Wholesale Price. ITUNES will pay COMPANY the CMA Wholesale Price (as defined in this paragraph) for each CMA Transaction. The CMA Wholesale Price will equal the wholesale price under this Agreement for the CMA Album in effect at the time of the CMA Transaction (“Regular Wholesale Price”) less the sum of the wholesale prices ITUNES previously paid for the Purchased Tracks to COMPANY; provided, however, that the CMA Wholesale Price in no event shall be less than the wholesale price under this Agreement for a single track (a single music video in the event the CMA Album is a video-only album) in effect at the time of the CMA Transaction. For avoidance of doubt, ITUNES may determine retail prices on the Online Store, including retail prices for CMA Transactions, entirely at its sole discretion.

ITUNES shall pay COMPANY for eMasters sold by ITUNES hereunder the applicable wholesale prices set forth in Exhibit B-1, which wholesale prices shall remain in effect throughout the Term (subject to Section 4(b)). ITUNES shall pay COMPANY the applicable wholesale price in Sterling (GBP) with respect to sales from the Online Store in the United Kingdom, and in Euros with respect to sales from any other Online Store in the Territory. ITUNES shall provide notice (which may be by email) at least five (5) days prior to an increase in the retail price of an eMaster in any format (e.g., single-track, multi-track), and shall consider COMPANY’s views in relation to such increase in price. For avoidance of doubt, ITUNES reserves the right to determine the retail price in its sole discretion.

Wholesale Price. APPLE shall pay COMPANY the wholesale price for eMasters sold by APPLE hereunder, as set forth in Exhibit B attached hereto. COMPANY shall not increase the wholesale price of any particular eMaster during the Term. Apple reserves the right to determine the retail price in its discretion.
Wholesale Price. The Contractor may be paid the lowest current wholesale price for which the materials are available in the quantities required, including customary costs of delivery and all applicable taxes less all available discounts, rebates, and back-charges; or

Wholesale Price. Audible Content shall be provided to Apple at the Wholesale Price as set forth in Exhibit C attached hereto. Audible will provide Apple with written notice of any change in any eContent wholesale price, which changed price shall become effective twenty-four (24) hours after receipt by Apple of such written notice.
Wholesale Price. With respect to downloads, COMPANY shall pay CD Baby the greater of: (a) [***] percent ([***]%) of the applicable retail price to COMPANY’s customers with respect to each download or transmission of a Master Recording; or (b) the applicable wholesale price set by CD Baby from time to time with respect to each download or transmission of a Master Recording. With respect to Master Tones, COMPANY shall pay CD Baby the greater of: (a) [***] percent ([***]%) of the applicable retail price to COMPANY’S customers with respect to each download or transmission of a Master Tone; or (b) the applicable wholesale price set by CD Baby from time to time with respect to each download or transmission of a Master Tone. CD Baby shall give COMPANY no less than fifteen (15) days’ prior notice of any wholesale price changes. COMPANY shall be responsible for and shall pay any and all taxes as shall result from the sale of downloads and Master Tones, and the operation of COMPANY’S systems. The parties hereto agree that this Agreement is executed on a so-called “Most Favored Nations” basis.
