IBM will correct all defects.
