WARRANTY TERMS. The Seller shall provide warranty for the quality of the Equipment for a period of 12 months. The warranty term shall commence on the day following the date of signing of the Handover Protocol pursuant to Section 10.4 hereof. In case the Buyer accepted the Equipment with defects or unfinished work the warranty term shall commence on the day following the date of removal of the defects or unfinished work. The warranty does not cover consumable things.

WARRANTY TERMS. 14.1 The Seller shall provide warranty for the quality of the Equipment 14.1.1 for a period of 36 months in case of the cryostat itself and 14.1.2 for a period of 12 months in case of its built-in accessories. 14.2 The warranty term shall commence on the day following the date of signing of the acceptance protocol pursuant to Section 9.5 hereof. The warranty does not cover consumable things. 14.3 Should the Buyer discover a defect, he shall notify the Seller to rectify such defect using the e-mail address . The Seller is obliged to notify the Buyer without delay about any change of this email address. The Seller shall be obliged to review any warranty claim within 7 business days from receipt and to propose solution, unless agreed otherwise by the Parties. 14.4 During the warranty period the Seller shall be obliged to rectify any claimed defects within 2 months of receiving the Equipment for repair. In cases of unusual defects, the Seller shall be obliged to rectify the defect in the period corresponding to the nature of the defect and to define the deadline for the handover of the rectified Equipment. 14.5 During the warranty period any and all costs associated with defect rectification / repair including transport and travel expenses of Seller shall be always borne by the Seller. 14.6 The repaired Equipment shall be handed over by the Seller to the Buyer on the basis of a protocol confirming removal of the defect (hereinafter the “Repair Protocol”) containing confirmations of both Parties that the Equipment was duly repaired and is defect-free. 14.7 The repaired portion of the Equipment shall be subject to a new warranty term in accordance with Section 14.1, which commences to run on the day following the date when the Repair Protocol was executed. 14.8 The Seller declares that he shall ensure paid post-warranty [out-of-warranty] service for the period of 10 years after the expiration of the warranty; the service terms shall be identical to those of Sections 14.3 and 14.3. 14.9 The Seller undertakes to provide the Buyer with updates of the software controlling the Equipment for the entire term of warranty service.
WARRANTY TERMS. Product warranty terms, conditions, exceptions, exclusions and disclaimers are contained within the Product packaging, with HPE quotes, on indicated web pages or HPE Partner Portal, or upon request.

WARRANTY TERMS. The foregoing warranty is expressly in lieu of any other expressed or implied warranties, including implied warranty of merchantability or fitness for a particular purpose, and any other obligation or liability on the part of the Manufacturer in tort or otherwise, whether arising from negligence or acts constituting strict liability. In no event shall Manufacturer be liable for any loss of anticipated profits or for consequential damages.

WARRANTY TERMS. 8.1 PRODUCT WARRANTY - Riverstone warrants that Products purchased under this TellabsAgreement will conform to the Product Specifications applicable as of the date of Tellabs' Order throughout the Warranty Period. 8.2 REPAIR OR REPLACEMENT - Riverstone shall use commercially reasonable efforts to, at its option, repair, replace or issue a credit equal to the purchase price for Products that fail to meet the applicable Product Specifications during the Warranty Period. 8.3 RETURN, REPAIR OR REPLACEMENT PROCEDURES - Products shall be returned for repair or replacement as follows: 8.3.1 Tellabs shall pay all transportation charges for Products returned to Riverstone under these product warranty terms. Riverstone will pay all transportation charges back to the Tellabs or End User. In the event that no warranty repair or replacement is required, Riverstone reserves the right to charge Tellabs for the transportation incurred by Riverstone in returning the Product. 8.3.2 The return of all Products shall be controlled under a Return Material Authorization ("RMA") system maintained by Riverstone. Tellabs must obtain an RMA-number prior to returning any Products to Riverstone and supply Riverstone with the following information: (a) End User identification; (b) Product serial number; and (c) information relating to the failure, including system setup and other failure details. 8.3.3 Returned Products must be packaged and shipped to Riverstone using packing materials sufficient to prevent either accidental opening of the carton or damage to the Product resulting from normal handling during shipment. Tellabs is responsible for shipping charges. Riverstone will pay shipping costs and bear the risk of loss of returning repaired or replaced Products to Tellabs. 8.3.4 If it is not possible to repair or rework the returned Products within fifteen (15) Business Days, a replacement Product will be shipped to Tellabs without cost. If reasonably requested by Tellabs or its customers, Riverstone will provide repair reports for repaired or reworked Products.

WARRANTY TERMS. (a) Art Culinaire Lacanche hoods come with a three year limited warranty that applies as follows: (i) For three (3) years from the date of the hood delivery, the warranty will cover parts and labor required to repair or replace any component of the hood that is defective in materials, workmanship, or factory design, provided that the defect arises out of normal and reasonable use of the hood. Please note that if the hood is not properly installed the warranty may become void. The blower insert is not covered by Art Culinaire’s warranty but is covered under its manufacturer’s warranty. (b) If your hood comes with a Vent-A-Hood® Magic Lung® (B-Series and T-Series) blower insert, the manufacturer’s warranty is as follows: (i) For five (5) years from the date of purchase of the blower insert, the warranty will cover parts and one year of labor. (ii) The warranty does not cover: freight damage, blower wheel damage, light bulbs, damage or malfunction caused by faulty installation, incidental or consequential damage, commercial application, or misapplication or modification of or to any part of the Vent-A-Hood® product. (c) If your hood comes with a Modern-Aire blower insert, the manufacturer’s warranty is as follows: (i) For three (3) years from the date of purchase of the blower insert, the warranty will cover parts and labor. (d) Art Culinaire expressly excludes the replacement costs of stainless-steel surfaces and powder coated exterior panels for aesthetic reasons or material defects occurring prior to installation. Instead, these defects will only be covered for ninety (90) days from hood delivery. (e) You acknowledge that there may be variances in the color of the hood You receive. We at Art Culinaire believe that color variances are a feature of our bespoke, artisanal hoods based on our specific manufacturing methods. Accordingly, these variances are expressly excluded from the Terms and Conditions’ warranty. (f) To qualify under these Terms and Conditions’ warranty, repair and replacement services must be performed by service agents qualified or approved by Art Culinaire. In addition, the services must be pre-approved in writing by Art Culinaire. Art Culinaire disclaims, and You will be solely responsible for, labor, repair, and replacement costs that Art Culinaire has not pre-approved.
