Where the Secretary is satisfied that there is insufficient productive work available for the employee during the remainder of the retention period and that there are no reasonable redeployment prospects in the Australian Public Service: • the Secretary can terminate the employee’s employment under section 29 of the Public Service Act 1999; and • upon termination, the employee will be paid a lump sum comprising: - the balance of the retention period (as shortened for the National Employment Standards under clause 9.31) and this payment will be taken to include the payment in lieu of notice of termination of employment, plus - the employee’s National Employment Standards entitlement to redundancy pay.
