Common use of Without prejudice to the foregoing Clause in Contracts

Without prejudice to the foregoing. (a) The Developer and its Sub-Contractors shall be responsible to ensure compliance with the provision of the Minimum Wages Act, 1948 and the Rules made thereunder. (b) The Developer and its Sub–Contractors shall be responsible to ensure compliance with the provisions of the Apprentice Act, 1961 and the Rules and orders issued thereunder from time to time in respect of apprentices. (c) The Developer and its Sub-Contractors shall comply with the provisions of the Payment of Wages Act, 1936 and the rules thereunder. (d) The Developer shall comply with the provision of the Contract Labour (Regulation and Abolition) Act, 1970 and the Contract Labour (Regulation and Abolition) Central Rules 1971 as modified from time to time, where ever applicable. (e) The Developer shall be responsible for the safety of all employees directly or through Sub-Contracts employed by it on the Project and shall report serious accidents to any of them however and wherever occurring on the Project to the Nodal Officer or the Nodal Officer’s Representative and shall make every arrangement to render all possible assistance. (f) The Developer shall observe and make its Sub-Contractors observe and perform all the provisions of the Xxxxx Xxx,0000 or any statutory modifications or re-enactments thereof for the time being in force and any rule and regulations made thereunder. (g) For the purposes of all Applicable Laws, the Developer shall be deemed to be the principal employer of all workers working at the Project. The Developer shall indemnify Indemnified Parties from and against any Liabilities under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Authority or the Railway has to pay any compensation in respect of the Project, Authority shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Developer under these conditions.

(bii) The Developer Facility Manager and its Sub–-Contractors and Licensees shall be responsible to ensure compliance with the provisions of the Apprentice Act, 1961 and the Rules and orders issued thereunder from time to time in respect of apprentices. (f) The Developer shall observe and make its Sub-Contractors observe and perform all the provisions of the Xxxxx Xxx,0000 or any statutory modifications or re-enactments thereof for the time being in force and any rule and regulations made thereunder. (gvi) For the purposes of all Applicable Laws, the Developer Facility Manager shall be deemed to be the principal employer of all workers engaged (either directly or indirectly) by the Facility Manager and Sub- Contractors working at the SFM Project. The Developer shall Facility Manager hereby agrees to indemnify Indemnified Parties from and against any Liabilities claim under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Authority or the MOR and/ or Railway Administration has to pay any compensation in respect of the SFM Project, Authority shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Developer Facility Manager under these conditionsthe SFM Agreement.

The Developer Concessionaire and its Sub-Contractors shall be responsible to ensure compliance with the provision of the Minimum Wages Act, 1948 and the Rules made thereunder. (b) b. The Developer and its Sub–Contractors shall be responsible to ensure compliance with the provisions of the Apprentice Act, 1961 and the Rules and orders issued thereunder from time to time in respect of apprentices. (c) The Developer Concessionaire and its Sub-Contractors shall comply with the provisions of the Payment of Wages Act, 1936 and the rules thereunderthereunder as may be applicable from time to time. (d) c. The Developer Concessionaire shall comply with the provision of the Building and Other Constructions Workers Act, 1996 including all time-to-time amendments, Contract Labour (Regulation and Abolition) Act, 1970 and the Contract Labour (Regulation rules framed thereunder and Abolition) Central Rules 1971 as modified from time to time, where ever applicable. (e) d. The Developer Concessionaire shall be responsible for the safety of all employees directly or through Sub-Contracts employed by it on the Project and shall report serious accidents to any of them however and wherever occurring on the Project to the Nodal Officer Maha- Metro Representative or the Nodal OfficerMaha-Metro Representative’s Representative and shall make every arrangement to render all possible assistance. (f) e. The Developer Concessionaire shall observe and make its Sub-Contractors observe and perform follow all the provisions of the Xxxxx Xxx,0000 applicable labour laws and other statutory laws or any statutory modifications or re-enactments thereof for the time being in force and any rule and regulations made thereunder. (g) f. For the purposes of all Applicable Laws, the Developer Concessionaire shall be deemed to be the principal employer of all workers working at the Project. The Developer Concessionaire shall indemnify Indemnified Parties Maha-Metro from and against any Liabilities under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Authority Maha-Metro or the Railway has to pay any compensation in respect of the Project, Authority Maha-Metro shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Developer Concessionaire under these conditions.

(gvi) For the purposes of all Applicable Laws, the Developer Facility Manager shall be deemed to be the principal employer of all workers engaged (either directly or indirectly) by the Facility Manager and Sub- Contractors working at the SFM Project. The Developer shall Facility Manager hereby agrees to indemnify Indemnified Parties from and against any Liabilities claim under any of the Acts or Rules thereunder mentioned in this Article or any other Applicable Laws, and in case through order of any Government Authority, Authority or the MOR and/ or Railway Administration has to pay any compensation in respect of the SFM Project, Authority shall recover such amount of compensation so paid from the Security Deposit or the Escrow Account or otherwise from the Developer Facility Manager under these conditionsthe SFM Agreement.
