Common use of Wet Weather Clause in Contracts

Wet Weather. During periods of wet weather that prevents work from being performed on certain areas of the Project, Lis-Con Concrete Construction Pty Ltd , where practical, will transfer affected Employees to alternative areas on the Project not so affected by wet weather, or to Lis-Con Concrete Construction Pty Ltd depot/yard to perform maintenance, service-type duties or training. The Parties agree that wet weather does not automatically create unsafe working conditions and that an Employee is not entitled to not attend work or leave the Project because of wet weather. The critical nature of the continuous operations is such that work shall continue during periods of wet weather, provided that in any situation where wet weather affects, or is likely to affect the safe performance of work in the area or activity concerned, affected Employees shall be consulted on the best method of completing work safely. The primary focus of these wet weather provisions is to provide a set of agreed procedures, which ensure that, through scheduling of working hours, loss of working time is minimised, and productive work is maximised without Employees being exposed to climatic conditions, which are unreasonable or unsafe to work in. All Employees shall be available to clean up and xxxxxxx relevant work areas as directed by Lis-Con Concrete Construction Pty Ltd following wet weather. Where a transfer is not practical, affected Employees will be entitled to payment for ordinary time lost through wet weather for up to 40 hours (non-cumulative) per 4 week period.
